14	14	To amend title 23, United States Code, to clarify provisions
15	15	relating to equal access for over-the-road buses, and for
16	16	other purposes.
17	17	Be it enacted by the Senate and House of Representa-1
18	18	tives of the United States of America in Congress assembled, 2
19	19	SECTION 1. SHORT TITLE. 3
20	20	This Act may be cited as the ‘‘Bus Parity and Clarity 4
21	21	Act’’. 5
22	22	SEC. 2. CLARIFICATION OF EQUAL ACCESS FOR OVER-THE- 6
23	23	ROAD BUSES. 7
24	24	(a) I
25	25	NGENERAL.— 8

29	29	(1) TOLL ROADS, BRIDGES, TUNNELS, AND 1
30	30	FERRIES.—Section 129(a) of title 23, United States 2
31	31	Code, is amended— 3
32	32	(A) in paragraph (9)(A) by striking ‘‘that 4
33	33	serves the public’’ and inserting ‘‘in scheduled 5
34	34	or charter service’’; and 6
35	35	(B) in paragraph (11) by adding at the 7
36	36	end the following: 8
37	37	‘‘(F) C
38	38	HARTER SERVICE.—The term ‘char-9
39	39	ter service’ has the meaning given the term in 10
40	40	part 604 of title 49, Code of Federal Regula-11
41	41	tions.’’. 12

43	43	FACILITIES.—Section 166 of title 23, 13
44	44	United States Code, is amended— 14
45	45	(A) in subsection (b)(3)(C) by striking 15
46	46	‘‘serving the public’’ and inserting ‘‘in sched-16
47	47	uled or charter service’’; and 17
48	48	(B) in subsection (f) by adding at the end 18
49	49	the following: 19
50	50	‘‘(7) C
51	51	HARTER SERVICE.—The term ‘charter 20
52	52	service’ has the meaning given the term in part 604 21
53	53	of title 49, Code of Federal Regulations.’’. 22

55	55	ALUEPRICINGPILOTPROGRAM.—In carrying 23
56	56	out a value pricing pilot program under section 1012(b) 24
57	57	of the Intermodal Surface Transportation Efficiency Act 25

61	61	of 1991 (23 U.S.C. 149 note), a public authority with ju-1
62	62	risdiction over a toll facility shall provide to an over-the- 2
63	63	road bus in scheduled or charter service access to a toll 3
64	64	facility under the same rates, terms, and conditions as a 4
65	65	public transportation vehicle, consistent with section 5
66	66	129(a)(9) of title 23, United States Code. 6

68	68	UBLICATION.—Not later than 180 days after the 7
69	69	date of enactment of this Act, and annually thereafter, 8
70	70	the Administrator of the Federal Highway Administration 9
71	71	shall publish on a publicly available website a unified data-10
72	72	base containing information with respect to the rates, 11
73	73	terms, and conditions of each toll facility covered under 12
74	74	the equal access provisions described in sections 129(a)(9) 13
75	75	and 166(b)(3) of title 23, United States Code. 14

77	77	EFINITIONS.—In this Act: 15
78	78	(1) C
79	79	HARTER SERVICE.—The term ‘‘charter 16
80	80	service’’ has the meaning given the term in part 604 17
81	81	of title 49, Code of Federal Regulations. 18

83	83	VER-THE-ROAD BUS.—The term ‘‘over-the- 19
84	84	road bus’’ has the meaning given the term in section 20
85	85	301 of the Americans with Disabilities Act of 1990 21
86	86	(42 U.S.C. 12181). 22

88	88	UBLIC AUTHORITY; TOLL FACILITY.—The 23
89	89	terms ‘‘public authority’’ and ‘‘toll facility’’ have the 24
