36 | 36 | | plans will often purchase stop-loss insurance as a fi-7 |

37 | 37 | | nancial risk management tool to protect against ex-8 |

38 | 38 | | cess or unexpected catastrophic health plan claims 9 |

39 | 39 | | losses that arise above projected costs paid out of 10 |
---|

41 | 41 | | (3) Stop-loss coverage insures the employer 12 |

42 | 42 | | sponsoring the health benefit plan against unfore-13 |
---|
43 | 43 | | seen health plan claims, does not insure the em-14 |
---|
44 | 44 | | ployee health benefit plan itself, and does not pay 15 |
---|
45 | 45 | | health care providers for medical services provided to 16 |
---|
46 | 46 | | the employees. 17 |

47 | 47 | | (4) Employer-sponsored health benefit plans are 18 |

48 | 48 | | regulated under the Employee Retirement Income 19 |
---|
49 | 49 | | Security Act of 1974, however, States regulate the 20 |
---|
50 | 50 | | availability and the coverage terms of stop-loss in-21 |
---|
51 | 51 | | surance coverage that employers purchase to protect 22 |
---|
52 | 52 | | company assets and to protect a fund against excess 23 |
---|
53 | 53 | | or unexpected claims losses. 24 |
