2727 ERTILITYTREATMENT.—Chapter 55 of title 10, 4
2828 United States Code, is amended by inserting after section 5
2929 1074o the following new section: 6
3030 ‘‘§ 1074p. Fertility treatment for certain active duty 7
3131 members of the uniformed services and 8
3232 their dependents 9
3333 ‘‘(a) C
3434 OVERAGE.—The Secretary shall ensure that 10
3535 fertility-related care for a member of the uniformed serv-11
3636 ices on active duty (or a dependent of such a member) 12
3737 shall be covered under TRICARE Prime and TRICARE 13
3838 Select. 14
3939 ‘‘(b) I
4040 NVITROFERTILIZATION.—In the case of in 15
4141 vitro fertilization treatment furnished to an individual 16
4242 pursuant to subsection (a)— 17
4343 ‘‘(1) not more than three completed oocyte re-18
4444 trievals may be furnished; and 19
4545 ‘‘(2) unlimited embryo transfers may be pro-20
4646 vided in accordance with the guidelines of the Amer-21
4747 ican Society for Reproductive Medicine. 22
4848 ‘‘(c) D
4949 EFINITIONS.—In this section: 23
5050 ‘‘(1) The term ‘infertility’ means a disease, con-24
5151 dition, or status characterized by— 25

5555 ‘‘(A) the failure to establish a pregnancy 1
5656 or to carry a pregnancy to live birth after reg-2
5757 ular, unprotected sexual intercourse in accord-3
5858 ance with the guidelines of the American Soci-4
5959 ety for Reproductive Medicine; 5
6060 ‘‘(B) the inability of an individual to repro-6
6161 duce without medical intervention either as a 7
6262 single individual or with the partner of the indi-8
6363 vidual; or 9
6464 ‘‘(C) the findings of a licensed physician 10
6565 based on the medical, sexual, and reproductive 11
6666 history, age, physical findings, or diagnostic 12
6767 testing, of the individual. 13
6868 ‘‘(2) The term ‘fertility-related care’ means— 14
6969 ‘‘(A) the diagnosis of infertility; and 15
7070 ‘‘(B) fertility treatment. 16
7171 ‘‘(3) The term ‘fertility treatment’ includes the 17
7272 following: 18
7373 ‘‘(A) In vitro fertilization or other treat-19
7474 ments or procedures in which human oocytes, 20
7575 embryos, or sperm are handled when clinically 21
7676 appropriate. 22
7777 ‘‘(B) Sperm retrieval. 23
7878 ‘‘(C) Egg retrieval. 24

8282 ‘‘(D) Preservation of human oocytes, em-1
8383 bryos, or sperm. 2
8484 ‘‘(E) Artificial insemination, including 3
8585 intravaginal insemination, intracervical insemi-4
8686 nation, and intrauterine insemination. 5
8787 ‘‘(F) Transfer of reproductive genetic ma-6
8888 terial. 7
8989 ‘‘(G) Medications as prescribed or nec-8
9090 essary for fertility. 9
9191 ‘‘(H) Fertility treatment coordination. 10
9292 ‘‘(I) Such other information, referrals, 11
9393 treatments, procedures, testing, medications, 12
9494 laboratory services, technologies, and services 13
9595 facilitating reproduction as determined appro-14
9696 priate by the Secretary of Defense.’’. 15

9898 ROGRAM ONFERTILITYTREATMENTCOORDI-16
9999 NATION.—Chapter 55 of title 10, United States Code, is 17
100100 amended by adding at the end the following new section: 18
101101 ‘‘§ 1110c. Program on fertility-related care coordina-19
102102 tion 20
103103 ‘‘(a) I
104104 NGENERAL.—The Secretary of Defense shall 21
105105 establish a program on the coordination of fertility-related 22
106106 care by the Secretary for purposes of ensuring patients 23
107107 receive timely fertility-related care. 24

111111 ‘‘(b) TRAINING ANDSUPPORT.—In carrying out the 1
112112 program established under subsection (a), the Secretary 2
113113 shall provide to community health care providers training 3
114114 and support with respect to the unique needs of members 4
115115 of the uniformed services and the dependents of such 5
116116 members.’’. 6

118118 ONFORMINGAMENDMENT.—Section 1079(a) of 7
119119 title 10, United States Code, is amended by adding at the 8
120120 end the following new paragraph: 9
121121 ‘‘(21) Fertility related care shall be provided in 10
122122 accordance with section 1074p of this title.’’. 11
123123 (d) A
124124 PPLICATION.—The amendments made by this 12
125125 section shall apply with respect to services provided on or 13
126126 after October 1, 2027. 14
