To prohibit special Government employees from holding con-
tracts or agreements with the Federal Government, and
for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Eliminating Looting 4
of Our Nation by Mitigating Unethical State Kleptocracy 5
Act of 2025’’ or the ‘‘ELON MUSK Act’’. 6

SEC. 2. PROHIBITION ON SPECIAL GOVERNMENT EMPLOY-1
EES HOLDING CONTRACTS OR AGREEMENTS 2
WITH THE FEDERAL GOVERNMENT. 3
(a) I
NGENERAL.—A special Government employee 4
may not enter into or benefit from any part of a contract 5
or agreement with the Federal Government. 6
(b) T
ERMINATION OF EXISTINGCONTRACTS.—Any 7
contract or agreement with the Federal Government held 8
by a special Government employee on the date of the en-9
actment of this Act shall be terminated. 10
(c) D
EFINITION.—In this section, the term ‘‘special 11
Government employee’’ has the meaning given that term 12
in section 202 of title 18, United States Code. 13
