228228 ‘‘(D) providing training with respect to 8
229229 FASD for professionals across relevant sectors; 9
230230 and 10
231231 ‘‘(E) disseminating information about 11
232232 FASD and support services to affected individ-12
233233 uals and their families; and 13
234234 ‘‘(4) an applied research program concerning 14
235235 intervention and prevention to support and conduct 15

249249 ‘‘(1) IN GENERAL.—The Secretary may award 1
250250 grants, cooperative agreements and contracts and 2
251251 provide technical assistance to eligible entities to 3
252252 carry out subsection (a). 4
253253 ‘‘(2) E
254254 LIGIBLE ENTITIES.—To be eligible to re-5
255255 ceive a grant, or enter into a cooperative agreement 6
256256 or contract, under this section, an entity shall— 7
257257 ‘‘(A) be a State, Indian Tribe or Tribal or-8
258258 ganization, local government, scientific or aca-9
259259 demic institution, or nonprofit organization; 10
260260 and 11
261261 ‘‘(B) prepare and submit to the Secretary 12
262262 an application at such time, in such manner, 13
263263 and containing such information as the Sec-14
264264 retary may require, including a description of 15
265265 the activities that the entity intends to carry 16
266266 out using amounts received under this section. 17
267267 ‘‘(3) A
268268 DDITIONAL APPLICATION CONTENTS .— 18
269269 The Secretary may require that an eligible entity in-19
270270 clude in the application submitted under paragraph 20
271271 (2)(B)— 21
272272 ‘‘(A) a designation of an individual to 22
273273 serve as a FASD State or Tribal coordinator of 23
274274 activities such eligible entity proposes to carry 24

282282 ance for the entity on developing and imple-5
283283 menting a statewide or Tribal strategic plan to 6
284284 prevent FASD and provide for the identifica-7
285285 tion, treatment, and support of individuals with 8
286286 FASD and their families. 9
287287 ‘‘(c) D
288288 EFINITION OFFASD-INFORMED.—For pur-10
289289 poses of this section, the term ‘FASD-informed’, with re-11
290290 spect to support or an intervention program, means that 12
291291 such support or intervention program uses culturally and 13
292292 linguistically informed evidence-based or practice-based 14
293293 interventions and appropriate resources to support an im-15
294294 proved quality of life for an individual with FASD and 16
295295 the family of such individual. 17
296296 ‘‘SEC. 399I. STRENGTHENING CAPACITY AND EDUCATION 18
297297 FOR FETAL ALCOHOL SPECTRUM DIS-19
298298 ORDERS. 20
299299 ‘‘(a) I
300300 NGENERAL.—The Secretary shall award 21
301301 grants, contracts, or cooperative agreements, as the Sec-22
302302 retary determines appropriate, to public or nonprofit pri-23
303303 vate entities with demonstrated expertise in the field of 24
304304 fetal alcohol spectrum disorders (referred to in this section 25

309309 building local, Tribal, State, and nationwide capacities to 2
310310 prevent the occurrence of FASD by carrying out the pro-3
311311 grams described in subsection (b). 4
312312 ‘‘(b) P
313313 ROGRAMS.—An entity receiving an award 5
314314 under subsection (a) may use such award for the following 6
315315 purposes: 7
316316 ‘‘(1) Developing and supporting public edu-8
317317 cation and outreach activities to raise public aware-9
318318 ness of the risks associated with alcohol consumption 10
319319 during pregnancy. 11
320320 ‘‘(2) Acting as a clearinghouse for evidence- 12
321321 based resources on FASD prevention, identification, 13
322322 and culturally and linguistically appropriate best 14
323323 practices to help inform systems of care for individ-15
324324 uals with FASD across their lifespan. 16
325325 ‘‘(3) Increasing awareness and understanding 17
326326 of efficacious, evidence-based screening tools and 18
327327 culturally and linguistically appropriate evidence- 19
328328 based intervention services and best practices, which 20
329329 may include improving the capacity for State, Trib-21
330330 al, and local affiliates. 22
331331 ‘‘(4) Providing technical assistance to recipients 23
332332 of grants, cooperative agreements, or contracts 24
333333 under section 399H, as appropriate. 25

337337 ‘‘(c) APPLICATION.—To be eligible for a grant, con-1
338338 tract, or cooperative agreement under this section, an enti-2
339339 ty shall submit to the Secretary an application at such 3
340340 time, in such manner, and containing such information as 4
341341 the Secretary may require. 5
342342 ‘‘(d) S
343343 UBCONTRACTING.—A public or private non-6
344344 profit entity may carry out the following activities required 7
345345 under this section through contracts or cooperative agree-8
346346 ments with other public and private nonprofit entities with 9
347347 demonstrated expertise in FASD: 10
348348 ‘‘(1) Resource development and dissemination. 11
349349 ‘‘(2) Intervention services. 12
350350 ‘‘(3) Training and technical assistance. 13
351351 ‘‘SEC. 399J. AUTHORIZATION OF APPROPRIATIONS. 14
352352 ‘‘There are authorized to be appropriated to carry out 15
353353 this part $12,500,000 for each of fiscal years 2026 16
354354 through 2030.’’. 17

356356 EPORT.—Not later than 4 years after the date 18
357357 of enactment of this Act, and every year thereafter, the 19
358358 Secretary of Health and Human Services shall prepare 20
359359 and submit to the Committee on Health, Education, 21
360360 Labor, and Pensions of the Senate and the Committee on 22
361361 Energy and Commerce of the House of Representatives 23
362362 a report containing— 24

369369 cation and awareness of fetal alcohol spectrum dis-4
370370 orders (referred to in this section as ‘‘FASD’’); 5
371371 (2) a description of— 6
372372 (A) the activities carried out pursuant to 7
373373 such sections 399H and 399I to identify, pre-8
374374 vent, and treat FASD; and 9
375375 (B) methods used to evaluate the outcomes 10
376376 of such activities; and 11
377377 (3) an assessment of activities carried out pur-12
378378 suant to such sections 399H and 399I to support in-13
379379 dividuals with FASD. 14
380380 SEC. 105. PROMOTING STATE CHOICE IN PDMP SYSTEMS. 15
381381 Section 399O(h) of the Public Health Service Act (42 16
382382 U.S.C. 280g–3(h)) is amended by adding at the end the 17
383383 following: 18
384384 ‘‘(5) P
385385 ROMOTING STATE CHOICE .—Nothing in 19
386386 this section shall be construed to authorize the Sec-20
387387 retary to require States to use a specific vendor or 21
388388 a specific interoperability connection other than to 22
389389 align with nationally recognized, consensus-based 23
390390 open standards, such as in accordance with sections 24
391391 3001 and 3004.’’. 25

795795 ‘‘FDA’’) a report that outlines a plan for assessing opioid 9
796796 analgesic drugs that are approved under section 505 of 10
797797 the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 11
798798 355) that addresses the public health effects of such opioid 12
799799 analgesic drugs as part of the benefit-risk assessment and 13
800800 the activities of the FDA that relate to facilitating the de-14
801801 velopment of nonaddictive medical products intended to 15
802802 treat pain or addiction. Such report shall include— 16
803803 (1) an update on the actions taken by the FDA 17
804804 to consider the effectiveness, safety, benefit-risk pro-18
805805 file, and use of approved opioid analgesic drugs; 19
806806 (2) a timeline for an assessment of the potential 20
807807 need, as appropriate, for labeling changes, revised or 21
808808 additional postmarketing requirements, enforcement 22
809809 actions, or withdrawals for opioid analgesic drugs; 23
810810 (3) an overview of the steps that the FDA has 24
811811 taken to support the development and approval of 25

828828 concerning the regulation by the FDA of opioid analgesic 13
829829 drugs, including scientific evidence that relates to condi-14
830830 tions of use, safety, or benefit-risk assessment (including 15
831831 consideration of the public health effects) of such opioid 16
832832 analgesic drugs. 17
