1919 This Act may be cited as the ‘‘Pecos Watershed Pro-4
2020 tection Act’’. 5
2121 SEC. 2. WITHDRAWAL OF FEDERAL LAND IN PECOS WATER-6

2424 EFINITION OFFEDERALLAND.—In this sec-8
2525 tion, the term ‘‘Federal land’’ means the Federal land de-9

3333 ITHDRAWAL.—Subject to valid rights in exist-3
3434 ence on the date of enactment of this Act, the Federal 4
3535 land is withdrawn from all forms of— 5
3636 (1) entry, appropriation, or disposal under the 6
3737 public land laws; 7
3838 (2) location, entry, and patent under the mining 8
3939 laws; and 9
4040 (3) disposition under all laws pertaining to min-10
4141 eral and geothermal leasing or mineral materials. 11
4242 SEC. 3. DESIGNATION OF THOMPSON PEAK WILDERNESS 12
4343 AREA, NEW MEXICO. 13

4545 EFINITIONS.—In this section: 14

4747 ECRETARY.—The term ‘‘Secretary’’ means 15
4848 the Secretary of Agriculture. 16

5050 TATE.—The term ‘‘State’’ means the State 17
5151 of New Mexico. 18

5353 ILDERNESS AREA.—The term ‘‘wilderness 19
5454 area’’ means the Thompson Peak Wilderness Area 20
5555 designated by subsection (b). 21

5757 ESIGNATION.—In accordance with the Wilder-22
5858 ness Act (16 U.S.C. 1131 et seq.), the approximately 23
5959 11,599 acres of land managed by the Forest Service in 24
6060 the State, as generally depicted on the map entitled ‘‘Pro-25

6767 tion System, to be known as the ‘‘Thompson Peak Wilder-4
6868 ness Area’’. 5

7070 AP ANDLEGALDESCRIPTION.— 6
7171 (1) I
7272 N GENERAL.—As soon as practicable after 7
7373 the date of enactment of this Act, the Secretary 8
7474 shall file a map and legal description of the wilder-9
7575 ness area with— 10
7676 (A) the Committee on Energy and Natural 11
7777 Resources of the Senate; and 12
7878 (B) the Committee on Natural Resources 13
7979 of the House of Representatives. 14

8181 FFECT.—The map and legal description 15
8282 filed under paragraph (1) shall have the same force 16
8383 and effect as if included in this Act, except that the 17
8484 Secretary may correct clerical and typographical er-18
8585 rors in the map and legal description. 19

8787 VAILABILITY.—The map and legal descrip-20
8888 tion filed under paragraph (1) shall be on file and 21
8989 available for public inspection in the Office of the 22
9090 Chief of the Forest Service. 23

9696 (1) IN GENERAL.—Subject to valid existing 1
9797 rights, the wilderness area shall be administered by 2
9898 the Secretary in accordance with the Wilderness Act 3
9999 (16 U.S.C. 1131 et seq.), except that any reference 4
100100 in that Act to the effective date of that Act shall be 5
101101 considered to be a reference to the date of enact-6
102102 ment of this Act. 7

104104 DJACENT MANAGEMENT .— 8

106106 O PROTECTIVE PERIMETERS OR 9
107107 BUFFER ZONES.—Congress does not intend for 10
108108 the designation of the wilderness area to create 11
109109 a protective perimeter or buffer zone around 12
110110 the wilderness area. 13
111111 (B) N
112112 ONWILDERNESS ACTIVITIES .—The 14
113113 fact that nonwilderness activities or uses out-15
114114 side of the wilderness area can be seen or heard 16
115115 from an area within the wilderness area shall 17
116116 not preclude the conduct of the nonwilderness 18
117117 activities or uses outside the boundaries of the 19
118118 wilderness area. 20

120120 ISH AND WILDLIFE MANAGEMENT .—In ac-21
121121 cordance with section 4(d)(7) of the Wilderness Act 22
122122 (16 U.S.C. 1133(d)(7)), nothing in this section af-23
123123 fects the jurisdiction or responsibilities of the State 24
124124 with respect to fish and wildlife management in the 25

129129 fishing, and trapping). 2

131131 RAZING.—The Secretary shall allow the 3
132132 continuation of the grazing of livestock in the wilder-4
133133 ness area, if established before the date of enact-5
134134 ment of this Act, in accordance with— 6
135135 (A) section 4(d)(4) of the Wilderness Act 7
136136 (16 U.S.C. 1133(d)(4)); and 8
137137 (B) the guidelines set forth in Appendix A 9
138138 of the report of the Committee on Interior and 10
139139 Insular Affairs of the House of Representatives 11
140140 accompanying H.R. 2570 of the 101st Congress 12
141141 (H. Rept. 101–405). 13

143143 ILDFIRE, INSECT, AND DISEASE CON -14
144144 TROL.—The Secretary may carry out measures in 15
145145 the wilderness area that the Secretary determines to 16
146146 be necessary to control fire, insects, or diseases, in 17
147147 accordance with section 4(d)(1) of the Wilderness 18
148148 Act (16 U.S.C. 1133(d)(1)). 19
149149 (e) I
150150 NCORPORATION OF ACQUIREDLAND ANDINTER-20
151151 ESTS INLAND.—Any land or interest in land within the 21
152152 boundaries of the wilderness area that is acquired by the 22
153153 United States after the date of enactment of this Act shall 23
154154 be added to and administered as part of the wilderness 24
155155 area. 25

160160 the wilderness area is withdrawn from— 2
161161 (1) entry, appropriation, or disposal under the 3
162162 public land laws; 4
163163 (2) location, entry, and patent under the mining 5
164164 laws; and 6
165165 (3) disposition under all laws relating to min-7
166166 eral and geothermal leasing or mineral materials. 8
