21	21	To require Federal agencies to conduct a benefit-cost analysis
22	22	on relocations involving the movement of employment
23	23	positions to different areas, and for other purposes.
24	24	Be it enacted by the Senate and House of Representa-1
25	25	tives of the United States of America in Congress assembled, 2
26	26	SECTION 1. SHORT TITLE. 3
27	27	This Act may be cited as the ‘‘Congressional Over-4
28	28	sight to Secure Transparency of Relocations Act’’ or the 5
29	29	‘‘COST of Relocations Act’’. 6

35	35	(a) I
36	36	NGENERAL.—Except as provided in subsection 3
37	37	(d), a Federal agency may not carry out a covered reloca-4
38	38	tion unless, prior to any submission to the Office of Man-5
39	39	agement and Budget or other reviewing entity regarding 6
40	40	such covered relocation— 7
41	41	(1) such agency— 8
42	42	(A) conducts a benefit-cost analysis on the 9
43	43	covered relocation; and 10
44	44	(B) submits to the Office of Inspector 11
45	45	General for such agency an unredacted report 12
46	46	on the findings of the benefit-cost analysis and 13
47	47	including such other information such Office of 14
48	48	Inspector General determines necessary for 15
49	49	compliance with subsection (c); and 16
50	50	(2) such Office of Inspector General reviews the 17
51	51	report and submits to Congress the report described 18
52	52	in subsection (c). 19

54	54	ENEFIT-COSTANALYSIS.— 20
55	55	(1) I
56	56	N GENERAL.—The benefit-cost analysis de-21
57	57	scribed in subsection (a)(1) shall be conducted in a 22
58	58	manner consistent with the economic and social 23
59	59	science principles articulated in the guidance appli-24
60	60	cable to relocations in the Office of Management and 25

72	72	(i) the anticipated outcomes and im-7
73	73	provements that will result from the pro-8
74	74	posed covered relocation, quantified in 9
75	75	monetary or other appropriate measures to 10
76	76	the extent practicable; 11
77	77	(ii) an explanation of how the pro-12
78	78	posed covered relocation will result in the 13
79	79	anticipated outcomes and improvements; 14
80	80	(iii) the metrics for measuring wheth-15
81	81	er the proposed covered relocation results 16
82	82	in the anticipated outcomes and improve-17
83	83	ments; 18
84	84	(iv) a detailed employee engagement 19
85	85	plan; 20
86	86	(v) a list of stakeholders; 21
87	87	(vi) a timeline of past and future en-22
88	88	gagements with stakeholders regarding the 23
89	89	proposed covered relocation; 24

94	94	posed covered relocation may affect stake-2
95	95	holders— 3
96	96	(I) served by the positions af-4
97	97	fected by the covered relocation; and 5
98	98	(II) in the destination agency or 6
99	99	region; 7
100	100	(viii) a comprehensive strategy for ac-8
101	101	complishing the proposed covered reloca-9
102	102	tion that includes— 10
103	103	(I) staffing, resourcing, and fi-11
104	104	nancial needs; 12
105	105	(II) an implementation timeline 13
106	106	identifying milestones and the persons 14
107	107	accountable for meeting such mile-15
108	108	stones; 16
109	109	(III) a risk assessment; 17
110	110	(IV) a risk mitigation plan; and 18
111	111	(V) documentation of ongoing 19
112	112	succession and recruiting planning 20
113	113	processes; 21
114	114	(ix) an analysis of the effect the pro-22
115	115	posed covered relocation may have on the 23
116	116	ability of the Federal agency to carry out 24

122	122	(x) an assessment of the short- and 3
123	123	long-term effects of the covered relocation 4
124	124	on the mission of the Federal agency. 5

126	126	UBLICATION.—A Federal agency 6
127	127	shall make publicly available the report de-7
128	128	scribed in subsection (a)(1)(B) in a form that 8
129	129	excludes any proprietary information or trade 9
130	130	secrets of any person and other confidential in-10
131	131	formation. 11
132	132	(c) I
133	133	NSPECTORGENERALREPORT TOCONGRESS.— 12
134	134	Not later than 90 days after the date on which a Federal 13
135	135	agency submits a report under subsection (a)(1)(B), the 14
136	136	Office of Inspector General for that agency shall submit 15
137	137	to the Committee on Homeland Security and Govern-16
138	138	mental Affairs of the Senate, the Committee on Environ-17
139	139	ment and Public Works of the Senate, the Committee on 18
140	140	Oversight and Government Reform of the House of Rep-19
141	141	resentatives, and the Committee on Transportation and 20
142	142	Infrastructure of the House of Representatives a report 21
143	143	on the findings of the review conducted under subsection 22
144	144	(a)(2), including— 23
145	145	(1) detailed descriptions of the data used in the 24
146	146	benefit-cost analysis described in subsection (a)(1), 25

152	152	(2) the conclusions of the benefit-cost analysis 3
153	153	and the analysis underlying such conclusions; and 4
154	154	(3) a comprehensive assessment of— 5
155	155	(A) the extent to which the Federal agency 6
156	156	adhered to the guidance in the Office of Man-7
157	157	agement and Budget Circular A–4, as in effect 8
158	158	on September 17, 2003, in conducting the ben-9
159	159	efit-cost analysis, including a determination 10
160	160	whether such adherence is sufficient to justify 11
161	161	the use of Federal funds for the proposed cov-12
162	162	ered relocation involved; and 13
163	163	(B) if the proposed covered relocation in-14
164	164	volves moving positions from inside the Na-15
165	165	tional Capital Region to outside the National 16
166	166	Capital Region, the extent to which real estate 17
167	167	options in the National Capital Region were 18
168	168	compared to those in the destination as part of 19
169	169	that analysis. 20

171	171	THERREQUIREMENTS NOTABROGATED.— 21
172	172	Nothing in this Act shall be construed to abrogate, reduce, 22
173	173	or eliminate any requirements imposed by law pertaining 23
174	174	to any covered relocation of a Federal agency or compo-24
175	175	nent of a Federal agency. 25

179	179	(e) DEFINITIONS.—In this Act: 1
180	180	(1) A
181	181	DMINISTRATIVE REDELEGATION OF FUNC -2
182	182	TION.—The term ‘‘administrative redelegation of 3
183	183	function’’ means a Federal agency establishing new 4
184	184	positions within the agency that replace existing po-5
185	185	sitions within the agency and perform the functions 6
186	186	of the positions replaced. 7
187	187	(2) C
188	188	OVERED RELOCATION .—The term ‘‘cov-8
189	189	ered relocation’’ means— 9
190	190	(A) an administrative redelegation of func-10
191	191	tion which, by itself or in conjunction with 11
192	192	other related redelegations, involves replacing 12
193	193	the existing positions of more than the lesser of 13
194	194	5 percent or 100 of the employees of the rel-14
195	195	evant Federal agency with new positions located 15
196	196	outside the commuting area of such employees; 16
197	197	(B) moving a Federal agency or any com-17
198	198	ponent of a Federal agency if such move, by 18
199	199	itself or in conjunction with other related 19
200	200	moves, involves moving the positions of more 20
201	201	than the lesser of 5 percent or 100 of the em-21
202	202	ployees of the Federal agency outside the com-22
203	203	muting area of such employees or under the ju-23
204	204	risdiction of another Federal agency; or 24

214	214	ployees or moved under the jurisdiction of an-7
215	215	other Federal agency. 8

217	217	MPLOYEE.—The term ‘‘employee’’ means 9
218	218	an employee or officer of a Federal agency. 10

220	220	EDERAL AGENCY .—The term ‘‘Federal 11
221	221	agency’’ has the meaning given the term ‘‘agency’’ 12
222	222	in section 902 of title 5, United States Code. 13

224	224	ATIONAL CAPITAL REGION .—The term 14
225	225	‘‘National Capital Region’’ has the meaning given 15
226	226	such term in section 8702 of title 40, United States 16
