employees, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Employee Limits ON 4
Profiteering Act’’. 5
SEC. 2. PROHIBITION ON FEDERAL AWARDS FOR SPECIAL 6
GOVERNMENT EMPLOYEES. 7
(a) P
ROHIBITION.—Except as provided in subsection 8
(b), the Federal Government may not enter into or make 9

a Federal award to a special Government employee or to 1
a covered third party. 2
(b) E
XCEPTION.—Subsection (a) does not apply to a 3
special Government employee who only serves as a member 4
of an advisory committee. 5
(c) R
EVISION OFFAR REQUIRED.—Not later than 6
60 days after the date of the enactment of this section, 7
the Federal Acquisition Regulation shall be revised in ac-8
cordance with this section. 9
(d) D
EFINITIONS.—In this section: 10
(1) A
DVISORY COMMITTEE .—The term ‘‘advi-11
sory committee’’ has the meaning given that term in 12
section 1001 of title 5, United States Code. 13
(2) C
OVERED THIRD PARTY .—The term ‘‘cov-14
ered third party’’ means— 15
(A) the spouse, child, and general partner 16
of a special Government employee; or 17
(B) an organization in which a special 18
Government employee serves as officer, director, 19
trustee, general partner, or employee. 20
(3) F
EDERAL AWARD .—The term ‘‘Federal 21
award’’ means a contract, grant, cooperative agree-22
ment, or other contract-like instrument, including an 23
agreement entered into pursuant to other trans-24
action authority. 25

(4) SPECIAL GOVERNMENT EMPLOYEE .—The 1
term ‘‘special Government employee’’ has the mean-2
ing given that term in section 202 of title 18, United 3
States Code. 4
