| 31 | 31 | | Section 104(f) of the Foreign Assistance Act of 1961 4 |

| 32 | 32 | | (22 U.S.C. 2151b(f)) is amended by adding at the end 5 |

| 34 | 34 | | ‘‘(4)(A) An individual who is a Federal employee and 7 |
|---|
| 35 | 35 | | knowingly violates any of the requirements of this sub-8 |
|---|
| 36 | 36 | | section— 9 |
|---|
| 37 | 37 | | ‘‘(i) shall be terminated from Federal employ-10 |
|---|
| 38 | 38 | | ment and may not be receive any Federal employ-11 |
|---|
| 39 | 39 | | ment in the future; and 12 |
|---|
| 40 | 40 | | ‘‘(ii) shall be fiscally liable for an amount equal 13 |
|---|
| 41 | 41 | | to the amount of funds illegally allocated to the ac-14 |
|---|
| 42 | 42 | | tivity that was in violation of such requirements in 15 |
|---|
| 43 | 43 | | order to provide restitution to the Federal govern-16 |
|---|
| 44 | 44 | | ment. 17 |
|---|
| 45 | 45 | | ‘‘(B) A grantee, sub-grantee, contractor or other re-18 |
|---|
| 46 | 46 | | cipient of Federal funds who violates any of the require-19 |
|---|
| 47 | 47 | | ments of this subsection may not receive any Federal 20 |
|---|
| 48 | 48 | | funds in the future. 21 |

| 49 | 49 | | ‘‘(C) The Secretary of State— 22 |
|---|
| 50 | 50 | | ‘‘(i) shall make final determinations of viola-23 |
|---|
| 51 | 51 | | tions of the requirements of this subsection and the 24 |
|---|
| 52 | 52 | | penalties imposed under subparagraphs (A) and (B), 25 |
|---|
| 53 | 53 | | and such final determinations shall not be subject to 26 |

| 65 | 65 | | ‘‘(II) who carried out or was involved in 9 |

| 66 | 66 | | the violation; and 10 |
|---|
| 67 | 67 | | ‘‘(III) what will be done to ensure the vio-11 |
|---|
| 68 | 68 | | lation is not repeated. 12 |

| 69 | 69 | | ‘‘(D) Any final determination of the Secretary of 13 |

| 70 | 70 | | State under subparagraph (C)(i) shall be subject to the 14 |

| 71 | 71 | | procedures under chapter 8 of title 5, United States Code 15 |
