110110 section, provide notice in the Federal Register of the 16
111111 interim final standard and a 30-day period for pub-17
112112 lic comment. 18

114114 FFECTIVE DATE OF INTERIM STAND -19
115115 ARD.—The interim final standard shall— 20
116116 (A) take effect on a date that is not later 21
117117 than 30 days after issuance, except that such 22
118118 interim final standard may include a reasonable 23
119119 phase-in period for the implementation of re-24

130130 (C) be in effect until the final standard de-8
131131 scribed in subsection (b) becomes effective and 9
132132 enforceable. 10

134134 AILURE TO PROMULGATE .—If an interim 11
135135 final standard described in paragraph (1) is not 12
136136 issued not later than 1 year of the date of enactment 13
137137 of this Act, the provisions of this title shall be in ef-14
138138 fect and enforced in the same manner and to the 15
139139 same extent as any standard promulgated under sec-16
140140 tion 6(b) of the Occupational Safety and Health Act 17
141141 (29 U.S.C. 655(b)) until such provisions are super-18
142142 seded in whole by an interim final standard issued 19
143143 by the Secretary that meets the requirements of 20
144144 paragraph (1). 21

163163 INAL STANDARD.—Not later than 42 9
164164 months after the date of enactment of this Act, the 10
165165 Secretary shall issue a final standard on such pro-11
166166 posed standard that shall— 12
167167 (A) provide no less protection than any 13
168168 workplace violence standard adopted by a State 14
169169 plan that has been approved by the Secretary 15
170170 under section 18 of the Occupational Safety 16
171171 and Health Act of 1970 (29 U.S.C. 667), pro-17
172172 vided the Secretary finds that the final stand-18
173173 ard is feasible on the basis of the best available 19
174174 evidence; and 20
175175 (B) be effective and enforceable in the 21
176176 same manner and to the same extent as any 22
177177 standard promulgated under section 6(b) of the 23
178178 Occupational Safety and Health Act of 1970 24
179179 (29 U.S.C. 655(b)). 25

226226 determines should be covered under the 14
227227 standards promulgated under section 101. 15

229229 XCLUSION.—The term ‘‘covered facil-16
230230 ity’’ does not include an office of a physician, 17
231231 dentist, podiatrist, or any other health practi-18
232232 tioner that is not physically located within a 19
233233 covered facility described in clauses (i) through 20
234234 (x) of subparagraph (A). 21

239239 service’’ includes the following services and op-24

251251 (iii) Any services described in clauses 8
252252 (i) and (ii) performed by a Federal Gov-9
253253 ernment agency and required to comply 10
254254 with occupational safety and health stand-11
255255 ards pursuant to section 1960 of title 29, 12
256256 Code of Federal Regulations (as such sec-13
257257 tion is in effect on the date of enactment 14
258258 of this Act). 15
259259 (iv) Any other services and operations 16
260260 the Secretary determines should be covered 17
261261 under the standards promulgated under 18
262262 section 101. 19

271271 tractor, subcontractor, a temporary service 25

279279 XCLUSION.—The term ‘‘covered em-4
280280 ployer’’ does not include an individual who pri-5
281281 vately employs, in the individual’s residence, a 6
282282 person to perform covered services for the indi-7
283283 vidual or a family member of the individual. 8

285285 OVERED EMPLOYEE .—The term ‘‘covered 9
286286 employee’’ includes an individual employed by a cov-10
287287 ered employer to work at a covered facility or to per-11
288288 form covered services. 12
289289 SEC. 103. REQUIREMENTS FOR WORKPLACE VIOLENCE 13
290290 PREVENTION STANDARD. 14
291291 Each standard described in section 101 shall include, 15
292292 at a minimum, the following requirements: 16
293293 (1) W
294294 ORKPLACE VIOLENCE PREVENTION 17
295295 PLAN.—Not later than 6 months after the date of 18
296296 promulgation of the interim final standard under 19
297297 section 101(a), a covered employer shall develop, im-20
298298 plement, and maintain an effective written workplace 21
299299 violence prevention plan (in this section referred to 22
300300 as the ‘‘Plan’’) for covered employees at each cov-23
301301 ered facility and for covered employees performing a 24

306306 meets the following: 2

308308 LAN DEVELOPMENT .—Each Plan— 3
309309 (i) shall be developed and imple-4
310310 mented with the meaningful participation 5
311311 of direct care employees, other employees, 6
312312 and employee representatives, for all as-7
313313 pects of the Plan; 8
314314 (ii) shall be tailored and specific to 9
315315 conditions and hazards for the covered fa-10
316316 cility or the covered service, including pa-11
317317 tient-specific risk factors and risk factors 12
318318 specific to each work area or unit; 13
319319 (iii) shall be suitable for the size, com-14
320320 plexity, and type of operations at the cov-15
321321 ered facility or for the covered service, and 16
322322 remain in effect at all times; and 17
323323 (iv) may be in consultation with stake-18
324324 holders or experts who specialize in work-19
325325 place violence prevention, emergency re-20
326326 sponse, or other related areas of expertise 21
327327 for all relevant aspects of the Plan. 22

329329 LAN CONTENT.—Each Plan shall in-23
330330 clude procedures and methods for the following: 24

336336 plementation of the Plan. 3
337337 (ii) With respect to each work area 4
338338 and unit at the covered facility or while 5
339339 covered employees are performing the cov-6
340340 ered service, risk assessment and identi-7
341341 fication of workplace violence risks and 8
342342 hazards to employees exposed to such risks 9
343343 and hazards (including environmental risk 10
344344 factors and patient-specific risk factors), 11
345345 which shall be— 12
346346 (I) informed by past violent inci-13
347347 dents specific to such covered facility 14
348348 or such covered service; and 15
349349 (II) conducted with, at a min-16
350350 imum— 17
351351 (aa) direct care employees; 18
352352 (bb) where applicable, the 19
353353 representatives of such employ-20
354354 ees; and 21
355355 (cc) the employer. 22
356356 (iii) Hazard prevention, engineering 23
357357 controls, or work practice controls to cor-24
358358 rect hazards, in a timely manner, applying 25

365365 alarm systems, adequate exit routes, 4
366366 monitoring systems, barrier protec-5
367367 tion, established areas for patients 6
368368 and clients, lighting, entry procedures, 7
369369 staffing and working in teams, and 8
370370 systems to identify and flag clients 9
371371 with a history of violence; and 10
372372 (II) shall ensure that employers 11
373373 correct, in a timely manner, hazards 12
374374 identified in any violent incident in-13
375375 vestigation described in paragraph (2) 14
376376 and any annual report described in 15
377377 paragraph (5). 16
378378 (iv) Reporting, incident response, and 17
379379 post-incident investigation procedures, in-18
380380 cluding procedures— 19
381381 (I) for employees to report work-20
382382 place violence risks, hazards, and inci-21
383383 dents; 22
384384 (II) for employers to respond to 23
385385 reports of workplace violence; 24

391391 briefing of all reports of workplace vi-3
392392 olence with the participation of em-4
393393 ployees and their representatives; 5
394394 (IV) to provide medical care or 6
395395 first aid to affected employees; and 7
396396 (V) to provide employees with in-8
397397 formation about available trauma and 9
398398 related counseling. 10
399399 (v) Procedures for emergency re-11
400400 sponse, including procedures for threats of 12
401401 mass casualties and procedures for inci-13
402402 dents involving a firearm or a dangerous 14
403403 weapon. 15
404404 (vi) Procedures for communicating 16
405405 with and training the covered employees on 17
406406 workplace violence hazards, threats, and 18
407407 work practice controls, the employer’s plan, 19
408408 and procedures for confronting, responding 20
409409 to, and reporting workplace violence 21
410410 threats, incidents, and concerns, and em-22
411411 ployee rights. 23
412412 (vii) Procedures for— 24

418418 ment, and implementation of the Plan 3
419419 with other employers who have em-4
420420 ployees who work at the covered facil-5
421421 ity or who are performing the covered 6
422422 service; and 7
423423 (II) determining which covered 8
424424 employer or covered employers shall 9
425425 be responsible for implementing and 10
426426 complying with the provisions of the 11
427427 standard applicable to the working 12
428428 conditions over which such employers 13
429429 have control. 14
430430 (viii) Procedures for conducting the 15
431431 annual evaluation under paragraph (6). 16

433433 VAILABILITY OF PLAN.—Each Plan 17
434434 shall be made available at all times to the cov-18
435435 ered employees who are covered under such 19
436436 Plan. 20
437437 (2) V
438438 IOLENT INCIDENT INVESTIGATION .— 21
439439 (A) I
440440 N GENERAL.—As soon as practicable 22
441441 after a workplace violence incident, risk, or haz-23
442442 ard of which a covered employer has knowledge, 24
443443 the employer shall conduct an investigation of 25

448448 employer shall— 2
449449 (i) review the circumstances of the in-3
450450 cident, risk, or hazard, and whether any 4
451451 controls or measures implemented pursu-5
452452 ant to the Plan of the employer were effec-6
453453 tive; and 7
454454 (ii) solicit input from involved employ-8
455455 ees, their representatives, and supervisors 9
456456 about the cause of the incident, risk, or 10
457457 hazard, and whether further corrective 11
458458 measures (including system-level factors) 12
459459 could have prevented the incident, risk, or 13
460460 hazard. 14
461461 (B) D
462462 OCUMENTATION.—A covered em-15
463463 ployer shall document the findings, rec-16
464464 ommendations, and corrective measures taken 17
465465 for each investigation conducted under this 18
466466 paragraph. 19
467467 (3) T
468468 RAINING AND EDUCATION .—With respect 20
469469 to the covered employees covered under a Plan of a 21
470470 covered employer, the employer shall provide train-22
471471 ing and education to such employees who may be ex-23
472472 posed to workplace violence hazards and risks, which 24
473473 meet the following requirements: 25

478478 include information on the Plan, including iden-2
479479 tified workplace violence hazards, work practice 3
480480 control measures, reporting procedures, record 4
481481 keeping requirements, response procedures, 5
482482 anti-retaliation policies, and employee rights. 6
483483 (B) Additional hazard recognition training 7
484484 shall be provided for supervisors and managers 8
485485 to ensure they— 9
486486 (i) can recognize high-risk situations; 10
487487 and 11
488488 (ii) do not assign employees to situa-12
489489 tions that predictably compromise the safe-13
490490 ty of such employees. 14
491491 (C) Additional training shall be provided 15
492492 for each such covered employee whose job cir-16
493493 cumstances have changed, within a reasonable 17
494494 timeframe after such change. 18
495495 (D) Additional training shall be provided 19
496496 for each such covered employee whose job cir-20
497497 cumstances require working with victims of tor-21
