16	16	and customs controls, and for other purposes.
17	17	Be it enacted by the Senate and House of Representa-1
18	18	tives of the United States of America in Congress assembled, 2
19	19	SECTION 1. SHORT TITLE. 3
20	20	This Act may be cited as the ‘‘Transnational Crimi-4
21	21	nal Organization Illicit Spotter Prevention and Elimi-5
22	22	nation Act’’. 6
23	23	SEC. 2. UNLAWFULLY HINDERING IMMIGRATION, BORDER, 7
24	24	AND CUSTOMS CONTROLS. 8

30	30	(1) IN GENERAL.—Chapter 9 of title II of the 1
31	31	Immigration and Nationality Act (8 U.S.C. 1351 et 2
32	32	seq.) is amended by adding at the end the following: 3
33	33	‘‘SEC. 295. UNLAWFULLY HINDERING IMMIGRATION, BOR-4
34	34	DER, AND CUSTOMS CONTROLS. 5
35	35	‘‘(a) I
36	36	LLICITSPOTTING.—Any person who knowingly 6
37	37	transmits, by any means, to another person the location, 7
38	38	movement, or activities of any Federal, State, local, or 8
39	39	tribal law enforcement agency with the intent to further 9
40	40	a Federal crime relating to United States immigration, 10
41	41	customs, controlled substances, agriculture, monetary in-11
42	42	struments, or other border controls shall be fined under 12
43	43	title 18, United States Code, imprisoned not more than 13
44	44	10 years, or both. 14

46	46	ESTRUCTION OF UNITEDSTATESBORDER 15

48	48	ONTROLS.—Any person who knowingly and without law-16
49	49	ful authorization destroys, alters, or damages any fence, 17
50	50	barrier, sensor, camera, or other physical or electronic de-18
51	51	vice deployed by the Federal Government to control the 19
52	52	border or a port of entry or otherwise seeks to construct, 20
53	53	excavate, or make any structure intended to defeat, cir-21
54	54	cumvent, or evade any such fence, barrier, sensor camera, 22
55	55	or other physical or electronic device deployed by the Fed-23
56	56	eral Government to control the border or a port of entry— 24

60	60	‘‘(1) shall be fined under title 18, United States 1
61	61	Code, imprisoned not more than 10 years, or both; 2
62	62	or 3
63	63	‘‘(2) if, at the time of the offense, the person 4
64	64	uses or carries a firearm or who, in furtherance of 5
65	65	any such crime, possesses a firearm, shall be fined 6
66	66	under such title 18, imprisoned not more than 20 7
67	67	years, or both. 8
68	68	‘‘(c) C
69	69	ONSPIRACY ANDATTEMPT.—Any person who 9
70	70	attempts or conspires to violate subsection (a) or (b) shall 10
71	71	be punished in the same manner as a person who com-11
72	72	pletes a violation of such subsection.’’. 12

74	74	LERICAL AMENDMENT .—The table of con-13
75	75	tents in the first section of the Immigration and Na-14
76	76	tionality Act (8 U.S.C. 1101 et seq.) is amended by 15
77	77	inserting after the item relating to section 294 the 16
78	78	following: 17
79	79	‘‘Sec. 295. Unlawfully hindering immigration, border, and customs controls.’’.

88	88	alien smuggling crime,’’ after ‘‘crime of vio-24
89	89	lence’’ each place that term appears; and 25

101	101	‘‘(A) the term ‘alien smuggling crime’ means 9
102	102	any felony punishable under section 274(a), 277, or 10
103	103	278 of the Immigration and Nationality Act (8 11
104	104	U.S.C. 1324(a), 1327, and 1328); 12
105	105	‘‘(B) the term ‘brandish’ means, with respect to 13
106	106	a firearm, to display all or part of the firearm, or 14
107	107	otherwise make the presence of the firearm known 15
108	108	to another person, in order to intimidate that per-16
109	109	son, regardless of whether the firearm is directly 17
110	110	visible to such person; 18
111	111	‘‘(C) the term ‘crime of violence’ means an of-19
112	112	fense that— 20
113	113	‘‘(i) is a felony; and 21
114	114	‘‘(ii)(I) has, as an element, the use, at-22
115	115	tempted use, or threatened use of physical force 23
116	116	against the person or property of another; or 24
