2323 This Act may be cited as the ‘‘Justice for 9/11 Act’’. 4

3232 LEAAGREEMENTS AND JUDGMENTS.—Notwith-5
3333 standing the provisions of section 949h of title 10, United 6
3434 States Code, any plea agreement entered into by Khalid 7
3535 Shaikh Mohammad, Walid Muhammad Salih Mubarak 8
3636 Bin ‘Attash, or Mustafa Ahmed Adam al Hawsawi for ac-9
3737 tions involving the terrorist attack on September 11, 10
3838 2001, and its related judgment, shall not preclude the trial 11
3939 of such individual under chapter 47A of such title or any 12
4040 other provision of law for that terrorist attack. 13

4242 ENTENCING.—Notwithstanding any other provi-14
4343 sion of law, in any trial of Khalid Shaikh Mohammad, 15
4444 Walid Muhammad Salih Mubarak Bin ‘Attash, or Mustafa 16
4545 Ahmed Adam al Hawsawi under chapter 47A of title 10, 17
4646 United States Code, or any other provision of law for the 18
4747 terrorist attack of September 11, 2001, a sentence of 19
4848 death shall be available. 20

5050 ONDITIONS OF CONFINEMENT; TRANSFER.— 21
5151 Notwithstanding any other provision of law, in the case 22
5252 of any sentence imposed on Khalid Shaikh Mohammad, 23
5353 Walid Muhammad Salih Mubarak Bin ‘Attash, or Mustafa 24
5454 Ahmed Adam al Hawsawi, such individual— 25
5555 (1) shall be— 26

6666 authorities at United States Naval Station, 8
6767 Guantanamo Bay, Cuba; and 9
6868 (2) shall not be transferred to the continental 10
