15	15	Be it enacted by the Senate and House of Representa-1
16	16	tives of the United States of America in Congress assembled, 2
17	17	SECTION 1. SHORT TITLE. 3
18	18	This Act may be cited as the ‘‘Conservation Reserve 4
19	19	Enhancement Program Improvement Act of 2025’’. 5
20	20	SEC. 2. CONSERVATION RESERVE ENHANCEMENT PRO-6
21	21	GRAM. 7
22	22	(a) I
23	23	NGENERAL.—Section 1231A of the Food Secu-8
24	24	rity Act of 1985 (16 U.S.C. 3831a) is amended— 9

28	28	(1) in subsection (a)(4), in the matter pre-1
29	29	ceding subparagraph (A), by inserting ‘‘(other than 2
30	30	an agreement described in subsection (e))’’ after 3
31	31	‘‘this subchapter’’; 4
32	32	(2) in subsection (b)(2)(A)(vi), by inserting ‘‘or 5
33	33	other appropriate practices, such as dryland agricul-6
34	34	tural uses and grazing,’’ after ‘‘conservation prac-7
35	35	tices’’; 8
36	36	(3) in subsection (c), by adding at the end the 9
37	37	following: 10
38	38	‘‘(5) V
39	39	ARIABLE ALLOCATION.—An owner or op-11
40	40	erator may elect to determine the amounts of annual 12
41	41	payments under this section allocated to each year 13
42	42	of the agreement under subsection (b)(1). 14

44	44	ROUGHT AND WATER CONSERVATION 15
45	45	AGREEMENTS.— 16
46	46	‘‘(A) R
47	47	ETIREMENT OF WATER RIGHTS .—In 17
48	48	the case of an agreement described in sub-18
49	49	section (e) that includes a permanent retire-19
50	50	ment of water rights, the payment rates for an-20
51	51	nual payments shall be equal to the irrigated 21
52	52	acre payment rates determined by the Sec-22
53	53	retary. 23

55	55	RYLAND AGRICULTURAL USES .— 24

59	59	‘‘(i) IN GENERAL.—In the case of an 1
60	60	agreement described in subsection (e) that 2
61	61	permits dryland agricultural uses pursuant 3
62	62	to paragraph (2) of that subsection, the 4
63	63	payment rates for annual payments shall 5
64	64	be equal to the difference between— 6
65	65	‘‘(I) the irrigated acre payment 7
66	66	rates determined by the Secretary; 8
67	67	and 9
68	68	‘‘(II) the dryland acre payment 10
69	69	rates determined by the Secretary. 11
70	70	‘‘(ii) R
71	71	ETROACTIVE APPLICATION .—In 12
72	72	the case of an agreement covered by clause 13
73	73	(i) entered into before the date of enact-14
74	74	ment of this paragraph under which the 15
75	75	payment rate is lower than the payment 16
76	76	rate that would be calculated for the agree-17
77	77	ment under that clause, the Secretary shall 18
78	78	modify the agreement by calculating the 19
79	79	payment rate in accordance with that 20
80	80	clause.’’; and 21
81	81	(4) in subsection (e)— 22
82	82	(A) in the matter preceding paragraph (1), 23
83	83	by striking ‘‘may—’’ and inserting ‘‘shall—’’; 24

88	88	cluding agricultural land on which a continuous 2
89	89	crop or crop rotation is maintained)’’ after ‘‘ag-3
90	90	ricultural land’’; 4
91	91	(C) in paragraph (2), by striking ‘‘with the 5
92	92	adoption of best management practices on’’ and 6
93	93	inserting ‘‘in accordance with a conservation 7
94	94	plan adopted with respect to’’; and 8
95	95	(D) in paragraph (3), by inserting ‘‘subject 9
96	96	to subsection (c)(6),’’ before ‘‘calculate’’. 10

98	98	XEMPTIONFROMPAYMENTLIMITATION.—Sec-11
99	99	tion 1234(g) of the Food Security Act of 1985 (16 U.S.C. 12
100	100	3834(g)) is amended— 13
101	101	(1) in paragraph (1), by striking ‘‘paragraph 14
102	102	(2)’’ and inserting ‘‘paragraphs (2) and (3)’’; and 15
103	103	(2) by adding at the end the following: 16
104	104	‘‘(3) C
105	105	ONSERVATION RESERVE ENHANCEMENT 17
106	106	PROGRAM.—Paragraph (1) shall not apply to rental 18
107	107	payments received under agreements entered into 19
108	108	under section 1231A.’’. 20
