2929 (a) I
3030 NGENERAL.—The Administrator of the Small 4
3131 Business Administration shall ensure that any application 5
3232 for a loan submitted under section 7(a) of the Small Busi-6
3333 ness Act (15 U.S.C. 636(a)) or title V of the Small Busi-7
3434 ness Investment Act of 1958 (15 U.S.C. 695 et seq.) in-8
3535 cludes the following information: 9
3636 (1) The date of birth for each individual appli-10
3737 cant for such loan or for each individual owner of 11
3838 an applicant concern. 12
3939 (2) Certification that— 13
4040 (A) an individual applicant for such loan is 14
4141 a citizen of the United States, a national of the 15
4242 United States, or a lawful permanent resident 16
4343 of the United States; or 17
4444 (B) an applicant concern for such loan or 18
4545 a guarantor for such loan is 100 percent bene-19
4646 ficially owned by individuals who are either citi-20
4747 zens of the United States, nationals of the 21
4848 United States, or lawful permanent residents of 22
4949 the United States. 23
5050 (3) Certification that no direct or indirect 24
5151 owner of an applicant concern for such loan is an in-25
5252 eligible person. 26

5656 (4) Documentation of the alien registration 1
5757 number of any lawful permanent resident who is— 2
5858 (A) an individual applicant for such loan; 3
5959 or 4
6060 (B) an owner of an applicant concern. 5

6262 ROHIBITION.—An applicant for a loan under 6
6363 section 7(a) of the Small Business Act (15 U.S.C. 636(a)) 7
6464 or title V of the Small Business Investment Act of 1958 8
6565 (15 U.S.C. 695 et seq.) is ineligible for such loan if— 9
6666 (1) the applicant submits the application for 10
6767 such loan after the date of the enactment of this Act 11
6868 and such application does not contain the informa-12
6969 tion required under subsection (a); 13
7070 (2) in the case such applicant is an applicant 14
7171 concern, any direct or indirect owner of such appli-15
7272 cant concern is an ineligible person; or 16
7373 (3) in the case such applicant is an individual 17
7474 applicant, such applicant is an ineligible person. 18

7676 NELIGIBLEPERSONDEFINED.—In this Act, the 19
7777 term ‘‘ineligible person’’ means— 20
7878 (1) an asylee; 21
7979 (2) a refugee; 22
8080 (3) an individual issued a visa to remain in the 23

8585 (4) an alien classified as a nonimmigrant under 1
8686 any subparagraph of section 101(a)(15) of the Im-2
8787 migration and Nationality Act (8 U.S.C. 3
8888 1101(a)(15)); 4
8989 (5) an alien to whom deferred action has been 5
9090 granted pursuant to the Deferred Action for Child-6
9191 hood Arrivals policy announced by the Secretary of 7
9292 Homeland Security on June 15, 2012; or 8
9393 (6) an alien present in the United States with-9
9494 out lawful status under the immigration laws (as 10
9595 such term is defined in section 101(a) of the Immi-11
9696 gration and Nationality Act (8 U.S.C. 1101(a))). 12
