3030 NGENERAL.—Section 214(a)(2) of the Immi-4
3131 gration and Nationality Act (8 U.S.C. 1184(a)(2)) is 5
3232 amended by adding at the end the following: 6
3333 ‘‘(C) Notwithstanding section 101(a)(15)(R)(ii), an 7
3434 alien may apply for, and the Secretary of Homeland Secu-8
3535 rity may grant, an extension of nonimmigrant status 9
3636 under section 101(a)(15)(R) until such alien’s application 10
3737 for adjustment of status or an immigrant visa has been 11
3838 processed and a decision has been made on such applica-12
3939 tion if the alien— 13
4040 ‘‘(i) is the principal or derivative beneficiary of 14
4141 an immigrant petition filed pursuant to section 15
4242 204(a) for a preference status under section 16
4343 203(b)(4); and 17
4444 ‘‘(ii) is eligible to be granted such immigrant 18
4545 status absent the application of the numerical limita-19
4646 tions under sections 201, 202, and 203.’’. 20

4949 101(a)(15)(R)(ii) of the Immigration and Nationality Act 22
