21	21	To limit the authority of the Small Business Administration
22	22	to facilitate access to voter registration, and for other
23	23	purposes.
24	24	Be it enacted by the Senate and House of Representa-1
25	25	tives of the United States of America in Congress assembled, 2
26	26	SECTION 1. SHORT TITLE. 3
27	27	This Act may be cited as the ‘‘Business over Ballots 4
28	28	Act’’. 5
29	29	SEC. 2. SENSE OF CONGRESS. 6
30	30	It is the sense of Congress that— 7

34	34	(1) the Small Business Administration should 1
35	35	focus on aiding and assisting small business con-2
36	36	cerns; 3
37	37	(2) facilitating access to voter registration is be-4
38	38	yond the scope of the mission of the Administration 5
39	39	and the authority of the Administration under Fed-6
40	40	eral law; and 7
41	41	(3) any Executive order issued by the President 8
42	42	may not conflict with this Act or otherwise compel 9
43	43	the Administrator of the Small Business Administra-10
44	44	tion to facilitate access to voter registration. 11
45	45	SEC. 3. LIMITATIONS ON FACILITATION OF ACCESS TO 12
46	46	VOTER REGISTRATION BY THE SMALL BUSI-13
47	47	NESS ADMINISTRATION. 14

49	49	ROHIBITION.—The Administrator of the Small 15
50	50	Business Administration may not take any action to facili-16
51	51	tate access to voter registration other than actions author-17
52	52	ized by Federal law. 18
53	53	(b) T
54	54	ERMS OFCONTRACTS.—On or after the date of 19
55	55	the enactment of this Act, any contract or other agree-20
56	56	ment entered into by the Administrator to provide assist-21
57	57	ance to a person shall include a term stating that such 22
58	58	person may not use such assistance to facilitate access to 23
59	59	voter registration. 24

63	63	(c) EXISTINGRECIPIENTS.—A recipient of assistance 1
64	64	from the Administrator may not use such assistance to 2
65	65	facilitate access to voter registration unless explicitly au-3
66	66	thorized by the terms of such assistance. 4

68	68	OVEREDENTITIES.—The Administrator may 5
69	69	not use, act through, or otherwise make a request of a 6
70	70	covered entity to engage in activities to facilitate access 7
71	71	to voter registration unless the Administrator is so author-8
72	72	ized by Congress. 9

74	74	EFINITIONS.—In this Act: 10
75	75	(1) A
76	76	DMINISTRATOR.—The term ‘‘Adminis-11
77	77	trator’’ means the Administrator of the Small Busi-12
78	78	ness Administration. 13

80	80	OVERED ENTITY.—The term ‘‘covered en-14
81	81	tity’’— 15
82	82	(A) means an entity, State government, or 16
83	83	unit of local government that receives funding 17
84	84	or other assistance from the Administrator 18
85	85	under a contract, cooperative agreement, memo-19
86	86	randum of understanding, or other agreement 20
87	87	to carry out a program administered by the Ad-21
88	88	ministrator; and 22
