15	15	restroom access for certain drivers, and for other purposes.
16	16	Be it enacted by the Senate and House of Representa-1
17	17	tives of the United States of America in Congress assembled, 2
18	18	SECTION 1. SHORT TITLE. 3
19	19	This Act may be cited as the ‘‘Trucker Bathroom Ac-4
20	20	cess Act’’. 5
21	21	SEC. 2. RESTROOM ACCESS FOR DRIVERS. 6
22	22	(a) I
23	23	NGENERAL.—Subchapter I of chapter 141 of 7
24	24	title 49, United States Code, is amended by adding at the 8
25	25	end the following: 9

29	29	‘‘§ 14105. Restroom access for drivers 1
30	30	‘‘(a) I
31	31	NGENERAL.—A covered driver shall be granted 2
32	32	access to any covered restroom facility at any covered es-3
33	33	tablishment to which such employee delivers any goods or 4
34	34	cargo or is waiting to be loaded to transport goods or 5
35	35	cargo. 6
36	36	‘‘(b) R
37	37	ULE OFCONSTRUCTION.—Nothing in this sec-7
38	38	tion shall be construed to require a covered establishment 8
39	39	to make any physical changes to a restroom to be in com-9
40	40	pliance with this section. 10
41	41	‘‘(c) D
42	42	EFINITIONS.—In this section: 11
43	43	‘‘(1) C
44	44	OVERED DRIVER.—The term ‘covered 12
45	45	driver’ means any commercial motor vehicle operator 13
46	46	with respect to whom the Secretary of Transpor-14
47	47	tation has power to establish qualifications and max-15
48	48	imum hours of service pursuant to the provisions of 16
49	49	section 31502. 17
50	50	‘‘(2) C
51	51	OVERED RESTROOM FACILITY .—The 18
52	52	term ‘covered restroom facility’ means a restroom lo-19
53	53	cated on the premises of a covered establishment 20
54	54	that is intended for use by customers or employees 21
55	55	of the establishment and that is— 22
56	56	‘‘(A) located in an area where providing 23
57	57	access would not create an obvious health or 24
58	58	safety risk to a covered driver; and 25

62	62	‘‘(B) located in an area where providing 1
63	63	access would not pose an obvious security risk 2
64	64	to the covered establishment. 3

66	66	OVERED ESTABLISHMENT .—The term 4
67	67	‘covered establishment’— 5
68	68	‘‘(A) means a place of business open to the 6
69	69	general public for the sale of goods or services; 7
70	70	‘‘(B) a shipper, receiver, manufacturer, 8
71	71	warehouse, distribution center, or any other 9
72	72	business entity that is receiving or sending 10
73	73	goods by commercial motor vehicle; and 11
74	74	‘‘(C) does not include any structure such 12
75	75	as a filling station, service station, or res-13
76	76	taurant of 800 square feet or less that has a 14
77	77	restroom located within such structure that is 15
78	78	only intended for use by employees.’’. 16

80	80	LERICALAMENDMENT.—The analysis for chap-17
81	81	ter 141 of title 49, United States Code, is amended by 18
82	82	inserting after the item relating to section 14104 the fol-19
83	83	lowing new item: 20
84	84	‘‘14105. Restroom access for drivers.’’.
85	85	SEC. 3. RESTROOM ACCESS FOR DRAYAGE TRUCK OPERA-

89	89	NGENERAL.—A terminal operator shall provide 23
90	90	a sufficient number of covered restrooms for use by cov-24

95	95	such operators typically have access to. 2
96	96	(b) R
97	97	EQUIREMENTS.—To be in compliance with sub-3
98	98	section (a), a terminal operator shall provide— 4
99	99	(1) access to existing restrooms while covered 5
100	100	drayage truck operators are on port property and 6
101	101	when such access does not pose an obvious safety 7
102	102	risk to such truck operators and other employees of 8
103	103	the terminal operator in the area; 9
104	104	(2) additional restrooms, if necessary, at loca-10
105	105	tions where there is the most need; and 11
106	106	(3) a place for covered drayage truck operators 12
107	107	to park vehicles while accessing such restrooms. 13

109	109	EFINITIONS.—In this section: 14
110	110	(1) C
111	111	OVERED DRAYAGE TRUCK OPERATOR .— 15
112	112	The term ‘‘covered drayage truck operator’’ means 16
113	113	the driver of any in-use on-road vehicle with a gross 17
114	114	vehicle weight rating of greater than 33,000 pounds 18
115	115	operating on or transgressing through port or inter-19
116	116	modal rail yard property for the purpose of loading, 20
117	117	unloading, or transporting cargo, including contain-21
118	118	erized, bulk, or break-bulk goods. 22

120	120	ERMINAL OPERATOR .—The term ‘‘ter-23
121	121	minal operator’’— 24
