A BILL 
To require public elementary and middle schools that receive 
funds under the Elementary and Secondary Education 
Act of 1965 to obtain parental consent before changing 
a minor’s gender markers, pronouns, or preferred name 
on any school form or sex-based accommodations, includ-
ing locker rooms or bathrooms. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Parental Rights Over 4
The Education and Care of Their Kids Act’’ or the ‘‘PRO-5
TECT Kids Act’’. 6

SEC. 2. REQUIREMENT RELATED TO GENDER MARKERS, 1
PRONOUNS, AND PREFERRED NAMES ON 2
SCHOOL FORMS. 3
(a) R
EQUIREMENT.—As a condition of receiving 4
funds under the Elementary and Secondary Education Act 5
of 1965 (20 U.S.C. 6301 et seq.), a public school that 6
receives funds under such Act shall be required to obtain 7
parental consent before changing a covered student’s— 8
(1) gender markers, pronouns, or preferred 9
name on any school form; or 10
(2) sex-based accommodations, including locker 11
rooms or bathrooms. 12

EFINITIONS.—In this section: 13
(1) C
OVERED STUDENT .—The term ‘‘covered 14
student’’ means a minor who is— 15
(A) an elementary school student; or 16
(B) a student in any of the middle grades. 17
(2) ESEA 
TERMS.—The terms ‘‘elementary 18
school’’, ‘‘middle grades’’, and ‘‘parent’’ have the 19
meanings given such terms in section 8101 of the 20
Elementary and Secondary Education Act of 1965 21
(20 U.S.C. 7801). 22
