1818 SECTION 1. SHORT TITLE. 3
1919 This Act may be cited as the ‘‘College Admissions Ac-4
2020 countability Act of 2025’’. 5
2121 SEC. 2. FINDINGS. 6
2222 Congress makes the following findings: 7
2323 (1) 21st century elite college admissions func-8
2424 tions as the Nation’s sorting machine for prestige 9

3030 (2) For decades United States colleges and uni-3
3131 versities adopted admissions policies and practices 4
3232 that rendered special preferences to applicants on 5
3333 the basis of race. 6
3434 (3) In Students for Fair Admissions, Inc. v. 7
3535 President and Fellows of Harvard College, 143 S. 8
3636 Ct. 2141 (2023), the Supreme Court of the United 9
3737 States found race-based admissions policies to be in 10
3838 violation of the Equal Protection Clause of the 14th 11
3939 Amendment to the Constitution of the United 12
4040 States. The Court further held that ‘‘universities 13
4141 may not simply establish through application essays 14
4242 or other means the regime we hold unlawful today’’. 15
4343 (4) Title VI of the Civil Rights Act of 1964 (42 16
4444 U.S.C. 2000d et seq.) prohibits entities that receive 17
4545 Federal funding from discriminating based on race. 18
4646 (5) Following the Court’s ruling, several United 19
4747 States colleges and universities issued statements or 20
4848 unveiled new policies at odds with its letter and spir-21
4949 it. 22
5050 (6) Institutions of higher education, including 23
5151 their offices of admission, must comply with the 24

9191 OVERED INSTITUTION .—The term ‘cov-7
9292 ered institution’ means an institution of higher edu-8
9393 cation that receives funds from Federal student as-9
9494 sistance or Federal institutional aid under the High-10
9595 er Education Act of 1965 (20 U.S.C. 1001 et seq.). 11

9797 FFICE OFINSPECTORGENERAL.—There is 12
9898 hereby established within the Department the Office of the 13
9999 Special Inspector General for Unlawful Discrimination in 14

103103 MOVAL; BASICPAY.— 17
104104 ‘‘(1) I
105105 N GENERAL.—The head of the Office of 18
106106 the Special Inspector General for Unlawful Discrimi-19
107107 nation in Higher Education shall be the Special In-20
108108 spector General for Unlawful Discrimination in 21
109109 Higher Education (referred to in this section as the 22
110110 ‘Special Inspector General’), who shall be appointed 23
111111 by the President, by and with the advice and consent 24
112112 of the Senate. 25

117117 Special Inspector General shall be made on the basis 2
118118 of integrity and demonstrated familiarity with higher 3
119119 education and admissions, in addition to expertise in 4
120120 auditing, civil rights, law, academic administration, 5
121121 education regulation, or investigations. 6

123123 EMOVAL.—The Special inspector General 7
124124 shall be removable from office in accordance with 8
125125 the provisions of section 403(b) of title 5, United 9
126126 States Code. 10

128128 ASIC PAY.—The annual rate of basic pay 11
129129 of the Special Inspector General shall be the annual 12
130130 rate of basic pay for an Inspector General under sec-13
131131 tion 403 of title 5, United States Code. 14

135135 N GENERAL.—It shall be the duty of the 16
136136 Special Inspector General to, in accordance with sec-17
137137 tion 404(b)(1) of title 5, United States Code— 18
138138 ‘‘(A) receive, review, and investigate allega-19
139139 tions from covered individuals or employees of 20
140140 covered institutions of admissions decisions, 21
141141 policies, or practices, or financial aid determina-22
142142 tions or academic programs, that are in viola-23
143143 tion of— 24

152152 lege, 143 S. Ct. 2141 (2023) (referred to 6
153153 in this subsection as the ‘Equal Protection 7
154154 Clause’); or 8
155155 ‘‘(ii) title VI of the Civil Rights Act of 9
156156 1964 (42 U.S.C. 2000d et seq.) (referred 10
157157 to in this subsection as ‘title VI’); 11
158158 ‘‘(B) review any Federal policies and pro-12
159159 grams that have the effect of incentivizing cov-13
160160 ered institutions to violate the Equal Protection 14
161161 Clause or title VI; and 15
162162 ‘‘(C) make recommendations to the appli-16
163163 cable covered institution, the Secretary, the At-17
164164 torney General of the United States, and the 18
165165 appropriate committees of Congress regard-19
166166 ing— 20
167167 ‘‘(i) measures that the covered institu-21
168168 tion should take to remedy any violation 22
169169 described in subparagraph (A) through re-23
170170 medial or corrective action; 24

175175 stitution that the Special Inspector Gen-2
176176 eral determines, after a review or inves-3
177177 tigation described in subparagraph (A), 4
178178 should face disciplinary action (including 5
179179 removal) as a result of a violation de-6
180180 scribed in such subparagraph; 7
181181 ‘‘(iii) eligibility of the covered institu-8
182182 tion to receive funds from Federal student 9
183183 assistance or Federal institutional aid; 10
184184 ‘‘(iv) further investigation into the 11
185185 covered institution’s compliance with the 12
186186 Constitution of the United States, title VI, 13
187187 and other laws of the United States; and 14
188188 ‘‘(v) reforms to any Federal policies 15
189189 and programs that have the effect of 16
190190 incentivizing covered institutions to violate 17
191191 the Equal Protection Clause or title VI. 18
192192 ‘‘(2) M
193193 AINTENANCE OF SYSTEMS .—The Special 19
194194 Inspector General shall establish, maintain, and 20
195195 oversee such systems, procedures, and controls as 21
196196 the Special Inspector General considers appropriate 22
197197 to discharge the duties of the Special inspector Gen-23
198198 eral under paragraph (1). 24

206206 spectors general under chapter 4 of title 5, United 5
207207 States Code. 6

209209 ONFIDENTIALITY OF INFORMATION .— 7
210210 The Special inspector General shall maintain the 8
211211 confidentiality of the identity of any person submit-9
212212 ting information to the Special Inspector General for 10
213213 the purposes of carrying out the duties of the Spe-11
214214 cial inspector General under this section, including 12
215215 in any report submitted under subsection (g). 13

217217 OWERS ANDAUTHORITIES.— 14

219219 N GENERAL.—In carrying out the duties 15
220220 of the Special Inspector General under subsection 16
221221 (d), the Special Inspector General shall have the au-17
222222 thorities provided in section 406 of title 5, United 18
223223 States Code. 19

225225 REATMENT OF OFFICE .—The Office of 20
226226 the Special Inspector General shall be considered to 21
227227 be an office described in section 406(f)(3) of title 5, 22
228228 United States Code. 23

251251 XPERTS AND CONSULTANTS .—The Spe-14
252252 cial Inspector General may obtain services as au-15
253253 thorized under section 3109 of title 5, United States 16
254254 Code, at daily rates not to exceed the equivalent rate 17
255255 prescribed for grade GS–15 of the General Schedule 18
256256 by section 5332 of that title. 19

258258 ONTRACTS.—The Special Inspector Gen-20
259259 eral may enter into contracts and other arrange-21
260260 ments for audits, studies, analyses, and other serv-22
261261 ices with public agencies and with private persons, 23
262262 and make such payments as may be necessary to 24

273273 N GENERAL.—Not later than 60 5
274274 days after the date on which the Special Inspec-6
275275 tor General is confirmed, and once every cal-7
276276 endar quarter thereafter, the Special Inspector 8
277277 General shall submit to the appropriate commit-9
278278 tees of Congress a report summarizing the ac-10
279279 tivities of the Special Inspector General during 11
280280 the 3-month period ending on the date on which 12
281281 the Special Inspector General submits the re-13
282282 port. 14
283283 ‘‘(B) C
284284 ONTENTS.—Each report submitted 15
285285 under subparagraph (A) shall include, for the 16
286286 period covered by the report, the following: 17
287287 ‘‘(i) A general description of the alle-18
288288 gations received and reviewed by the Spe-19
289289 cial Inspector General under subsection 20
290290 (d)(1)(A). 21
291291 ‘‘(ii) Recommendations of the Special 22
292292 Inspector General regarding reforms that 23
293293 the Special Inspector General believes 24
294294 should be undertaken with respect to the 25

303303 ‘‘(iii) For a covered institution with 6
304304 respect to which an allegation submitted 7
305305 under this section applies, the steps that 8
306306 the covered institution with respect to 9
307307 which an allegation submitted under this 10
308308 section applies, the steps that the covered 11
309309 institution has taken, and has yet to take, 12
310310 to remedy the issues outlined in the allega-13
311311 tion. 14
312312 ‘‘(iv) Data regarding the number of 15
313313 allegations received and reviewed by the 16
314314 Special Inspector General under this sec-17
315315 tion that document any legitimate viola-18
316316 tion, as determined by the Special inspec-19
317317 tor General, which shall— 20
318318 ‘‘(I) be disaggregated by the 21
319319 number of violations committed by 22
320320 each covered institution; and 23
321321 ‘‘(II) contain a separate provision 24
322322 listing the number of those acts that 25

333333 formed by the Special Inspector General, 8
334334 including, with respect to each covered in-9
335335 stitution has implemented recommenda-10
336336 tions made by the Special Inspector Gen-11
337337 eral and whether the covered institution 12
338338 has provided information or access re-13
339339 quested by the Special Inspector General. 14
340340 ‘‘(2) R
341341 ULE OF CONSTRUCTION .—Nothing in 15
342342 this subsection may be construed to authorize the 16
343343 public disclosure of information that is— 17
344344 ‘‘(A) specifically prohibited from disclosure 18
345345 by any other provision of law; 19
346346 ‘‘(B) specifically required by Executive 20
347347 order to be protected from disclosure in the in-21
348348 terest of national defense or national security or 22
349349 in the conduct of foreign affairs; or 23
350350 ‘‘(C) a part of an ongoing criminal inves-24
351351 tigation. 25

356356 priated $25,000,000 to carry out this section, which shall 2
357357 remain available until expended. 3

360360 TEGRITY ANDEFFICIENCY.—The Special Inspector Gen-5
361361 eral shall be a member of the Council of the Inspectors 6
362362 General on Integrity and Efficiency established under sec-7
363363 tion 424 of title 5, United States Code. 8

365365 ORRECTIVERESPONSES TO AUDITPROB-9
366366 LEMS.—A covered institution shall— 10
367367 ‘‘(1) take action to address deficiencies identi-11
368368 fied by a report or investigation of the Special In-12
369369 spector General; or 13
370370 ‘‘(2) with respect to a deficiency identified 14
371371 under paragraph (1), certify to the Special Inspector 15
372372 General and the appropriate committees of Congress 16
373373 that no action is necessary or appropriate. 17
374374 ‘‘(k) R
375375 ULE OFCONSTRUCTION.—Nothing in this sec-18
376376 tion may be construed as limiting the authority of the In-19
377377 spector General of the Department. 20
378378 ‘‘(l) S
379379 UNSET.—The Office of the Special Inspector 21
380380 General for Unlawful Discrimination in Higher Education, 22
381381 established under this section, shall terminate on the date 23
382382 that is 12 years after the date of enactment of the College 24
383383 Admissions Accountability Act of 2025.’’. 25

399399 BASIS OF RACE IN VIOLATION OF EQUAL 12
400400 PROTECTION CLAUSE OR TITLE VI. 13
401401 ‘‘Notwithstanding any other provision of law, no in-14
402402 stitution of higher education shall be eligible to receive 15
403403 funds from Federal student assistance or Federal institu-16
404404 tional aid under this Act if the Secretary determines that 17
405405 the institution had an admissions decision, policy, or prac-18
406406 tice, or financial aid determination or academic program, 19
407407 that discriminated on the basis of race in violation of— 20
408408 ‘‘(1) the Equal Protection Clause of the 14th 21
409409 Amendment to the Constitution of the United 22
410410 States, pursuant to the holding in Students for Fair 23
411411 Admissions, Inc. v. President and Fellows of Har-24
412412 vard College, 143 S. Ct. 2141 (2023); or 25
