A BILL
To provide for control of remote access of items under the
Export Control Reform Act of 2018.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Remote Access Secu-4
rity Act’’. 5
SEC. 2. CONTROL OF REMOTE ACCESS OF ITEMS UNDER 6
THE EXPORT CONTROL REFORM ACT OF 2018. 7
The Export Control Reform Act of 2018 is amended 8
as follows: 9

(1) In section 1742 (50 U.S.C. 4801), by add-1

‘‘(15) R
EMOTE ACCESS.—The term ‘remote ac-3
cess’ means— 4
‘‘(A) access to an item subject to the juris-5
diction of the United States by a foreign person 6
through a network connection, including the 7
internet or a cloud computing service, from a 8
location other than where the item is physically 9
located; or 10
‘‘(B) any other form of access specified in 11
regulations promulgated by the Secretary.’’. 12
(2) In section 1752 (50 U.S.C. 4811)— 13
(A) in paragraph (1)— 14
(i) in subparagraph (A), by inserting 15
‘‘or remote access of such items’’ after 16
‘‘export of items’’; and 17
(ii) in subparagraph (B), by inserting 18
‘‘or remote access of such items’’ after 19
‘‘export of items’’; and 20
(B) in paragraph (2)— 21
(i) in the matter preceding subpara-22
graph (A), by striking ‘‘and in-country 23
transfer of items’’ and inserting ‘‘in-coun-24
