1919 This Act may be cited as the ‘‘Safe Workplaces Act’’. 4

2121 OLENCE IN THE WORKPLACE. 6

2323 TUDY.—The Director of the National Institute 7
2424 for Occupational Safety and Health shall conduct a study 8
2525 on reducing the threat of violence in the workplace. 9

2929 (b) REPORT.—Not later than 15 months after the 1
3030 date of the enactment of this Act, the Director shall sub-2
3131 mit to the Secretary of Labor, the Committee on Edu-3
3232 cation and Labor of the House of Representatives, and 4
3333 the Committee on Health, Education, Labor, and Pen-5
3434 sions of the Senate a report on the results of the study 6
3535 conducted under subsection (a), which shall include rec-7
3636 ommendations that the Secretary of Labor shall consider 8
3737 when issuing the guidance described in subsection (c). 9

3939 UIDANCE.— 10
4040 (1) I
4141 N GENERAL.—Not later than 4 years after 11
4242 the date of enactment of this Act, the Secretary of 12
4343 Labor, acting through the Occupational Safety and 13
4444 Health Administration, shall issue nonmandatory 14
4545 guidance on activities and work practice controls 15
4646 that can be implemented by workplaces to reduce 16
4747 workplace violence. Such guidance shall be differen-17
4848 tiated to the extent necessary to account for the 18
4949 unique characteristics of, and the potential for 19
5050 threats of violence at, of each variety of workplace, 20
5151 including grocery stores, retail stores, movie thea-21
5252 tres, hospitals, office buildings, restaurants and 22
5353 bars, religious facilities, manufacturing facilities, 23
5454 mail distribution centers, community centers, child 24
5555 care centers, and schools. 25

5959 (2) CONSIDERATION.—In issuing the guidance 1
6060 required under paragraph (1), the Secretary shall— 2
6161 (A) consider the recommendations included 3
6262 in the report required under subsection (b); and 4
6363 (B) take into account engineering controls, 5
6464 dangerous weapons, and environmental risk fac-6
6565 tors that may impact a workplace. 7

6767 EFINITIONS.—In this Act: 8

6969 ANGEROUS WEAPON .—The term ‘‘dan-9
7070 gerous weapon’’ means an instrument capable of in-10
7171 flicting death or serious bodily injury, without re-11
7272 gard to whether such instrument was designed for 12
7373 that purpose. 13

7575 NGINEERING CONTROLS .— 14
7676 (A) I
7777 N GENERAL.—The term ‘‘engineering 15
7878 controls’’ means an aspect of the built space or 16
7979 a device that removes a hazard from the work-17
8080 place or creates a barrier between an employee 18
8181 and the hazard. 19

8383 NCLUSIONS.—For purposes of reduc-20
8484 ing workplace violence hazards, the term ‘‘engi-21
8585 neering controls’’ includes electronic access con-22
8686 trols to employee occupied areas, weapon detec-23
8787 tors (installed or handheld), enclosed work-24
8888 stations with shatter-resistant glass, deep serv-25

9898 NVIRONMENTAL RISK FACTORS .— 6
9999 (A) I
100100 N GENERAL.—The term ‘‘environ-7
101101 mental risk factors’’ means factors in the facil-8
102102 ity or area in which a service is performed that 9
103103 may contribute to the likelihood or severity of 10
104104 a workplace violence incident. 11

106106 LARIFICATION.—Environmental risk 12
107107 factors may be associated with the specific task 13
108108 being performed or the work area, such as 14
109109 working in an isolated area, poor illumination 15
110110 or blocked visibility, and lack of physical bar-16
111111 riers between individuals and persons at risk of 17
112112 committing workplace violence. 18

114114 HREAT OF VIOLENCE .—The term ‘‘threat 19
115115 of violence’’ means a statement or conduct that— 20
116116 (A) causes an individual to fear for such 21
117117 individual’s safety because there is a reasonable 22
118118 possibility the individual might be physically in-23
119119 jured; and 24
120120 (B) serves no legitimate purpose. 25

127127 tice controls’’ means procedures and rules that 3
128128 are used to effectively reduce workplace violence 4

131131 NCLUSIONS.—The term ‘‘work prac-6
132132 tice controls’’ includes— 7
133133 (i) assigning and placing sufficient 8
134134 numbers of staff to reduce workplace vio-9
135135 lence directed at employees by customers, 10
136136 clients, patients, students, inmates, or any 11
137137 individual for whom the workplace provides 12
138138 services or for whom the employee per-13
139139 forms services; 14
140140 (ii) a provision of dedicated and avail-15
141141 able safety personnel such as security 16
142142 guards; 17
143143 (iii) employee training on workplace 18
144144 violence prevention methods and tech-19
145145 niques to de-escalate and minimize violent 20
146146 behavior; and 21
147147 (iv) employee training on procedures 22
148148 for response in the event of a workplace vi-23
149149 olence incident and for post-incident re-24
150150 sponse. 25

156156 N GENERAL.—The term ‘‘workplace 2
157157 violence’’ means any act of violence or threat of 3
158158 violence, without regard to intent, that occurs 4
159159 at a workplace or while an employee performs 5
160160 a service. 6

162162 XCLUSIONS.—The term ‘‘workplace 7
163163 violence’’ does not include lawful acts of self-de-8
164164 fense or lawful acts of defense of others. 9

166166 NCLUSIONS.—The term ‘‘workplace 10
167167 violence’’ includes— 11
168168 (i) the threat or use of physical force 12
169169 against a employee that results in or has 13
170170 a high likelihood of resulting in injury, 14
171171 psychological trauma, or stress, without re-15
172172 gard to whether the employee sustains an 16
173173 injury, psychological trauma, or stress; and 17
174174 (ii) an incident involving the threat or 18
175175 use of a firearm or a dangerous weapon, 19
176176 including the use of common objects as 20
177177 weapons, without regard to whether the 21
178178 employee sustains an injury, psychological 22
179179 trauma, or stress. 23
