for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Freedom in School 4
Cafeterias and Lunches Act’’ or the ‘‘FISCAL Act’’. 5

SEC. 2. TYPES OF MILK OFFERED UNDER THE SCHOOL 1
LUNCH PROGRAM. 2
(a) I
NGENERAL.—Section 9(a)(2) of the Richard B. 3
Russell National School Lunch Act (42 U.S.C. 4
1758(a)(2)) is amended— 5
(1) in the heading, by striking ‘‘F
LUID MILK’’ 6
and inserting ‘‘M
ILK’’; 7
(2) in subparagraph (A)— 8
(A) in clause (i)— 9
(i) by striking ‘‘fluid milk. Such milk’’ 10
and inserting ‘‘milk, including fluid milk 11
and plant-based milk, which’’; 12
(ii) by inserting ‘‘or, in the case of a 13
plant-based milk not included under those 14
guidelines, consistent with nutritional 15
standards established by the Secretary’’ 16
after ‘‘(7 U.S.C. 5341)’’; and 17
(iii) by inserting ‘‘and’’ after the semi-18
colon; 19
(B) in clause (ii), by striking ‘‘; and’’ and 20
inserting a period; and 21
(C) by striking clause (iii); 22
(3) by striking subparagraph (B); 23
(4) by redesignating subparagraph (C) as sub-24
paragraph (B); and 25

in the matter preceding clause (i), by inserting ‘‘or 2
plant-based milk’’ after ‘‘fluid milk’’. 3

ONFORMINGAMENDMENTS.— 4
(1) Section 14(f) of the Richard B. Russell Na-5
tional School Lunch Act (42 U.S.C. 1762a(f)) is 6
amended, in the third sentence, by inserting ‘‘or 7
plant-based’’ before ‘‘milk’’. 8
(2) Section 20(c) of the Richard B. Russell Na-9
tional School Lunch Act (42 U.S.C. 1769b(c)) is 10
amended by striking ‘‘fluid’’. 11
