2323 This Act may be cited as the ‘‘New Opportunities for 4

2525 Overcome Waste Act,’’ or the ‘‘NO TIME TO Waste Act’’. 6

4444 OOD LOSS.—The term ‘‘food loss’’ means, 11
4545 with respect to food, that the food does not reach a 12
4646 consumer as a result of an issue in the production, 13

4949 OOD RECOVERY.—The term ‘‘food recov-15
5050 ery’’ means the collection of wholesome food that 16
5151 would otherwise go to waste and the redistribution 17
5252 of that food to feed people. 18

5454 OOD SPOILAGE.—The term ‘‘food spoil-19
5555 age’’ means a process or change that renders a food 20
5656 product undesirable or unacceptable for human con-21

7676 PCYCLED FOOD PRODUCT .—The term 9
7777 ‘‘upcycled food product’’ means a product that— 10
7878 (A) is created from surplus food, unmar-11
7979 ketable food, or edible or inedible food byprod-12

8181 (B) is made with ingredients that— 14
8282 (i) otherwise would not have gone to 15
8383 human consumption; 16
8484 (ii) are sourced and produced using 17
8585 supply chains for which upstream data can 18
8686 be verified and validated for accuracy; and 19
8787 (iii) have a positive impact on the en-20
8888 vironment. 21
8989 SEC. 3. OFFICE OF FOOD LOSS AND WASTE. 22

9191 STABLISHMENT.—The Secretary shall establish 23
9292 in the Department of Agriculture an Office of Food Loss 24
9393 and Waste (referred to in this section as the ‘‘Office’’). 25

104104 (3) research on new technologies to reduce food 8

106106 (4) quantifying the impact of food waste reduc-10
107107 tion policies on greenhouse gas emissions reductions; 11
108108 (5) submitting to Congress and making publicly 12
109109 available reports describing the progress of the 13
110110 United States in advancing toward or achieving the 14
111111 goal of reducing food loss and food waste by 50 per-15
112112 cent, compared to 2016 levels, by 2030; 16
113113 (6) publishing reports to Congress and to the 17
114114 public for the purpose of engaging with educational 18
115115 campaigns relating to food loss and food waste; 19
116116 (7) carrying out the grant program under sub-20
117117 section (d); 21
118118 (8) contributing to an assessment relating to 22
119119 how food loss and food waste affects climate change, 23
120120 food and nutrition security, and public health; 24

133133 Federal agencies to advance research relating to 10

135135 (11) analyzing food loss and food waste policy 12
136136 data and establishing and disseminating model poli-13
137137 cies for municipal, local, State, territorial, and Trib-14
138138 al governments that are proven to reduce food loss 15
139139 or food waste; 16
140140 (12) recommending new regulations, invest-17
141141 ments, or policies to the Liaison and the Secretary 18
142142 to address new identified gaps on preventing and re-19
143143 ducing food loss and food waste; and 20
144144 (13) carrying out such other activities as the 21
145145 Secretary or the Liaison determine to be appro-22

158158 food recovery issues locally, regionally, and nationally. 6

162162 N GENERAL.—The Office shall establish a 8
163163 grant program to support collecting data on existing 9
164164 State and local food loss and food waste policies. 10

166166 LIGIBILITY.—An entity eligible to receive 11
167167 a grant under paragraph (1) is— 12
168168 (A) a municipal, local, State, or Tribal 13
169169 government; 14
170170 (B) a partnership of 1 or more govern-15
171171 ments described in subparagraph (A) and 1 or 16
172172 more nonprofit organizations; or 17
173173 (C) a partnership of 2 or more— 18
174174 (i) governments described in subpara-19
175175 graph (A); or 20
176176 (ii) nonprofit organizations. 21

178178 OLLABORATION.—An entity that receives a 22
179179 grant under paragraph (1) may collaborate with 1 or 23
180180 more nonprofit, private, or other organizations in 24
181181 carrying out activities using the grant funds. 25

185185 (4) PROJECT REQUIREMENTS .—A data collec-1
186186 tion project carried out using a grant under para-2
187187 graph (1) shall— 3
188188 (A) be carried out for not longer than 3 4
189189 years; and 5
190190 (B) include the provision of data collected 6
191191 under the project to the Office. 7

193193 ATA REQUIREMENTS .—Data collected 8
194194 under a project carried out using a grant under 9
195195 paragraph (1) shall provide rigorous evidence of the 10
196196 impact of food loss and food waste policies, which 11
197197 may include— 12
198198 (A) estimates of the quantity of the reduc-13
199199 tion of food loss and food waste after the imple-14
200200 mentation of a policy; 15
201201 (B) where relevant, estimates of the quan-16
202202 tity of food loss and food waste in a similar 17
203203 community that is not subject to the policy; and 18
204204 (C) the economic benefits and impacts re-19
205205 alized from food that is recovered, upcycled, re-20
206206 used, or recycled. 21

208208 ATCHING REQUIREMENT .—An entity that 22
209209 receives a grant under paragraph (1) shall provide 23
210210 funds, in-kind contributions, or a combination of 24
211211 both from sources other than funds provided 25

221221 the data collected under the grant program under 6
222222 this paragraph, the Office shall analyze the data and 7
223223 establish model policies for municipal, local, State, 8
224224 and Tribal governments that are proven to reduce 9
225225 food waste. 10

229229 N GENERAL.—There is authorized to be 12
230230 appropriated to the Office $1,500,000 for each of 13
231231 fiscal years 2026 through 2030. 14

236236 be appropriated to carry out the grant program 17
237237 under subsection (d) $2,000,000 for each of fis-18
238238 cal years 2026 through 2030. 19

240240 DMINISTRATIVE COSTS .—Of the 20
241241 amount appropriated under subparagraph (A), 21
242242 the Secretary may retain not more than 4 per-22
243243 cent to pay administrative costs incurred by the 23
244244 Secretary in carrying out subsection (d). 24

254254 in the Department of Agriculture regional coordina-5

257257 ESPONSIBILITIES.—The regional coordina-7
258258 tors established under paragraph (1) shall be re-8
259259 sponsible for— 9
260260 (A) partnering with food producers, food 10
261261 processors, distributors, and food recovery orga-11
262262 nizations and acting as regional points of con-12
263263 tact to facilitate real-time food recovery; 13
264264 (B) understanding and developing the ca-14
265265 pacity needed for ongoing food recovery; 15
266266 (C) providing technical support to food re-16
267267 covery organizations to improve the ability of 17
268268 the food recovery organizations to pick up sur-18
269269 plus food, process that food, and deliver that 19
270270 food to populations or communities; and 20
271271 (D) engaging with Department of Agri-21
272272 culture regional food business centers to iden-22
273273 tify opportunities for synergy and alignment 23
274274 with those centers. 24

291291 Food Assistance Act of 1983 (7 U.S.C. 7507(d)) a 11
292292 program to award annual block grants to States and 12
293293 Indian Tribes to carry out projects to develop and 13
294294 support food recovery infrastructure and innovative 14
295295 food distribution models. 15

297297 ISTRIBUTION.—A State shall distribute a 16
298298 block grant received under paragraph (1) to applica-17
299299 ble food recovery organizations and local govern-18
300300 ments to address any gaps in food recovery infra-19
301301 structure, including— 20
302302 (A) storage and capacity of processing in-21
303303 frastructure equipment and facilities; 22
304304 (B) temperature-controlled food distribu-23
305305 tion infrastructure; 24

313313 (D) support of salaries, wages, and bene-5
314314 fits for food recovery organizations. 6

316316 OORDINATION.—In establishing the pro-7
317317 gram under paragraph (1), the Secretary shall co-8
318318 ordinate with other Department of Agriculture agen-9
319319 cies and programs, including— 10
320320 (A) the Agricultural Marketing Service; 11
321321 (B) the Emergency Food Assistance Pro-12
322322 gram Reach and Resiliency Grants; and 13
323323 (C) such other agencies and programs as 14
324324 the Secretary determines to be appropriate. 15

347347 ing through the Liaison and the Office of Food Loss 6
348348 and Waste established under section 3, in consulta-7
349349 tion with the Administrator and the Commissioner, 8
350350 shall submit to Congress and make publicly available 9
351351 a report describing the progress of the Secretary in 10
352352 carrying out the agreement described in paragraph 11
353353 (1). 12

355355 NTERAGENCY ENGAGEMENT .—Pursuant to 13
356356 paragraph (1), the Secretary, the Administrator, and 14
357357 the Commissioner shall engage with the heads of 15
358358 other Federal departments and agencies, including 16
359359 the Secretary of Defense, the Secretary of Edu-17
360360 cation, the Secretary of Transportation, the Sec-18
361361 retary of Homeland Security, the Administrator of 19
362362 General Services, and such other Federal depart-20
363363 ments and agencies as the Secretary, the Adminis-21
364364 trator, and the Commissioner determine to be appro-22
365365 priate, to expand work on food loss and food waste. 23

384384 (iv) sharing and developing procure-14
385385 ment best practices that will assist the 15
386386 heads of Federal departments and agencies 16
387387 described in paragraph (3) in— 17
388388 (I) preventing food loss and 18
389389 waste; 19
390390 (II) reducing food loss and food 20
391391 waste; 21
392392 (III) leading by example in ad-22
393393 dressing issues relating to food loss 23
394394 and food waste; and 24

403403 tives referred to in subparagraph (A) are rep-5
404404 resentatives of— 6
405405 (i) the private sector; 7
406406 (ii) agricultural producers; 8
407407 (iii) food industry members, such as 9
408408 food safety trainers, food aggregators and 10
409409 processors, food safety professionals, retail-11
410410 ers, and food service entities; 12
411411 (iv) nonprofit organizations; 13
412412 (v) food recovery organizations of 14
413413 varying sizes; and 15
414414 (vi) any other sector, as determined 16
415415 by the Secretary. 17

417417 EPRESENTATION OF SMALLER PRO -18
418418 DUCERS AND FOOD INSECURE COMMUNITIES .— 19
419419 In consulting and receiving advice under sub-20
420420 paragraph (A), the Secretary shall ensure par-21
421421 ticipation by smaller producers and organiza-22
422422 tions from communities most impacted by food 23
423423 and nutrition insecurity and food loss and food 24
424424 waste issues. 25

429429 retary may consult and receive advice under 2
430430 subparagraph (A) through— 3
431431 (i) a meeting through which input is 4
432432 sought, such as a workshop, town hall 5
433433 meeting, or listening session; 6
434434 (ii) a meeting described in clause (i) 7
435435 with an existing group formed by rep-8
436436 resentatives described in subparagraph 9
437437 (B); and 10
438438 (iii) such other means as the Sec-11
439439 retary determines to be appropriate. 12

441441 NTERAGENCY MEETINGS .—The Sec-13
442442 retary shall host quarterly meetings with the 14
443443 Administrator, the Commissioner, and the 15
444444 heads of other Federal agencies for the purpose 16
445445 of sharing communications relating to consulta-17
446446 tion and advice received under subparagraph 18
447447 (A) with those officials regularly. 19

449449 EXEMPTION.—Chapter 10 of 20
450450 title 5, United States Code (commonly referred 21
451451 to as the ‘‘Federal Advisory Committee Act’’), 22
452452 shall not apply to any group formed for pur-23
453453 poses of consultation or providing advice under 24
454454 this paragraph. 25
