2929 URPOSE.—The purpose of this section is to— 3
3030 ‘‘(1) authorize States to apply under this sec-4
3131 tion on behalf of the entire State, or on behalf of a 5
3232 local area or a consortium of local areas in the 6
3333 State, to receive the allotments or allocations of the 7
3434 State or the local areas, respectively, for youth work-8
3535 force investment activities and adult and dislocated 9
3636 worker employment and training activities under this 10
3737 Act, as a consolidated grant for 5 years for the pur-11
3838 pose of carrying out a demonstration project to pur-12
3939 sue innovative reforms to achieve better outcomes 13
4040 for jobseekers, employers, and taxpayers; and 14
4141 ‘‘(2) require that rigorous evaluations be con-15
4242 ducted to demonstrate if better outcomes and associ-16
4343 ated innovative reforms were achieved as a result of 17
4444 such demonstration projects. 18

4646 ENERALAUTHORITY.— 19
4747 ‘‘(1) W
4848 AIVERS AND DEMONSTRATION GRANT 20
4949 AMOUNTS.—Notwithstanding any other provision of 21
5050 law, during the demonstration period applicable to a 22
5151 demonstration project approved for a State pursuant 23
5252 to subsection (d)(3), the Secretary shall comply with 24
5353 each of the following: 25

9191 sum to the local board for such local 4
9292 area, for purposes of carrying out the 5
9393 project, the local area’s allocation for 6
9494 such fiscal year under— 7
9595 ‘‘(aa) subsections (b) and (c) 8
9696 of section 128; and 9
9797 ‘‘(bb) subsections (b) and 10
9898 (c) of section 133; or 11
9999 ‘‘(II) if the local board of the 12

101101 ment with the State for the State to 14
102102 serve as the fiscal agent for the local 15

110110 AREAS.—In a case of a consortium of local 22
111111 areas selected by a State to carry out a 23
112112 demonstration project under this section, 24

129129 State for the State to serve as the fis-13
130130 cal agent for the consortium during 14
131131 the demonstration project, use the 15
132132 funds described in subclause (I) for 16
133133 purposes of carrying out the project 17
134134 on behalf of such consortium. 18

136136 XCEPTIONS.— 19
137137 ‘‘(A) I
138138 N GENERAL.—A State, local area, or 20
139139 consortium of local areas carrying out a dem-21
140140 onstration project under this section shall com-22
141141 ply with statutory or regulatory requirements of 23
142142 this Act relating to— 24

152152 the use of such boards during the dem-7
153153 onstration period; and 8
154154 ‘‘(iii) the priority of service described 9
155155 in section 134(c)(3)(E). 10

157157 PPLICABILITY OF DEFINED 11
158158 TERMS.—In carrying out a demonstration 12
159159 project under this section, a State, local area, 13
160160 or consortium of local areas may only use a 14
161161 term defined in section 3 to describe an activity 15
162162 carried out under such demonstration project if 16
163163 the State, local area, or consortium of local 17
164164 areas gives such term the same meaning as 18
165165 such term is given under such section. 19
166166 ‘‘(3) A
167167 UTHORITY FOR THIRD -PARTY EVALUA-20
168168 TION.— 21
169169 ‘‘(A) I
170170 N GENERAL.—Not later than 180 22
171171 days after the first demonstration project is ap-23
172172 proved under this section, the Secretary shall 24
173173 contract with a third-party evaluator to conduct 25

178178 project approved under this section. The evalua-2
179179 tion shall— 3
180180 ‘‘(i) cover the 5-year period of each 4
181181 demonstration project; 5
182182 ‘‘(ii) compare the employment and 6
183183 earnings outcomes of participants in activi-7
184184 ties carried out under the demonstration 8
185185 project to— 9
186186 ‘‘(I) the outcomes of similarly sit-10
187187 uated individuals that do not partici-11
188188 pate in such activities who are located 12
189189 in such State, local area, or a local 13
190190 area in such consortium; and 14
191191 ‘‘(II) the outcomes of partici-15
192192 pants in activities under this chapter 16
193193 in the State, local area, or a local area 17
194194 in the consortium that was awarded a 18
195195 waiver prior to the award of such 19
196196 waiver; 20
197197 ‘‘(iii) conduct a qualitative analysis 21
198198 that identifies any promising practices or 22
199199 innovative strategies that— 23
200200 ‘‘(I) would not have been con-24
201201 ducted without the waiving of statu-25

207207 ‘‘(II) lead to positive employment 3
208208 and earnings outcomes for the partici-4

210210 ‘‘(iv) compare the outcomes for sub-6
211211 clauses (I) and (II) of clause (ii) with re-7
212212 spect to the subpopulations described in 8
213213 section 116(d)(2)(B). 9
214214 ‘‘(B) R
215215 EPORT.—Not later than 2 years 10
216216 after the fifth year of each demonstration 11
217217 project approved under this section, the Sec-12
218218 retary shall submit to the Committee on Edu-13
219219 cation and the Workforce of the House of Rep-14
220220 resentatives and the Committee on Health, 15
221221 Education, Labor, and Pensions, the results of 16
222222 the evaluation of such conducted under this 17
223223 paragraph. 18
224224 ‘‘(c) D
225225 EMONSTRATIONPERIOD; LIMITATIONS.— 19
226226 ‘‘(1) I
227227 N GENERAL.—A demonstration project 20
228228 approved under this section for a State, local area, 21
229229 or consortium— 22
230230 ‘‘(A) shall be carried out for a 5-year dem-23
231231 onstration period; and 24

236236 year demonstration period, if the State, local 2
237237 area, or consortium— 3
238238 ‘‘(i) for each of the final 3 years of 4
239239 the preceding 5-year demonstration period, 5
240240 meets its expected levels of performance 6
241241 established under subsection (f)(1)(C); and 7
242242 ‘‘(ii) on the final year of the preceding 8
243243 5-year demonstration period, achieves a 9
244244 performance improvement of not less than 10
245245 an average of a 5-percent increase across 11
246246 all of the indicators of performance de-12
247247 scribed in clauses (i) and (ii) of subsection 13
248248 (f)(1)(A), compared with— 14
249249 ‘‘(I) the highest level of perform-15
250250 ance for the corresponding indicators 16
251251 of performance, as described in sub-17
252252 section (f)(1)(B)(i) with respect to 18
253253 such State, for the most recent pro-19
254254 gram year that ended prior to the be-20
255255 ginning of the first year of the pre-21
256256 ceding 5-year demonstration period; 22
257257 or 23
258258 ‘‘(II) the alternate baseline level 24
259259 of performance for the corresponding 25

270270 EMONSTRATION PERIOD LIMITA -6
271271 TIONS.—For each 5-year demonstration period 7
272272 (including renewals of such period) the Sec-8
273273 retary may not approve— 9
274274 ‘‘(i) more than 8 demonstration 10
275275 projects for States to carry out a dem-11
276276 onstration project described in subsection 12
277277 (b)(1)(B)(i); and 13
278278 ‘‘(ii) more than 8 demonstration 14
279279 projects for local areas (or consortia of 15
280280 local areas) to carry out a demonstration 16
281281 project described in clause (ii) or (iii) of 17
282282 subsection (b)(1)(B). 18
283283 ‘‘(B) S
284284 TATE LIMITATIONS.—No more than 19
285285 1 demonstration project may be approved under 20
286286 this section per State. For purposes of this sub-21
287287 paragraph, a demonstration project described in 22
288288 clause (ii) or (iii) of subsection (b)(1)(B) ap-23
289289 proved for a local area or a consortium of local 24
290290 areas, respectively, in a State shall be consid-25

297297 PPLICATION.— 3
298298 ‘‘(1) I
299299 N GENERAL.—To be eligible to carry out 4
300300 a demonstration project under this section, a State 5
301301 shall submit to the Secretary an application at such 6
302302 time and in such manner as the Secretary may rea-7
303303 sonably require, and containing the information de-8
304304 scribed in paragraph (2). 9
305305 ‘‘(2) C
306306 ONTENT.—Each application submitted by 10
307307 a State under this subsection shall include the fol-11
308308 lowing: 12
309309 ‘‘(A) A description of the demonstration 13
310310 project to be carried out under this section, in-14
311311 cluding— 15
312312 ‘‘(i) whether the project will be car-16
313313 ried out— 17
314314 ‘‘(I) by the State as a whole; 18
315315 ‘‘(II) by a local area, and if so— 19
316316 ‘‘(aa) an identification of— 20
317317 ‘‘(AA) such local area; 21
318318 ‘‘(BB) whether the 22
319319 local board for such local 23
320320 area is the fiscal agent for 24
321321 the project, or whether the 25

340340 areas in the State, and if so— 16
341341 ‘‘(aa) an identification of— 17
342342 ‘‘(AA) each local area 18
343343 that comprises the consor-19

346346 that will serve as the fiscal 22

362362 ‘‘(AA) to carry out such 10
363363 project as a consortium; and 11
364364 ‘‘(BB) to the fiscal 12
365365 agent for the consortium 13
366366 identified in item (aa)(BB); 14
367367 ‘‘(ii) a description of the activities to 15
368368 be carried out under the project; and 16
369369 ‘‘(iii) the goals the State, local area, 17
370370 or consortium intends to achieve through 18
371371 such activities, which shall be aligned with 19
372372 the purpose described in subsection (a). 20
373373 ‘‘(B) A description of the performance out-21
374374 comes the State, the local area, or consortium 22
375375 expects to achieve for such activities for each 23
376376 year of the demonstration period as described 24
377377 in subsection (f)(1). 25

382382 area, or consortium consulted with employers, 2
383383 the State board, and the local boards in the 3
384384 State in determining the activities to carry out 4
385385 under the demonstration project. 5
386386 ‘‘(D) A description of how the State will 6
387387 make such activities available to jobseekers and 7
388388 employers in each of the local areas in the State 8
389389 or, in a case of a project that will be carried out 9
390390 by a local area or a consortium, a description 10
391391 of how such services will be made available to 11
392392 jobseekers and employers in such local area or 12
393393 each of the local areas in the consortium. 13
394394 ‘‘(E) A description, if appropriate, of how 14
395395 the State, local area, or consortium will inte-15
396396 grate the funds received, and the activities car-16
397397 ried out, under the demonstration project under 17
398398 this section with State workforce development 18
399399 programs and other Federal, State, or local 19
400400 workforce, education, or social service programs 20
401401 (including the programs and activities listed in 21
402402 section 103(a)(2), the program of adult edu-22
403403 cation and literacy activities authorized under 23
404404 title II, and the program authorized under title 24

410410 ‘‘(F) An assurance that the State, local 3
411411 area, or consortium will meet the requirements 4
412412 of this section. 5
413413 ‘‘(3) S
414414 ECRETARIAL APPROVAL .— 6
415415 ‘‘(A) I
416416 N GENERAL.—Not later than 60 7
417417 days after the date on which a State submits an 8
418418 application under this subsection, the Secretary 9
419419 shall— 10
420420 ‘‘(i) in a case in which the application 11
421421 meets the requirements of this section and 12
422422 is not subject to the limitations described 13
423423 in subsection (c)(2), approve such applica-14
424424 tion and the demonstration project de-15
425425 scribed in such application; or 16
426426 ‘‘(ii) provide to the State a written ex-17
427427 planation of initial disapproval that meets 18
428428 the requirements of subparagraph (C). 19
429429 ‘‘(B) D
430430 EFAULT APPROVAL .—With respect 20
431431 to an application submitted by a State under 21
432432 this subsection that is not subject to the limita-22
433433 tions described in subsection (c), if the Sec-23
434434 retary fails to approve such application or pro-24
435435 vide an explanation of initial disapproval for 25

440440 graph (A), the application and the demonstra-2
441441 tion project described in such application shall 3
442442 be deemed approved by the Secretary. 4
443443 ‘‘(C) I
444444 NITIAL DISAPPROVAL .—An expla-5
445445 nation of initial disapproval provided by the 6
446446 Secretary to a State under subparagraph (A)(ii) 7
447447 shall provide the State— 8
448448 ‘‘(i) a detailed explanation of why the 9
449449 application does not meet the requirements 10
450450 of this section; and 11
451451 ‘‘(ii) if the State is not subject to the 12
452452 limitations described in subsection (c), an 13
453453 opportunity to revise and resubmit the 14
454454 State’s application under this section. 15
455455 ‘‘(e) S
456456 TATEDEMONSTRATION PROJECTREQUIRE-16
457457 MENTS.—A State, local area, or consortium that has been 17
458458 approved to carry out a demonstration project under this 18
459459 section shall meet each of the following requirements: 19
460460 ‘‘(1) U
461461 SE OF FUNDS.—Use the funds received 20
462462 pursuant to subsection (b)(1)(B) solely to carry out 21
463463 the activities of the demonstration project to achieve 22
464464 the goals described in subsection (d)(2)(A). 23
465465 ‘‘(2) A
466466 DMINISTRATIVE COSTS LIMITATION .— 24
467467 Use not more than 10 percent of the funds received 25

472472 the administrative costs of carrying out the dem-2
473473 onstration project. 3
474474 ‘‘(3) P
475475 RIORITY FOR SERVICES .—Give priority 4
476476 for services under the project to veterans and their 5
477477 eligible spouses in accordance with the requirements 6
478478 of section 4215 of title 38, United States Code, re-7
479479 cipients of public assistance, low-income individuals, 8
480480 and individuals who are basic skills deficient. 9
481481 ‘‘(4) N
482482 UMBER OF PARTICIPANTS .—Serve a 10
483483 number of participants under the activities of the 11
484484 demonstration project for each year of the dem-12
485485 onstration period that— 13
486486 ‘‘(A) is greater than the number of partici-14
487487 pants served by such State, local area, or con-15
488488 sortium under the programs described in sub-16
489489 paragraph (A) of the definition of the term 17
490490 ‘core program provision’ under section 3 for the 18
491491 most recent program year that ended prior to 19
492492 the beginning of the first year of the dem-20
493493 onstration period; or 21
494494 ‘‘(B) is not less than the number of par-22
495495 ticipants to be served under the activities of the 23
496496 demonstration project that is agreed upon be-24

600600 Prior to approving an application for a dem-11
601601 onstration project submitted by a State, and 12
602602 using the expected levels of performance de-13
603603 scribed in such application, the Secretary shall 14
604604 reach an agreement with such State on the ex-15
605605 pected levels of performance for each of the in-16
606606 dicators of performance. In reaching an agree-17
607607 ment on such expected levels of performance, 18
608608 the Secretary and the State may consider the 19
609609 factors described in section 116(b)(3)(A)(v). 20

627627 gram year to reflect the actual characteris-8
628628 tics of participants served and the actual 9
629629 economic conditions experienced using a 10
630630 statistical adjustment model similar to the 11
