16	16	Administration in sanctuary jurisdictions, and for other

18	18	Be it enacted by the Senate and House of Representa-1
19	19	tives of the United States of America in Congress assembled, 2
20	20	SECTION 1. SHORT TITLE. 3
21	21	This Act may be cited as the ‘‘Save SBA from Sanc-4
22	22	tuary Cities Act’’. 5

26	26	SEC. 2. RELOCATION OF CERTAIN OFFICES IN SANCTUARY 1
27	27	JURISDICTIONS. 2
28	28	(a) I
29	29	NGENERAL.—The Administrator shall relocate 3
30	30	each covered office located in a sanctuary jurisdiction in 4
31	31	accordance with this section. 5
32	32	(b) D
33	33	ETERMINATION REQUIRED.—Subsection (a) 6
34	34	shall apply with respect to a covered office only if, prior 7
35	35	to ordering the relocation of such covered office under 8
36	36	such subsection, the Administrator makes a determination 9
37	37	that such covered office is located in a sanctuary jurisdic-10
38	38	tion and makes such determination publicly available. 11

40	40	ELOCATIONREQUIREMENT.—When relocating a 12
41	41	covered office under this section, the Administrator shall 13
42	42	relocate such covered office to a location that— 14
43	43	(1) is not in a sanctuary jurisdiction; and 15
44	44	(2) if the State in which such covered office is 16
45	45	located prior to such relocation is not a sanctuary 17
46	46	jurisdiction, is in such State. 18
47	47	(d) S
48	48	USPENSION OFOPERATIONS.—During the pe-19
49	49	riod the Administrator is relocating a covered office under 20
50	50	this section that is located in a State that is a sanctuary 21
51	51	jurisdiction, such covered office shall cease the operations 22
52	52	of such office in such State. 23

56	56	EADLINE.—Not later 60 days after the 25
57	57	Administrator makes publicly available a determina-26

61	61	tion under subsection (b) with respect to a covered 1
62	62	office, the Administrator shall relocate such covered 2
63	63	office in accordance with subsection (c). 3

65	65	ONCOMPLIANCE.— 4
66	66	(A) I
67	67	N GENERAL.—If a covered office de-5
68	68	scribed in paragraph (1) is not relocated in ac-6
69	69	cordance with subsection (c) prior to the expira-7
70	70	tion of the 60-day period applicable to such re-8
71	71	location under such paragraph— 9
72	72	(i) not later 5 days after the expira-10
73	73	tion of such 60-day period, the head of 11
74	74	such covered office shall submit to the Ad-12
75	75	ministrator a written explanation of why 13
76	76	such covered office was not relocated prior 14
77	77	to expiration of such 60-day period; and 15
78	78	(ii) during the period beginning on the 16
79	79	day after expiration of such 60-day period 17
80	80	and ending on the date on which such cov-18
81	81	ered office is relocated to a location that is 19
82	82	not in a sanctuary jurisdiction— 20
83	83	(I) such covered office shall cease 21
84	84	operations; and 22
85	85	(II) each employee of the Admin-23
86	86	istration whose duty station was at 24
87	87	such covered office shall be assigned 25

92	92	office that is located in the same 2
93	93	State and not in a sanctuary jurisdic-3
94	94	tion or, if no other covered office is lo-4
95	95	cated in the same State and not in a 5
96	96	sanctuary jurisdiction, any other cov-6
97	97	ered office that is not located in a 7
98	98	sanctuary jurisdiction. 8
99	99	(B) R
100	100	EMOVAL.—The Administrator shall 9
101	101	immediately remove the head of a covered office 10
102	102	required to submit a written explanation under 11
103	103	subparagraph (A)(i) if— 12
104	104	(i) such head does not submit such a 13
105	105	written explanation in accordance with 14
106	106	such subparagraph; or 15
107	107	(ii) the Administrator determines that 16
108	108	the reasons provided in the written expla-17
109	109	nation submitted by such head under such 18
110	110	subparagraph for the relocation of such 19
111	111	covered office not being completed prior to 20
112	112	the expiration of the 60-day period de-21
113	113	scribed in paragraph (1) with respect to 22
114	114	such covered office are insufficient. 23

119	119	may not establish a covered office in sanctuary jurisdic-2

122	122	EFINITIONS.—In this section: 4
123	123	(1) A
124	124	DMINISTRATION.—The term ‘‘Administra-5
125	125	tion’’ means the Small Business Administration. 6

127	127	DMINISTRATOR.—The term ‘‘Adminis-7
128	128	trator’’ means the Administrator of the Administra-8
129	129	tion. 9

131	131	OVERED OFFICE.—The term ‘‘covered of-10
132	132	fice’’ means a regional, district, or local office the 11
133	133	Administration, other than the headquarters of the 12
134	134	Administration, or any other component of the Ad-13
135	135	ministration fully funded by funds appropriated by 14
136	136	Congress. 15

138	138	ANCTUARY JURISDICTION .— 16
139	139	(A) I
140	140	N GENERAL.—Except as provided by 17
141	141	subparagraph (B), the term ‘‘sanctuary juris-18
142	142	diction’’ means any State or political subdivi-19
143	143	sion of a State that has in effect a statute, ordi-20
144	144	nance, policy, or practice that prohibits or re-21
145	145	stricts any government entity or official from— 22
146	146	(i) sending, receiving, maintaining, or 23
147	147	exchanging with any Federal, State, or 24
148	148	local government entity information re-25

153	153	tus (lawful or unlawful) of any individual; 2

155	155	(ii) complying with a request lawfully 4
156	156	made by the Department of Homeland Se-5
157	157	curity under section 236 or 287 of the Im-6
158	158	migration and Nationality Act (8 U.S.C. 7
159	159	1226 and 1357) to comply with a detainer 8
160	160	for, or notify about the release of, an indi-9
161	161	vidual. 10
162	162	(B) E
163	163	XCEPTION.—A State or political sub-11
164	164	division of a State shall not be deemed a sanc-12
165	165	tuary jurisdiction based solely on its having a 13
166	166	policy whereby its officials will not share infor-14
167	167	mation regarding, or comply with a request 15
168	168	made by the Department of Homeland Security 16
169	169	under section 236 or 287 of the Immigration 17
170	170	and Nationality Act (8 U.S.C. 1226 and 1357) 18
171	171	to comply with a detainer regarding, an indi-19
172	172	vidual who comes forward as a victim or a wit-20
173	173	ness to a criminal offense. 21
