1919 To amend the Family and Medical Leave Act of 1993 to
2020 prohibit an employer from recovering any health care
2121 premium paid by the employer for an employee if the
2222 employee fails to return to work due to the birth of
2323 a child, and for other purposes.

2727 This Act may be cited as the ‘‘Fairness for Stay-at- 4
2828 Home Parents Act’’. 5

3535 NGENERAL.—Section 104(c)(2)(B) of the Fam-3
3636 ily and Medical Leave Act of 1993 (29 U.S.C. 4
3737 2614(c)(2)(B)) is amended— 5
3838 (1) in clause (i), by striking the ‘‘or’’ at the 6
3939 end; 7
4040 (2) by redesignating clause (ii) as clause (iii); 8
4141 and 9
4242 (3) by inserting after clause (i) the following: 10
4343 ‘‘(ii) the birth of a son or daughter of 11
4444 the employee; or’’. 12

4646 OTICE.—Section 104(c) of the Family and Med-13
4747 ical Leave Act of 1993 (29 U.S.C. 2614(c)) is amended 14
4848 by adding at the end the following: 15
4949 ‘‘(4) N
5050 OTICE REGARDING OPTION TO NOT RE -16
5151 TURN FROM LEAVE .—An employer shall notify any 17
5252 eligible employee that takes leave for the birth of a 18
5353 son or daughter of the employee that the employer 19
5454 may not recover any premium described in para-20
5555 graph (2) that the employer paid for maintaining 21
5656 coverage for the employee if the employee fails to re-22
5757 turn due to such birth.’’. 23
