1919 SECTION 1. SHORT TITLE. 3
2020 This Act may be cited as the ‘‘Proper Leadership to 4
2121 Align Networks for Broadband Act’’ or the ‘‘PLAN for 5

2929 NGENERAL.—Not later than 1 year after the 3
3030 date of the enactment of this Act, the Assistant Secretary, 4
3131 in consultation with the heads of the covered agencies, 5
3232 shall develop and submit to the appropriate committees 6
3333 of Congress a National Strategy to Close the Digital Di-7
3434 vide to— 8
3535 (1) support better management of Federal 9
3636 broadband programs to deliver on the goal of pro-10
3737 viding high-speed, affordable broadband internet ac-11
3838 cess service to all individuals in the United States; 12
3939 (2) synchronize interagency coordination among 13
4040 covered agencies for Federal broadband programs; 14
4141 (3) synchronize interagency coordination re-15
4242 garding the process for approving the grant of an 16
4343 easement, right of way, or lease to, in, over, or on 17
4444 a building or any other property owned by the Fed-18
4545 eral Government for the right to install, construct, 19
4646 modify, or maintain infrastructure with respect to 20
4747 broadband internet access service; and 21
4848 (4) reduce barriers, lower costs, and ease ad-22
4949 ministrative burdens for State, local, and Tribal gov-23
5050 ernments to participate in Federal broadband pro-24
5151 grams. 25

5353 EQUIREDCONTENTS.—The Strategy shall— 26

6262 the affordability of, or the adoption of 6
6363 broadband internet access service; 7
6464 (2) describe current, as of the date on which 8
6565 the Strategy is submitted, Federal efforts to coordi-9
6666 nate Federal broadband programs; 10
6767 (3) identify gaps and limitations, including 11
6868 laws, that hinder, or may hinder, coordination across 12

8686 administrative burdens for State, local, and Tribal 2
8787 governments with respect to participation in Federal 3
8888 broadband programs; 4
8989 (7) recommend incentives, legislative solutions, 5
9090 and administrative actions to help State, local, and 6
9191 Tribal governments more efficiently— 7
9292 (A) distribute, and effectively administer, 8
9393 funding received from Federal broadband pro-9
9494 grams; and 10
9595 (B) resolve conflicts with respect to the 11
9696 funding described in subparagraph (A); 12
9797 (8) recommend incentives, legislative solutions, 13
9898 and administrative actions to— 14
9999 (A) improve the coordination and manage-15
100100 ment of Federal broadband programs; and 16
101101 (B) eliminate duplication with respect to 17
102102 Federal broadband programs; 18
103103 (9) describe current, as of the date on which 19
104104 the Strategy is submitted, efforts by covered agen-20
105105 cies to streamline the process for granting access to 21
106106 an easement, right of way, or lease to, in, over, or 22
107107 on a building or any other property owned by the 23

115115 to allowing regional, interstate, or cross-border eco-4
116116 nomic development organizations to participate in 5
117117 Federal broadband programs; and 6
118118 (11) address specific issues relating to closing 7
119119 the digital divide on Tribal lands. 8

121121 UBLICCONSULTATION.—In developing the 9
122122 Strategy, the Assistant Secretary shall consult with— 10
123123 (1) groups that represent consumers or the in-11
124124 terests of the public, including economically or so-12
125125 cially disadvantaged individuals; 13
126126 (2) subject matter experts; 14
127127 (3) providers of broadband internet access serv-15
128128 ice; 16
129129 (4) Tribal entities; and 17
130130 (5) State and local agencies and entities. 18
131131 SEC. 3. IMPLEMENTATION PLAN. 19
132132 (a) I
133133 NGENERAL.—Not later than 120 days after the 20
134134 date on which the Assistant Secretary submits the Strat-21
135135 egy to the appropriate committees of Congress under sec-22
136136 tion 2(a), the Assistant Secretary shall develop and submit 23
137137 to the appropriate committees of Congress an implementa-24
138138 tion plan for the Strategy. 25

144144 (1) provide a plan for implementing the roles, 3
145145 responsibilities, goals, objectives, and performance 4
146146 measures for the management of Federal broadband 5
147147 programs and interagency coordination efforts iden-6
148148 tified in the Strategy; 7
149149 (2) provide a plan for holding the covered agen-8
150150 cies accountable for the roles, responsibilities, goals, 9
151151 objectives, and performance measures identified in 10
152152 the Strategy; 11
153153 (3) describe the roles and responsibilities of the 12
154154 covered agencies, and the interagency mechanisms, 13
155155 to coordinate the implementation of the Strategy; 14
156156 (4) provide a plan for regular meetings among 15
157157 the heads of the covered agencies to coordinate the 16
158158 implementation of the Strategy and improve coordi-17
159159 nation among Federal broadband programs and for 18
160160 permitting processes for infrastructure with respect 19
161161 to broadband internet access service; 20
162162 (5) provide a plan for regular engagement with 21
163163 interested members of the public to evaluate Federal 22
164164 broadband programs, permitting processes for infra-23
165165 structure with respect to broadband internet access 24
166166 service, and progress in implementing the Strategy; 25

172172 broadband internet access service, provide a plan for 3
173173 the adoption of— 4
174174 (A) common data sets regarding those 5
175175 awards, including a requirement that covered 6
176176 agencies use the maps created under title VIII 7
177177 of the Communications Act of 1934 (47 U.S.C. 8
178178 641 et seq.); and 9
179179 (B) applications regarding those awards, 10
180180 as described in section 903(e) of the ACCESS 11
181181 BROADBAND Act (47 U.S.C. 1307(e)); 12
182182 (7) provide a plan to monitor and reduce waste, 13
183183 fraud, and abuse in Federal broadband programs, 14
184184 including wasteful spending resulting from frag-15
185185 mented, overlapping, and unnecessarily duplicative 16
186186 programs; 17
187187 (8) require consistent obligation and expendi-18
188188 ture reporting by covered agencies for Federal 19
189189 broadband programs, which shall be consistent with 20
190190 section 903(c)(2) of the ACCESS BROADBAND 21
191191 Act (47 U.S.C. 1307(c)(2)); 22
192192 (9) provide a plan to increase awareness of, and 23
193193 participation and enrollment in, Federal broadband 24

199199 (10) describe the administrative and legislative 3
200200 action that is necessary to carry out the Strategy. 4

202202 UBLICCOMMENT.—Not later than 30 days after 5
203203 the date on which the Assistant Secretary submits the 6
204204 Strategy to the appropriate committees of Congress under 7
205205 section 2(a), the Assistant Secretary shall seek public com-8
206206 ment regarding the development and implementation of 9
207207 the Implementation Plan. 10
208208 SEC. 4. BRIEFINGS AND IMPLEMENTATION. 11
209209 (a) B
210210 RIEFING.—Not later than 21 days after the date 12
211211 on which the Assistant Secretary submits the Implementa-13
212212 tion Plan to the appropriate committees of Congress under 14
213213 section 3(a), the Assistant Secretary, and appropriate rep-15
214214 resentatives from the covered agencies involved in the for-16
215215 mulation of the Strategy, shall provide a briefing on the 17
216216 implementation of the Strategy to the appropriate commit-18
217217 tees of Congress. 19

219219 MPLEMENTATION.— 20

221221 N GENERAL.—The Assistant Secretary 21
222222 shall— 22
223223 (A) implement the Strategy in accordance 23
224224 with the terms of the Implementation Plan; and 24

232232 date on which the Implementation Plan is fully 5
233233 implemented, brief the appropriate committees 6
234234 of Congress on the progress in implementing 7
235235 the Implementation Plan. 8

237237 ULE OF CONSTRUCTION .—Nothing in this 9
238238 subsection may be construed to affect the authority 10
239239 or jurisdiction of the Federal Communications Com-11
240240 mission or confer upon the Assistant Secretary or 12
241241 any executive agency the power to direct the actions 13
242242 of the Federal Communications Commission, either 14
243243 directly or indirectly. 15
244244 SEC. 5. GOVERNMENT ACCOUNTABILITY OFFICE STUDY 16
245245 AND REPORT. 17
246246 (a) S
247247 TUDY.—The Comptroller General of the United 18
248248 States shall conduct a study that shall— 19
249249 (1) examine the efficacy of the Strategy and the 20
250250 Implementation Plan in closing the digital divide; 21
251251 and 22
252252 (2) make recommendations regarding how to 23
253253 improve the Strategy and the Implementation Plan. 24

261261 appropriate committees of Congress a report on the re-5
262262 sults of the study conducted under subsection (a). 6
