2424 This Act may be cited as the ‘‘All Economic Regula-4

4040 ‘‘SEC. 651. AGENCY MONTHLY SUBMISSION TO OFFICE OF 11
4141 INFORMATION AND REGULATORY AFFAIRS. 12
4242 ‘‘On a monthly basis, the head of each agency shall 13
4343 submit to the Administrator of the Office of Information 14
4444 and Regulatory Affairs (referred to in this chapter as the 15
4545 ‘Administrator’), in such a manner as the Administrator 16
4646 may reasonably require, the following information: 17
4747 ‘‘(1) For each rule that the agency expects to 18
4848 propose or finalize during the 12-month period fol-19
4949 lowing the month covered by the monthly submis-20
5050 sion: 21
5151 ‘‘(A) A summary of the nature of the rule, 22
5252 including the regulation identifier number and 23
5353 the docket number for the rule. 24
5454 ‘‘(B) The objectives of and legal basis for 25
5555 the issuance of the rule, including— 26

121121 pected to be publically disclosed, and, if 8
122122 that date is altered in subsequent reports, 9
123123 a brief explanation for the change; and 10
124124 ‘‘(iii) the Internet address of the in-11
125125 formation or peer review completed and 12
126126 disclosed or of where the information or 13
127127 peer review will be found, once completed 14
128128 and disclosed. 15

148148 the following, with respect to the previous year: 4
149149 ‘‘(A) The information that the Adminis-5
150150 trator received from the head of each agency 6
151151 under section 651. 7
152152 ‘‘(B) The number of rules and a list of 8
153153 each such rule— 9
154154 ‘‘(i) that was proposed by each agen-10
155155 cy, including, for each such rule, an indica-11
156156 tion of whether the issuing agency con-12
157157 ducted an analysis of the costs or benefits 13
158158 of the rule; and 14
159159 ‘‘(ii) that was finalized by each agen-15
160160 cy, including for each such rule an indica-16
161161 tion of whether— 17
162162 ‘‘(I) the issuing agency conducted 18
163163 an analysis of the costs or benefits of 19
164164 the rule; 20
165165 ‘‘(II) the agency claimed an ex-21
166166 emption from the procedures under 22
167167 section 553 pursuant to section 23
168168 553(b)(B); and 24

177177 list of each such action taken by each agency 6

179179 ‘‘(i) repealed a rule; 8
180180 ‘‘(ii) reduced the scope of a rule; 9
181181 ‘‘(iii) reduced the cost of a rule; or 10
182182 ‘‘(iv) accelerated the expiration date 11
183183 of a rule. 12
184184 ‘‘(D) The total cost (without reducing the 13
185185 cost by any offsetting benefits) of all rules pro-14
186186 posed or finalized, the total cost of any un-15
187187 funded mandates imposed by all such rules, and 16
188188 the number of rules for which an estimate of 17
189189 the cost of the rule was not available. 18
190190 ‘‘(2) P
191191 UBLICATION ON THE INTERNET .—Not 19
192192 later than October 1 of each year, the Administrator 20
193193 shall make publicly available on the Internet the fol-21
194194 lowing: 22
195195 ‘‘(A) The analysis of the costs or benefits, 23
196196 if conducted, for each proposed rule or final 24
197197 rule issued by an agency for the previous year. 25

207207 vious year, and the authority under which each 7

210210 each such rule for which the head of an agency 10
211211 completed a review under section 610 for the 11
212212 previous year. 12
213213 ‘‘(E) The number of rules and a list of 13
214214 each such rule submitted to the Comptroller 14
215215 General under section 801. 15
216216 ‘‘(F) The number of rules and a list of 16
217217 each such rule for which a resolution of dis-17
218218 approval was introduced in either the House of 18
219219 Representatives or the Senate under section 19
220220 802. 20
221221 ‘‘SEC. 653. REQUIREMENT FOR RULES TO APPEAR IN AGEN-21
222222 CY-SPECIFIC MONTHLY PUBLICATION. 22

224224 NGENERAL.—Subject to subsection (b), a rule 23
225225 may not take effect until the information required to be 24
226226 made publicly available on the Internet regarding such 25

233233 XCEPTIONS.—The requirement of subsection 3
234234 (a) shall not apply in the case of a rule— 4
235235 ‘‘(1) for which the agency issuing the rule 5
236236 claims an exception under section 553(b)(B); or 6
237237 ‘‘(2) which the President determines by Execu-7
238238 tive order should take effect because the rule is— 8
239239 ‘‘(A) necessary because of an imminent 9
240240 threat to health or safety or other emergency; 10
241241 ‘‘(B) necessary for the enforcement of 11
242242 criminal laws; 12
243243 ‘‘(C) necessary for national security; or 13
244244 ‘‘(D) issued pursuant to any statute imple-14
245245 menting an international trade agreement. 15
246246 ‘‘SEC. 654. DEFINITIONS. 16
247247 ‘‘In this chapter, the terms ‘agency’, ‘agency action’, 17
248248 ‘rule’, and ‘rule making’ have the meanings given those 18
249249 terms in section 551, and the term ‘unfunded mandate’ 19
250250 has the meaning given the term ‘Federal mandate’ in sec-20
251251 tion 421(6) of the Congressional Budget Act of 1974 (2 21
252252 U.S.C. 658(6)).’’. 22

280280 date that is 60 days after the date of the enact-16
281281 ment of this Act. 17

283283 EADLINE.—The first requirement to 18
284284 publish or make available, as the case may be, 19
285285 under subsection (b) of section 652 of title 5, 20
286286 United States Code, as added by subsection (a), 21
287287 shall be the first October 1 after the effective 22
288288 date of such subsection. 23
