FINDINGS. 1 The Congress finds the following: 2 (1) Each year, an estimated 4,200,000 youth 3 and young adults experience homelessness in the 4 United States. 5 (2) Youth and young adults face many barriers 6 to safe and stable housing, such as systemic and 7 structural racism, age discrimination, and a scarce 8 supply of affordable housing suitable for occupancy. 9 (3) Black, Indigenous, and other youth and 10 young adults of color have been systematically ex-11 cluded from employment opportunities and access to 12 stable income. 13 (4) Prior to the COVID–19 pandemic, 1 in 5 14 young people of color were living in poverty, as op-15 posed to 1 in 9 young White people, and the impact 16 of the pandemic has resulted in an exponential wid-17 ening of the inequity faced by Black, Indigenous, 18 and other youth and young adults of color when 19 seeking safe housing and careers of their choice with 20 stable income. 21 (5) Full-time minimum-wage earners cannot af-22 ford the average cost of a 2-bedroom apartment any-23 where in the United States. 24 (6) The changing nature of the economy—in-25 cluding the growth of the ‘‘gig economy’’ in which 26 VerDate Sep 11 2014 21:05 Apr 03, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2475.IH H2475 ssavage on LAPJG3WLY3PROD with BILLS 3 •HR 2475 IH workers earn income providing on-demand work, 1 services, or goods; unemployment risks posed by au-2 tomation; and the fluctuating nature of waged 3 labor—will result in increased income volatility and 4 prevent upward economic mobility, especially among 5 young adults. 6 SEC. 3. DEFINITIONS. 7 In this Act: 8 (1) A PPROPRIATE CONGRESSIONAL COMMIT -9 TEES.—The term ‘‘appropriate congressional com-10 mittees’’ means— 11 (A) the Committee on Financial Services 12 of the House of Representatives; 13 (B) the Committee on Ways and Means of 14 the House of Representatives; 15 (C) the Committee on Banking, Housing, 16 and Urban Affairs of the Senate; and 17 (D) the Committee on Finance of the Sen-18 ate. 19 (2) C ERTIFIED COMMUNITY DEVELOPMENT FI -20 NANCIAL INSTITUTION.—The term ‘‘certified com-21 munity development financial institution’’ means a 22 community development financial institution, as de-23 fined in section 103 of the Community Development 24 Banking and Financial Institutions Act of 1994 (12 25 VerDate Sep 11 2014 21:05 Apr 03, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2475.IH H2475 ssavage on LAPJG3WLY3PROD with BILLS 4 •HR 2475 IH U.S.C. 4702), certified by the Community Develop-1 ment Financial Institutions Fund under section 2 1805.201 of title 12, Code of Federal Regulations. 3 (3) C OUNCIL.—The term ‘‘Council’’ means the 4 National Youth Economic Advisory Council. 5 (4) D ATABASE.—The term ‘‘database’’ means 6 the database created under section 4(b)(1). 7 (5) F AIR MARKET RENT.—The term ‘‘fair mar-8 ket rent’’ means the applicable fair market rental es-9 tablished pursuant to section 8(c) of the United 10 States Housing Act of 1937 (42 U.S.C. 1437f(c)). 11 (6) H ISTORICALLY MARGINALIZED COMMU -12 NITIES.—The term ‘‘historically marginalized com-13 munities’’ includes low-income communities and mi-14 nority religious, racial, and ethnic groups. 15 (7) H OMELESS.—The term ‘‘homeless’’ has the 16 meaning given that term in section 103 of the 17 McKinney-Vento Homeless Assistance Act (42 18 U.S.C. 11302) and includes homeless children and 19 youths as defined in section 725 of such Act (42 20 U.S.C. 11434a). 21 (8) L OW-INCOME GEOGRAPHIC AREA .—The 22 term ‘‘low-income geographic area’’ has the meaning 23 given that term in section 351 of the Small Business 24 Investment Act of 1958 (15 U.S.C. 689). 25 VerDate Sep 11 2014 21:05 Apr 03, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H2475.IH H2475 ssavage on LAPJG3WLY3PROD with BILLS 5 •HR 2475 IH (9) PAYMENT-RECEIVING GROUP .—The term 1 ‘‘payment-receiving group’’ means the group des-2 ignated to receive cash payments pursuant to section 3 4(c)(3). 4 (10) P ILOT PROGRAM.—The term ‘‘pilot pro-5 gram’’ means the Youth Homelessness Guaranteed 6 Income Pilot Program. 7 (11) P ROGRAM PAYMENT .—The term ‘‘program 8 payment’’ means a payment made under section 9 4(c)(3). 10 (12) R ACIAL AND ETHNIC MINORITY GROUP .— 11 The term ‘‘racial and ethnic minority group’’ has the 12 meaning given the term in section 1707(g) of the 13 Public Health Service Act (42 U.S.C. 300u–6(g)). 14 (13) S ECRETARY.—The term ‘‘Secretary’’ 15 means the Secretary of Health and Human Services. 16 (14) S OCIALLY DISADVANTAGED GROUP .—The 17 term ‘‘socially disadvantaged group’’ means a group 18 whose members have been subjected to racial, ethnic, 19 or gender prejudice because of their identity as 20 members of a group without regard to their indi-21 vidual qualities. 22 VerDate Sep 11 2014 21:05 Apr 03, 2025 Jkt 059200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H2475.IH H2475 ssavage on LAPJG3WLY3PROD with BILLS 6 •HR 2475 IH SEC. 4. THE YOUTH HOMELESSNESS GUARANTEED INCOME 1 PILOT PROGRAM. 2 (a) I NGENERAL.—The Secretary shall establish a 3 program, entitled the ‘‘Youth Homelessness Guaranteed 4 Income Pilot Program’’, to provide housing assistance to 5 certain eligible individuals in accordance with this section. 6 (b) P REPARATION.—Within 2 years after the date of 7 the enactment of this Act: 8 (1) D ATABASE OF HOMELESS INDIVIDUALS .— 9 (A) C REATION OF DATABASE .—The Sec-10 retary shall create a database of individuals 11 who are homeless while living in the United 12 States containing the information described in 13 section 6(b)(1). 14 (B) E LIGIBLE PARTICIPANTS.—Based on 15 the recommendations issued by the Council 16 under section 6(b)(1), the Secretary— 17 (i) shall make reasonable efforts using 18 reliable sources to identify homeless indi-19 viduals for inclusion in the database; and 20 (ii) may communicate recommenda-21 tions to the Secretary of Agriculture, the 22 Secretary of Education, or the Secretary of 23 Housing and Urban Development with re-24 spect to the prescription of regulations de-25 scribed in subparagraph (C). 26 VerDate Sep 11 2014 21:05 Apr 03, 2025 Jkt 059200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H2475.IH H2475 ssavage on LAPJG3WLY3PROD with BILLS 7 •HR 2475 IH (C) AUTHORITY TO PRESCRIBE REGULA -1 TIONS.—The Secretary of Agriculture, the Sec-2 retary of Education, and the Secretary of Hous-3 ing and Urban Development may each prescribe 4 regulations requiring a recipient of funds or 5 other assistance under the McKinney-Vento 6 Homeless Assistance Act (42 U.S.C. 11301– 7 11435)— 8 (i) to make reasonable efforts to iden-9 tify homeless individuals who receive bene-10 fits or assistance provided through the 11 funds; and 12 (ii) to submit sufficient information to 13 the Secretary for the homeless individuals 14 to be listed in the database. 15 (D) R EQUIREMENTS FOR DATABASE IN -16 FORMATION.—The Secretary— 17 (i) shall verify the accuracy of the in-18 formation in the database; or 3 (II) administer the pilot program 4 with the individual as a participant; 5 and 6 (iii) may not include in the database 7 any information about the citizenship sta-8 tus, immigration status, or Social Security 9 number of any individual listed in the 10 database. 11 (E) R EPORT TO CONGRESS ON THE DATA -12 BASE.—The Secretary shall submit a written 13 report to the appropriate congressional commit-14 tees describing the process used to create the 15 database. 16 (2) S ELECTION OF PILOT PROGRAM PARTICI -17 PANTS.— 18 (A) C RITERIA.—The Secretary, in coordi-19 nation with the External Partner and the Coun-20 cil, shall develop criteria for the selection of 21 pilot program participants that are— 22 (i) consistent with the objectives of 23 the study described in section 5; and 2 (iii) representative of the demo-3 graphics of the population of homeless in-4 dividuals in the United States who have 5 not attained 30 years of age. 6 (B) S ELECTION.—The Secretary shall se-7 lect, consistent with the criteria developed 8 under subparagraph (A), not more than 9 105,000 individuals listed in the database to 10 participate in the pilot program, each of whom 11 shall be— 12 (i) an emancipated minor; or 13 (ii) an individual who has attained 18 14 years of age but not 30 years of age. 15 (C) I MPERMISSIBLE FACTORS .—The Sec-16 retary may not use citizenship or immigration 17 status as factors in the selection of pilot pro-18 gram participants. 19 (3) C ONDITIONS FOR PARTICIPATION IN THE 20 PILOT PROGRAM.—An individual may not participate 21 in the pilot program until the individual, in a form 22 and manner determined by the Secretary— 23 (A) consents to the disclosure of Federal 24 and State income tax return information of the 25 VerDate Sep 11 2014 21:05 Apr 03, 2025 Jkt 059200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6201 E:\BILLS\H2475.IH H2475 ssavage on LAPJG3WLY3PROD with BILLS 10 •HR 2475 IH individual to the Secretary and the External 1 Partner; and 2 (B) discloses other personal information 3 determined by the Secretary to be necessary for 4 the administration of the pilot program and the 5 study described in section 5, including the ZIP 6 Code of the primary place of residence main-7 tained by the individual. 8 (c) P ROVISION OFASSISTANCE.— 9 (1) D URATION.—The Secretary shall provide 10 the assistance described in this subsection to the 11 pilot program participants for 36 consecutive 12 months. 13 (2) A SSISTANCE AVAILABLE TO ALL PARTICI -14 PANTS.—Based on the recommendations issued by 15 the Council under section 6(b)(2), and in consulta-16 tion with the External Partner, the Secretary shall, 17 directly or by contract or cooperative agreement, 18 provide to each participant, appropriate to the cir-19 cumstances of the participant, the following: 20 (A) Housing navigation services. 21 (B) Financial coaching courses. 22 (C) Workforce development services. 23 (D) Educational attainment services. 24 VerDate Sep 11 2014 21:05 Apr 03, 2025 Jkt 059200 PO 00000 Frm 00010 Fmt 6652 Sfmt 6201 E:\BILLS\H2475.IH H2475 ssavage on LAPJG3WLY3PROD with BILLS 11 •HR 2475 IH (E) Education on the landlord-tenant laws 1 of the jurisdiction of residence of the partici-2 pant and the rights that the participant would 3 have as a tenant. 4 (F) Additional services recommended by 5 the Council and the External Partner, at the 6 discretion of the Secretary. 7 (G) Assistance in identifying, applying for, 8 and using any service or assistance available to 9 the participant that is funded under the McKin-10 ney-Vento Homeless Assistance Act (42 U.S.C. 11 11301–11435). 12 (3) C ASH PAYMENTS TO THE PAYMENT -RECEIV-13 ING GROUP.— 14 (A) D IVISION INTO 2 GROUPS.—The Sec-15 retary shall— 16 (i) divide the participants randomly 17 into 2 groups, approximately equal in size 18 and equally representative with respect to 19 the criteria for the selection of partici-20 pants; and 21 (ii) designate 1 group to receive cash 22 payments pursuant to this paragraph. 23 (B) F REQUENCY; AMOUNT.— 24 VerDate Sep 11 2014 21:05 Apr 03, 2025 Jkt 059200 PO 00000 Frm 00011 Fmt 6652 Sfmt 6201 E:\BILLS\H2475.IH H2475 ssavage on LAPJG3WLY3PROD with BILLS 12 •HR 2475 IH (i) IN GENERAL.—The Secretary shall 1 make a payment to each member of the 2 payment-receiving group every month for 3 the duration described in paragraph (1), 4 with each monthly payment in the amount 5 equal to or the greater of $1,400 or the 6 adjusted fair market rent cost for the 7 member involved. 8 (ii) A DJUSTED FAIR MARKET RENT 9 COST.—The Secretary shall determine the 10 adjusted fair market rent cost for such a 11 member based on the fair market rent cost 12 for a 2-bedroom home in the ZIP Code 13 designated by the member and any modi-14 fications recommended by the Council 15 under section 6(b)(4). 16 (iii) L UMP SUM PAYMENT PERMITTED 17 FOR THE 1ST YEAR .—Notwithstanding 18 clause (i), not more than half of the mem-19 bers of the payment-receiving group may 20 elect to receive not more than the first 12 21 monthly payments under clause (i) in a 22 single lump sum payment. 23 (C) F ORMS OF PAYMENT .—The Secretary 24 shall make each program payment by whichever 25 VerDate Sep 11 2014 21:05 Apr 03, 2025 Jkt 059200 PO 00000 Frm 00012 Fmt 6652 Sfmt 6201 E:\BILLS\H2475.IH H2475 ssavage on LAPJG3WLY3PROD with BILLS 13 •HR 2475 IH of the following methods is elected by the par-1 ticipant involved: 2 (i) Cash. 3 (ii) Electronic funds transfer. 4 (iii) Prepaid debit card. 5 (iv) Any other method offered by the 6 Secretary. 7 (D) D AY OF PAYMENT.—Each member of 8 the payment-receiving group may elect to re-9 ceive the monthly payment on the first or last 10 weekday of the month that is not a legal public 11 holiday. 12 (d) P RIVACYPROTECTIONS.— 13 (1) D ISCLOSURES PROHIBITED .—A person shall 14 not disclose any information related to the pilot pro-15 gram, except to the extent permitted by regulations 16 prescribed under paragraph (2). 17 (2) R EGULATIONS FOR SHARING INFORMA -18 TION.—The Secretary, in consultation with the 19 Council and External Partner, may prescribe regula-20 tions to provide for the sharing of information in the 21 database, without personal identifiers, with nonprofit 22 organizations and academic institutions for non-23 commercial research purposes. 24 VerDate Sep 11 2014 21:05 Apr 03, 2025 Jkt 059200 PO 00000 Frm 00013 Fmt 6652 Sfmt 6201 E:\BILLS\H2475.IH H2475 ssavage on LAPJG3WLY3PROD with BILLS 14 •HR 2475 IH (3) DESTRUCTION OF DATABASE .—The Sec-1 retary shall destroy the database within 30 days 2 after the Council terminates. 3 (4) V IOLATIONS.— 4 (A) Any person who, by virtue of an offi-5 cial position or affiliation with the Secretary, 6 the Council, or the External Partner— 7 (i) has possession of, or access to, any 8 record containing individually identifiable 9 information the disclosure of which is pro-10 hibited by or under this Act; and 11 (ii) knowingly discloses such a record 12 to any person or agency not entitled to re-13 ceive the record, 14 shall be guilty of a misdemeanor and fined not 15 more than $25,000. 16 (B) Any person who knowingly requests or 17 obtains any record related to the pilot program 18 from the Secretary, the Council, or the External 19 Partner under false pretenses shall be guilty of 20 a misdemeanor and fined not more than 21 $25,000. 22 (e) R ELATIONSHIP TO OTHERPROGRAMS, BENE-23 FITS, ANDLAWS.—Notwithstanding any other provision 24 of law: 25 VerDate Sep 11 2014 21:05 Apr 03, 2025 Jkt 059200 PO 00000 Frm 00014 Fmt 6652 Sfmt 6201 E:\BILLS\H2475.IH H2475 ssavage on LAPJG3WLY3PROD with BILLS 15 •HR 2475 IH (1) Participation in the pilot program, including 1 the receipt of program payments, may not be consid-2 ered for the purposes of determining— 3 (A) the eligibility of a participant for, or 4 the amount or timing of, any benefit or assist-5 ance under any Federal program or under any 6 State or local program financed, in whole or in 7 part, with Federal funds; or 8 (B) whether a participant is a public 9 charge under section 212(a)(4) of the Immigra-10 tion and Nationality Act (8 U.S.C. 1182(a)(4)) 11 or section 237(a)(5) of such Act (8 U.S.C. 12 1227(a)(5)). 13 (2) For purposes of the Internal Revenue Code 14 of 1986, gross income shall not include any program 15 payment to a participant. 16 (3) Section 401 of the Personal Responsibility 17 and Work Opportunity Reconciliation Act of 1996 (8 18 U.S.C. 1611) shall not apply to this Act. 19 SEC. 5. STUDY. 20 (a) I NGENERAL.—The Secretary shall conduct, in 21 coordination with the External Partner selected pursuant 22 to this section, a study on the effects of the pilot program. 23 (b) O BJECTIVES.—The primary objectives of the 24 study shall be— 25 VerDate Sep 11 2014 21:05 Apr 03, 2025 Jkt 059200 PO 00000 Frm 00015 Fmt 6652 Sfmt 6201 E:\BILLS\H2475.IH H2475 ssavage on LAPJG3WLY3PROD with BILLS 16 •HR 2475 IH (1) to analyze the effect of the program pay-1 ments on— 2 (A) the housing outcomes of the pilot pro-3 gram participants; 4 (B) the microeconomic outcomes of the 5 participants; 6 (C) the physical and mental health and 7 well-being of the participants; and 8 (D) the social cost attributable to income 9 volatility and homelessness, including through 10 public expenditures for government-provided 11 services in health, education, employment, and 12 childcare; and 13 (2) to evaluate the feasibility of— 14 (A) expanding the pilot program to include 15 more participants in the payment-receiving 16 group; and 17 (B) using direct cash transfers to reduce 18 homelessness in the United States. 19 (c) S ELECTION OF THEEXTERNALPARTNER.— 20 (1) I N GENERAL.—Within 270 days after the 21 date of enactment of this Act, and before complying 22 with section 4(b)(2), the Secretary shall choose an 23 organization with demonstrated experience and ex-24 pertise in mixed-methods experimental design and 25 VerDate Sep 11 2014 21:05 Apr 03, 2025 Jkt 059200 PO 00000 Frm 00016 Fmt 6652 Sfmt 6201 E:\BILLS\H2475.IH H2475 ssavage on LAPJG3WLY3PROD with BILLS 17 •HR 2475 IH the implementation of cash-transfer programs and 1 randomized controlled trials to be the External Part-2 ner. 3 (2) C ONDITIONS ON SELECTION .—The Sec-4 retary may require the External Partner to employ 5 the services of certain qualified individuals in car-6 rying out the responsibilities of the External Partner 7 under this Act. 8 (3) C OMPENSATION FOR SERVICES REN -9 DERED.—The Secretary may pay not more than the 10 hourly equivalent of the annual rate of basic pay for 11 grade GS–12, step 5, of the General Schedule for 12 each hour (including travel time) during which a 13 person affiliated with the External Partner is en-14 gaged in the performance of duties of the External 15 Partner under this section. 16 (d) D UTIES OF THEEXTERNALPARTNER.— 17 (1) S ELECTION OF STUDY CRITERIA .—The Ex-18 ternal Partner shall make recommendations to the 19 Secretary on— 20 (A) how to accomplish the primary objec-21 tives described in subsection (b); and 22 (B) additional objectives for the study. 23 (2) D ATA COLLECTION.—Under the oversight 24 of the Secretary, the External Partner shall collect 25 VerDate Sep 11 2014 21:05 Apr 03, 2025 Jkt 059200 PO 00000 Frm 00017 Fmt 6652 Sfmt 6201 E:\BILLS\H2475.IH H2475 ssavage on LAPJG3WLY3PROD with BILLS 18 •HR 2475 IH the data required for the study and may use any in-1 formation about a pilot program participant given by 2 the Secretary to the External Partner for the study. 3 (e) R EPORTS TOCONGRESS.—The Secretary, in con-4 sultation with the External Partner, shall submit to the 5 appropriate congressional committees— 6 (1) an interim report, within 24 months after 7 the commencement of pilot program services; and 8 (2) a final report, within 12 months after the 9 conclusion of the pilot program services. 10 SEC. 6. NATIONAL YOUTH ECONOMIC ADVISORY COUNCIL. 11 (a) E STABLISHMENT.—The Secretary shall establish 12 the National Youth Economic Advisory Council. 13 (b) D UTIES.— 14 (1) R ECOMMENDATIONS FOR THE DATABASE 15 AND THE SELECTION OF THE EXTERNAL PART -16 NER.—The Council shall issue recommendations to 17 the Secretary with respect to— 18 (A) the identification and utilization of re-19 liable sources of information for identifying 20 homeless individuals and listing the individuals 21 in the database with sufficient information for 22 the Secretary to select any individual listed in 23 the BILLS 19 •HR 2475 IH (B) any regulation that may be prescribed 1 by the Secretary of Education, the Secretary of 2 Agriculture, or the Secretary of Housing and 3 Urban Development with respect to the McKin-4 ney-Vento Homeless Assistance Act (42 U.S.C. 5 11301–11435) to facilitate the identification of 6 homeless individuals for inclusion in the data-7 base; and 8 (C) the selection of the External Partner. 9 (2) R ECOMMENDATIONS FOR THE SELECTION 10 CRITERIA.—The Council shall issue recommenda-11 tions to the Secretary with respect to the selection 12 criteria for pilot program participants that are con-13 sistent with the objectives of the study and with the 14 demographics of the homeless population in the 15 United States. 16 (3) R ECOMMENDATIONS FOR FORMS OF ASSIST -17 ANCE.—The Council shall issue recommendations to 18 the Secretary on the forms of assistance to be pro-19 vided to a pilot program participant pursuant to sec-20 tion 4(c)(2). 21 (4) R ECOMMENDATIONS FOR THE R EGULAR MEMBERS .—The Secretary 14 shall appoint the following regular members of 15 the Council: 16 (i) A member representing the Sec-17 retary, who shall chair the Council. 18 (ii) A representative from a national 19 nonprofit homeless youth organization. 20 (iii) A representative from a national 21 nonprofit civil rights organization rep-22 resenting historically marginalized commu-23 nities or ONTINUATION OF MEMBERSHIP .—If an in-3 cumbent member is appointed to the Council as a 4 representative of an organization and the incumbent 5 member ceases to be affiliated with the organization, 6 the incumbent member may continue as a member 7 until the Secretary appoints a new member in the 8 stead of the incumbent member. 9 (3) R EMOVAL.—The Secretary may remove a 10 member for inefficiency, neglect of duty, or malfea-11 sance in office. 12 (d) P AY.— 13 (1) R ATES OF PAY.—Members of the Council 14 shall each be entitled to receive the daily equivalent 15 of the annual rate of basic pay for grade GS–14, 16 step 10, of the General Schedule for each day (in-17 cluding travel time) during which such members are 18 engaged in the performance of duties of the Council. 19 (2) P ROHIBITION OF COMPENSATION OF FED -20 ERAL EMPLOYEES.—Notwithstanding paragraph (1), 21 the members of the Council who are full-time offi-22 cers or employees of the United States or Members 23 of Congress for IH Code, may not receive additional pay, allowances, or 1 benefits by reason of service on the Council. 2 (3) T RAVEL EXPENSES .—Each member shall 3 receive travel expenses, including per diem in lieu of 4 subsistence, in accordance with applicable provisions 5 of subchapter I of chapter 57 of title 5, United 6 States Code. 7 (e) S TAFF.—On request of the Council and on a re-8 imbursable basis, for the purpose of assisting the Council 9 in carrying out the duties of the Council, the Secretary, 10 the Secretary of Education, and the Secretary of Health 11 and Human Services may each detail to the Council any 12 personnel of their respective departments. 13 (f) F REQUENCY OFMEETINGS.— 14 (1) I N GENERAL.—The Council shall meet at 15 least every 3 months. 16 (2) D ISCRETION OF THE SECRETARY .—The 17 Secretary may require the Council to sit for addi-18 tional meetings at the discretion of the Secretary. 19 (3) D ISCRETION OF THE CHAIR .—The Chair 20 may require the Council to sit for the meeting. 3 (g) C HARTER; QUORUM.— 4 (1) C OUNCIL CHARTER .—The Council shall 5 comply with section 1008(c) of title 5, United States 6 Code, as if— 7 (A) the Council were an advisory com-8 mittee but not a Presidential advisory com-9 mittee; 10 (B) the Secretary were the head of the 11 agency to whom the advisory committee reports; 12 and 13 (C) the appropriate congressional commit-14 tees were the standing committees of the Sen-15 ate and House of Representatives having legis-16 lative jurisdiction over the agency to which the 17 advisory committee reports. 18 (2) A DDITIONAL CONTENTS IN COUNCIL CHAR -19 TER.—The charter filed pursuant to paragraph (1) 20 shall contain provisions to determine— 21 (A) quorum; 22 (B) the information required to be dis-23 closed, in any notice of a interest in a matter may or shall dis-7 qualify a member from participating in consid-8 ering, or voting on, the matter. 9 (3) Q UORUM.—Until the filing of the charter, a 10 majority of the members of the Council appointed 11 shall constitute a quorum, but a lesser number may 12 hold hearings. 13 (h) P OWERS.— 14 (1) H EARINGS AND SESSIONS .—The Council 15 may, for the purpose of carrying out this section, 16 hold hearings, sit and act at times and places, take 17 testimony, administer oaths or affirmations to wit-18 nesses appearing before the Council, and receive evi-19 dence as the Council considers appropriate. 20 (2) O BTAINING OFFICIAL DATA .—The Council 21 may secure directly from any department or agency 22 of the United States information necessary to enable 23 the Council to administrative support services nec-4 essary for the Commission to carry out the duties of 5 the Council under this section. 6 (i) R EPORTS.— 7 (1) I NTERIM REPORTS.—The Council may sub-8 mit to the Secretary such interim reports as the 9 Council considers appropriate. 10 (2) F INAL REPORT.—The Council shall submit 11 a final report to the Secretary containing an assess-12 ment of the Council with respect to— 13 (A) the pilot program; and 14 (B) the report submitted by the Secretary 15 pursuant to section 5(e)(2). 16 (j) T ERMINATION.—The Council shall terminate 17 within 30 days after the Secretary submits the report pur-18 suant to section 5(e)(2). 19 (k) E XEMPTIONFROMFEDERALADVISORYCOM-20 MITTEEACT.—Except as provided in subsection (g)(1) of 21 this section, chapter 10 of title 5, United States Code, 22 shall not apply to the Council, but the Secretary may pre-23 scribe regulations directing the Council to comply with 24 sections 1009 through 1111 of such title if the Secretary
