14	14	nonimmigrant status to mobile entertainment workers,
15	15	and for other purposes.
16	16	Be it enacted by the Senate and House of Representa-1
17	17	tives of the United States of America in Congress assembled, 2
18	18	SECTION 1. SHORT TITLE. 3
19	19	This Act may be cited as the ‘‘Carnivals are Real En-4
20	20	tertainment Act’’. 5
21	21	SEC. 2. MOBILE ENTERTAINMENT WORKERS. 6
22	22	(a) M
23	23	OBILEENTERTAINMENT WORKERS.— 7
24	24	(1) I
25	25	N GENERAL.—Subparagraph (P) of section 8
26	26	101(a)(15) of the Immigration and Nationality Act 9
27	27	(8 U.S.C. 1101(a)(15)(P)) is amended— 10

31	31	(A) in clause (iii)(II), by striking ‘‘or’’ at 1
32	32	the end; 2
33	33	(B) by redesignating clause (iv) as clause 3
34	34	(v); 4
35	35	(C) in clause (v), as redesignated by sub-5
36	36	paragraph (B), by striking ‘‘clause (i), (ii), or 6
37	37	(iii)’’ and inserting ‘‘clause (i), (ii), (iii), or 7
38	38	(iv)’’; and 8
39	39	(D) by inserting after clause (iii) the fol-9
40	40	lowing: 10
41	41	‘‘(iv) seeks to enter the United States tem-11
42	42	porarily and solely for the purpose of per-12
43	43	forming functions that are integral and essen-13
44	44	tial to the operation of a mobile entertainment 14
45	45	provider (as set forth in section 15
46	46	214(c)(4)(I)(ii)); or’’. 16

48	48	DMISSION OF MOBILE ENTERTAINMENT 17
49	49	WORKERS.—Paragraph (4) of section 214(c) of the 18
50	50	Immigration and Nationality Act (8 U.S.C. 19
51	51	1184(c)(4)) is amended by adding at the end the fol-20
52	52	lowing: 21
53	53	‘‘(I) The following shall apply to the ad-22
54	54	mission of any alien under section 23
55	55	101(a)(15)(P)(iv): 24

59	59	‘‘(i) The mobile entertainment pro-1
60	60	vider shall be subject to the same program 2
61	61	requirements that govern the admission of 3
62	62	non-immigrants pursuant to section 4
63	63	101(a)(15)(H)(ii)(b) of the Immigration 5
64	64	and Nationality Act (8 U.S.C. 1101(a) 6
65	65	(15)(H)(ii)(b)) as promulgated by the De-7
66	66	partment of Labor in section 655 of title 8
67	67	20 of the Code of Federal Regulations. 9
68	68	‘‘(ii) For purposes of section 10
69	69	101(a)(15)(P)(iv), functions that are inte-11
70	70	gral and essential to the operation of a mo-12
71	71	bile entertainment provider include trans-13
72	72	porting, assembly, operation, disassembly, 14
73	73	and maintenance of mobile entertainment 15
74	74	attractions, structures, and equipment, in-16
75	75	cluding rides, games, novelties, and food or 17
76	76	beverage concessions, as well as other func-18
77	77	tions that are common in the mobile enter-19
78	78	tainment industry and are necessary for 20
79	79	the safe and efficient operation of the mo-21
80	80	bile entertainment provider. 22
81	81	‘‘(iii) For purposes of this subpara-23
82	82	graph, the term ‘mobile entertainment pro-24
83	83	vider’ means— 25

87	87	‘‘(I) a carnival or circus that 1
88	88	travels around the United States on a 2
89	89	temporary or seasonal basis; or 3
90	90	‘‘(II) a provider of services nor-4
91	91	mally affiliated with a carnival or cir-5
92	92	cus, such as food and game conces-6
93	93	sions, that travels around the United 7
94	94	States on a seasonal or temporary 8
95	95	basis to provide services to State, 9
96	96	county, and local fairs and festivals, 10
97	97	or support events sponsored by not- 11
98	98	for-profit organizations for fund-12
99	99	raising.’’. 13

101	101	ULEMAKING.—Not later than 180 days 14
102	102	after the date of the enactment of this Act, the Sec-15
103	103	retary of Homeland Security and the Secretary of 16
104	104	Labor shall separately publish in the Federal Reg-17
105	105	ister proposed rules implementing the provisions of 18
106	106	this section and the amendments made by this sec-19
107	107	tion, and shall finalize such rules not later than 1 20
108	108	year after the date of the enactment of this Act. 21
