2626 SEC. 2. RELOCATION OF CERTAIN OFFICES IN SANCTUARY 1
2727 JURISDICTIONS. 2
2828 (a) I
2929 NGENERAL.—The Administrator shall relocate 3
3030 each covered office located in a sanctuary jurisdiction in 4
3131 accordance with this section. 5
3232 (b) D
3333 ETERMINATION REQUIRED.—Subsection (a) 6
3434 shall apply with respect to a covered office only if, prior 7
3535 to ordering the relocation of such covered office under 8
3636 such subsection, the Administrator makes a determination 9
3737 that such covered office is located in a sanctuary jurisdic-10
3838 tion and makes such determination publicly available. 11

4040 ELOCATIONREQUIREMENT.—When relocating a 12
4141 covered office under this section, the Administrator shall 13
4242 relocate such covered office to a location that— 14
4343 (1) is not in a sanctuary jurisdiction; and 15
4444 (2) if the State in which such covered office is 16
4545 located prior to such relocation is not a sanctuary 17
4646 jurisdiction, is in such State. 18

4848 USPENSION OFOPERATIONS.—During the pe-19
4949 riod the Administrator is relocating a covered office under 20
5050 this section that is located in a State that is a sanctuary 21
5151 jurisdiction, such covered office shall cease the operations 22
5252 of such office in such State. 23

5656 EADLINE.—Not later 60 days after the 25

6262 office, the Administrator shall relocate such covered 2
6363 office in accordance with subsection (c). 3

6565 ONCOMPLIANCE.— 4
6666 (A) I
6767 N GENERAL.—If a covered office de-5
6868 scribed in paragraph (1) is not relocated in ac-6
6969 cordance with subsection (c) prior to the expira-7
7070 tion of the 60-day period applicable to such re-8
7171 location under such paragraph— 9
7272 (i) not later 5 days after the expira-10
7373 tion of such 60-day period, the head of 11
7474 such covered office shall submit to the Ad-12
7575 ministrator a written explanation of why 13
7676 such covered office was not relocated prior 14
7777 to expiration of such 60-day period; and 15
7878 (ii) during the period beginning on the 16
7979 day after expiration of such 60-day period 17
8080 and ending on the date on which such cov-18
8181 ered office is relocated to a location that is 19
8282 not in a sanctuary jurisdiction— 20
8383 (I) such covered office shall cease 21
8484 operations; and 22
8585 (II) each employee of the Admin-23
8686 istration whose duty station was at 24
8787 such covered office shall be assigned 25

9292 office that is located in the same 2
9393 State and not in a sanctuary jurisdic-3
9494 tion or, if no other covered office is lo-4
9595 cated in the same State and not in a 5
9696 sanctuary jurisdiction, any other cov-6
9797 ered office that is not located in a 7
9898 sanctuary jurisdiction. 8
9999 (B) R
100100 EMOVAL.—The Administrator shall 9
101101 immediately remove the head of a covered office 10
102102 required to submit a written explanation under 11
103103 subparagraph (A)(i) if— 12
104104 (i) such head does not submit such a 13
105105 written explanation in accordance with 14
106106 such subparagraph; or 15
107107 (ii) the Administrator determines that 16
108108 the reasons provided in the written expla-17
109109 nation submitted by such head under such 18
110110 subparagraph for the relocation of such 19
111111 covered office not being completed prior to 20
112112 the expiration of the 60-day period de-21
113113 scribed in paragraph (1) with respect to 22
114114 such covered office are insufficient. 23

119119 may not establish a covered office in sanctuary jurisdic-2

122122 EFINITIONS.—In this section: 4
123123 (1) A
124124 DMINISTRATION.—The term ‘‘Administra-5
125125 tion’’ means the Small Business Administration. 6

127127 DMINISTRATOR.—The term ‘‘Adminis-7
128128 trator’’ means the Administrator of the Administra-8
129129 tion. 9

131131 OVERED OFFICE.—The term ‘‘covered of-10
132132 fice’’ means a regional, district, or local office the 11
133133 Administration, other than the headquarters of the 12
134134 Administration, or any other component of the Ad-13
135135 ministration fully funded by funds appropriated by 14
136136 Congress. 15

138138 ANCTUARY JURISDICTION .— 16
139139 (A) I
140140 N GENERAL.—Except as provided by 17
141141 subparagraph (B), the term ‘‘sanctuary juris-18
142142 diction’’ means any State or political subdivi-19
143143 sion of a State that has in effect a statute, ordi-20
144144 nance, policy, or practice that prohibits or re-21
145145 stricts any government entity or official from— 22
146146 (i) sending, receiving, maintaining, or 23
147147 exchanging with any Federal, State, or 24
148148 local government entity information re-25

153153 tus (lawful or unlawful) of any individual; 2

155155 (ii) complying with a request lawfully 4
156156 made by the Department of Homeland Se-5
157157 curity under section 236 or 287 of the Im-6
158158 migration and Nationality Act (8 U.S.C. 7
159159 1226 and 1357) to comply with a detainer 8
160160 for, or notify about the release of, an indi-9
161161 vidual. 10

163163 XCEPTION.—A State or political sub-11
164164 division of a State shall not be deemed a sanc-12
165165 tuary jurisdiction based solely on its having a 13
166166 policy whereby its officials will not share infor-14
167167 mation regarding, or comply with a request 15
168168 made by the Department of Homeland Security 16
169169 under section 236 or 287 of the Immigration 17
170170 and Nationality Act (8 U.S.C. 1226 and 1357) 18
171171 to comply with a detainer regarding, an indi-19
172172 vidual who comes forward as a victim or a wit-20
173173 ness to a criminal offense. 21
