A BILL
To amend the Fair Credit Reporting Act to prevent con-
sumer reporting agencies from furnishing consumer re-
ports under certain circumstances, and for other pur-
poses.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Homebuyers Privacy 4
Protection Act’’. 5

Section 604(c) of the Fair Credit Reporting Act (15 3
U.S.C. 1681b(c)) is amended by adding at the end the 4
following: 5
‘‘(4) T
REATMENT OF PRESCREENING REPORT 6
REQUESTS.— 7
‘‘(A) D
EFINITIONS.—In this paragraph: 8
‘‘(i) C
REDIT UNION.—The term ‘cred-9
it union’ means a Federal credit union or 10
a State credit union, as those terms are 11
defined in section 101 of the Federal Cred-12
it Union Act (12 U.S.C. 1752). 13
‘‘(ii) I
NSURED DEPOSITORY INSTITU -14
TION.—The term ‘insured depository insti-15
tution’ has the meaning given the term in 16
section 3 of the Federal Deposit Insurance 17
Act (12 U.S.C. 1813(c)). 18
‘‘(iii) R
ESIDENTIAL MORTGAGE 19
LOAN.—The term ‘residential mortgage 20
loan’ has the meaning given the term in 21
section 1503 of the S.A.F.E. Mortgage Li-22
censing Act of 2008 (12 U.S.C. 5102). 23
‘‘(iv) S
ERVICER.—The term ‘servicer’ 24
has the meaning given the term in section 25

dures Act of 1974 (12 U.S.C. 2605(i)). 2
‘‘(B) L
IMITATION.—If a person requests a 3
consumer report from a consumer reporting 4
agency in connection with a credit transaction 5
involving a residential mortgage loan, that 6
agency may not, based in whole or in part on 7
that request, furnish a consumer report to an-8
other person under this subsection unless— 9
‘‘(i) the transaction consists of a firm 10
offer of credit or insurance; and 11
‘‘(ii) that other person— 12
‘‘(I) has submitted documenta-13
tion to that agency certifying that 14
such other person has, pursuant to 15
paragraph (1)(A), the authorization of 16
the consumer to whom the consumer 17
report relates; or 18
‘‘(II)(aa) has originated a cur-19
rent residential mortgage loan of the 20
consumer to whom the consumer re-21
port relates; 22
‘‘(bb) is the servicer of a current 23
residential mortgage loan of the con-24

sumer to whom the consumer report 1
relates; or 2
‘‘(cc)(AA) is an insured deposi-3
tory institution or credit union; and 4
‘‘(BB) holds a current account 5
for the consumer to whom the con-6
sumer report relates.’’. 7
SEC. 3. EFFECTIVE DATE. 8
This Act, and the amendments made by this Act, 9
shall take effect on the date that is 180 days after the 10
date of enactment of this Act. 11
