5151 SEC. 2. ALLOWING FOR MEDICAL ASSISTANCE UNDER MED-5
5252 ICAID FOR INMATES DURING 30-DAY PERIOD 6

5454 (a) I
5555 NGENERAL.—The subdivision (A) following the 8
5656 last numbered paragraph of section 1905(a) of the Social 9
5757 Security Act (42 U.S.C. 1396d(a)) is amended by insert-10
5858 ing ‘‘or in the case of any individual during the 30-day 11
5959 period preceding the date of release of such individual 12
6060 from such public institution’’ before ‘‘);’’. 13

6262 EPORT.—Not later than 18 months after the 14
6363 date of enactment of this Act, the Medicaid and CHIP 15
6464 Payment and Access Commission shall submit a report to 16
6565 Congress on the Medicaid inmate exclusion under the sub-17
6666 division (A) following the last numbered paragraph of sec-18
6767 tion 1905(a) of the Social Security Act (42 U.S.C. 19
6868 1396d(a)). Such report shall, to the extent practicable, in-20
6969 clude the following information: 21

7272 SETTINGS.—An analysis and description of stand-23
7373 ards for health and safety for individuals who are in-24
7474 mates of correctional facilities, the health care pro-25

8181 (A) An assessment of access to health care 4
8282 for incarcerated individuals, including a descrip-5
8383 tion of medical and behavioral health services 6
8484 generally available to incarcerated individuals. 7
8585 (B) An assessment of Medicare and Med-8
8686 icaid conditions of participation for hospitals, 9
8787 psychiatric facilities, psychiatric residential 10
8888 treatment facilities, nursing facilities, and other 11
8989 relevant provider types, if any, and their poten-12
9090 tial application to health care services furnished 13
9191 to individuals who are inmates of correctional 14
9292 facilities. 15
9393 (C) An assessment of State licensing and 16
9494 certification standards, processes, and enforce-17
9595 ment mechanisms for correctional facilities, and 18
9696 the potential application of such standards, 19
9797 processes, and enforcement mechanisms to the 20
9898 provision of health care to individuals who are 21
9999 inmates of correctional facilities. 22

101101 for correctional facilities, the respective accred-24
102102 iting standards of such bodies, and the accred-25

112112 MPACT OF THE REENTRY ACT ; REC-6
113113 OMMENDATIONS FOR ADDITIONAL ACTION .— 7
114114 (A) The number of incarcerated individuals 8
115115 who would otherwise be eligible to enroll for 9
116116 medical assistance under a State plan approved 10
117117 under title XIX of the Social Security Act (42 11
118118 U.S.C. 1396 et seq.) (or a waiver of such a 12
119119 plan). 13
120120 (B) An analysis of the preliminary impact 14
121121 of the amendment made by subsection (a) on 15
122122 health care coverage and the transition back 16
123123 into the community for individuals who are 17
124124 newly released from correctional facilities. 18
125125 (C) A description of current practices re-19
126126 lated to the discharge of incarcerated individ-20
127127 uals, including how correctional facilities inter-21
128128 act with State Medicaid agencies to ensure that 22
129129 such individuals who are eligible to enroll for 23
130130 medical assistance under a State plan or waiver 24
131131 described in subparagraph (A) are so enrolled. 25

137137 Department of Health and Human Services, or 3
138138 States on further legislative or administrative 4

140140 (i) ensure access to comprehensive 6
141141 health coverage for incarcerated and newly 7
142142 released individuals, including an assess-8
143143 ment of the impact of the Medicaid inmate 9
144144 exclusion; and 10
145145 (ii) better facilitate an effective transi-11
146146 tion to community services and addiction 12
147147 treatment for newly released individuals. 13
148148 (E) Any other information that the Com-14
149149 mission determines would be useful to Con-15
150150 gress. 16
