1919 This Act may be cited as the ‘‘Carnivals are Real En-4
2020 tertainment Act’’. 5
2121 SEC. 2. MOBILE ENTERTAINMENT WORKERS. 6

2525 N GENERAL.—Subparagraph (P) of section 8
2626 101(a)(15) of the Immigration and Nationality Act 9

4949 WORKERS.—Paragraph (4) of section 214(c) of the 18
5050 Immigration and Nationality Act (8 U.S.C. 19
5151 1184(c)(4)) is amended by adding at the end the fol-20
5252 lowing: 21
5353 ‘‘(I) The following shall apply to the ad-22
5454 mission of any alien under section 23
5555 101(a)(15)(P)(iv): 24

5959 ‘‘(i) The mobile entertainment pro-1
6060 vider shall be subject to the same program 2
6161 requirements that govern the admission of 3
6262 non-immigrants pursuant to section 4
6363 101(a)(15)(H)(ii)(b) of the Immigration 5
6464 and Nationality Act (8 U.S.C. 1101(a) 6
6565 (15)(H)(ii)(b)) as promulgated by the De-7
6666 partment of Labor in section 655 of title 8
6767 20 of the Code of Federal Regulations. 9
6868 ‘‘(ii) For purposes of section 10
6969 101(a)(15)(P)(iv), functions that are inte-11
7070 gral and essential to the operation of a mo-12
7171 bile entertainment provider include trans-13
7272 porting, assembly, operation, disassembly, 14
7373 and maintenance of mobile entertainment 15
7474 attractions, structures, and equipment, in-16
7575 cluding rides, games, novelties, and food or 17
7676 beverage concessions, as well as other func-18
7777 tions that are common in the mobile enter-19
7878 tainment industry and are necessary for 20
7979 the safe and efficient operation of the mo-21
8080 bile entertainment provider. 22
8181 ‘‘(iii) For purposes of this subpara-23
8282 graph, the term ‘mobile entertainment pro-24
8383 vider’ means— 25

8787 ‘‘(I) a carnival or circus that 1
8888 travels around the United States on a 2
8989 temporary or seasonal basis; or 3
9090 ‘‘(II) a provider of services nor-4
9191 mally affiliated with a carnival or cir-5
9292 cus, such as food and game conces-6
9393 sions, that travels around the United 7
9494 States on a seasonal or temporary 8
9595 basis to provide services to State, 9
9696 county, and local fairs and festivals, 10
9797 or support events sponsored by not- 11
9898 for-profit organizations for fund-12
9999 raising.’’. 13

101101 ULEMAKING.—Not later than 180 days 14
102102 after the date of the enactment of this Act, the Sec-15
103103 retary of Homeland Security and the Secretary of 16
104104 Labor shall separately publish in the Federal Reg-17
105105 ister proposed rules implementing the provisions of 18
106106 this section and the amendments made by this sec-19
107107 tion, and shall finalize such rules not later than 1 20
108108 year after the date of the enactment of this Act. 21
