PROHIBITION ON STATE DIVERSION OF FEDERAL 1 FUNDS TO REPLACE STATE SPENDING. 2 (a) I NGENERAL.—Section 404 of the Social Security 3 Act (42 U.S.C. 604) is amended by adding at the end the 4 following: 5 ‘‘(l) L IMITATION ONUSE OFFEDERALFUNDSTO 6 R EPLACESTATEGENERALREVENUEFUNDS.—A State 7 shall use Federal funds received under this part only to 8 supplement funds that, in the absence of the Federal 9 funds, would be made available from State and local 10 sources for programs assisted under this part, and not to 11 supplant the funds.’’. 12 (b) S TATECERTIFICATION.—Section 402(a) of such 13 Act (42 U.S.C. 602(a)) is amended by adding at the end 14 the following: 15 ‘‘(9) C ERTIFICATION OF STATE SUPPLEMEN -16 TATION.—A certification by the chief executive offi-17 cer of the State that the funds provided to the State 18 under this part will not be used to supplant State 19 or non-Federal funds for services and activities that 20 promote the purposes of this part.’’. 21 (c) E FFECTIVEDATE.—The amendments made by 22 this section shall take effect on October 1, 2025. 23 VerDate Sep 11 2014 01:40 Apr 05, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2584.IH H2584 ssavage on LAPJG3WLY3PROD with BILLS 3 •HR 2584 IH SEC. 3.
