2222 SECTION 1. SHORT TITLE. 3
2323 This Act may be cited as the ‘‘Mortgage Relief for 4
2424 Disaster Survivors Act’’. 5

3131 (a) I
3232 NGENERAL.—With respect to any disaster, a 4
3333 borrower with a covered mortgage loan for a property lo-5
3434 cated within the disaster area that is damaged or de-6
3535 stroyed by such disaster may request a forbearance on 7
3636 such loan during the covered period. 8
3737 (b) R
3838 EQUEST FORFORBEARANCE.—A borrower de-9
3939 scribed in subsection (a) may request a forbearance by— 10
4040 (1) submitting a written request for a forbear-11
4141 ance to the borrower’s servicer; and 12
4242 (2) providing documentation of verifiable dam-13
4343 age or destruction to the property. 14

4545 RANT OFFORBEARANCE.— 15
4646 (1) I
4747 N GENERAL.—Upon receiving a request for 16
4848 a forbearance from a borrower described in sub-17
4949 section (a), the borrower’s servicer shall grant a for-18
5050 bearance— 19
5151 (A) for a duration of 180 days; and 20
5252 (B) regardless of the delinquency status of 21
5353 the covered mortgage loan. 22

5555 XTENSION OF FORBEARANCE .—At any 23
5656 time during the forbearance, a borrower may request 24
5757 an extension, of not more than 180 days, of the du-25
5858 ration described in paragraph (1). 26

6262 (d) RIGHTTODISCONTINUE.—A borrower described 1
6363 in subsection (a) may request to discontinue the forbear-2
6464 ance at any time. 3

6666 CCRUAL.—During any forbearance granted 4
6767 under subsection (c), no fees, penalties, or interest (be-5
6868 yond the amounts scheduled or calculated as if the bor-6
6969 rower made all contractual payments on time and in full 7
7070 under the terms of the mortgage contract) shall accrue 8
7171 on the borrower’s account. 9
7272 SEC. 3. DEFINITIONS. 10

7474 (1) C
7575 OVERED MORTGAGE LOAN .—The ‘‘covered 12
7676 mortgage loan’’ means— 13
7777 (A) a Federally backed mortgage loan; or 14
7878 (B) a Federally backed multifamily mort-15
7979 gage loan. 16

8181 OVERED PERIOD.—The term ‘‘covered pe-17
8282 riod’’ means the period beginning on the date of the 18
8383 declaration of a disaster and ending on the date that 19
8484 such declaration ends. 20

8686 ISASTER.—The term ‘‘disaster’’ means 21
8787 any major disaster or emergency declared by the 22
8888 President under the Robert T. Stafford Disaster Re-23
8989 lief and Emergency Assistance Act (42 U.S.C. 4121 24

9494 (4) DISASTER AREA.—The term ‘‘disaster area’’ 1
9595 means, with respect to a disaster, any area that is 2
9696 subject to the declaration of such disaster. 3

9898 EDERALLY BACKED MORTGAGE LOAN .— 4
9999 The term ‘‘Federally backed mortgage loan’’ in-5
100100 cludes any loan (other than temporary financing, 6
101101 such as a construction loan) that is— 7
102102 (A) secured by a first or subordinate lien 8
103103 on residential real property (including indi-9
104104 vidual units of condominiums and cooperatives) 10
105105 designed principally for the occupancy of from 11
106106 1 to 4 families, including any such secured 12
107107 loan, the proceeds of which are used to prepay 13
108108 or pay off an existing loan secured by the same 14
109109 property; and 15
110110 (B) purchased or securitized by the Fed-16
111111 eral Home Loan Mortgage Corporation or the 17
112112 Federal National Mortgage Association. 18
113113 (6) F
114114 EDERALLY BACKED MULTIFAMILY MORT -19
115115 GAGE LOAN.—The term ‘‘Federally backed multi-20
116116 family mortgage loan’’ includes any loan (other than 21
117117 temporary financing, such as a construction loan) 22
118118 that is— 23
119119 (A) secured by a first or subordinate lien 24
120120 on residential multifamily real property de-25
