To amend title 10, United States Code, to provide for the 
coverage of assisted reproductive services under the 
TRICARE program, and for other purposes. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Expanding Access to 4
Fertility Care for Servicemembers and Dependents Act’’. 5

SEC. 2. COVERAGE OF ASSISTED REPRODUCTIVE SERVICES 1
UNDER TRICARE PROGRAM. 2
Chapter 55 of title 10, United States Code, is amend-3
ed by inserting after section 1074o the following new sec-4
tion: 5
‘‘§ 1074p. Assisted reproductive services for certain 6
members and dependents 7
‘‘(a) I
NGENERAL.—Any member of the armed forces 8
(including the reserve components) performing active serv-9
ice who is entitled to medical care under the TRICARE 10
program, and any dependent of such a member, shall be 11
entitled to assisted reproductive services as part of such 12
medical care, without regard to any of the following: 13
‘‘(1) Whether the assisted reproductive service 14
is related to the treatment of a service-connected 15
disability. 16
‘‘(2) Whether the member has a serious illness 17
or injury resulting from a service-connected dis-18
ability. 19
‘‘(3) The ability of the member or dependent, 20
as applicable— 21
‘‘(A) to conceive a pregnancy or carry a 22
pregnancy to live birth after an appropriate pe-23
riod of regular, unprotected sexual intercourse; 24
or 25

‘‘(B) to reproduce, either as an individual 1
or with a partner. 2
‘‘(4) The sex, gender, sexual orientation, or 3
marital status of the member or dependent, as appli-4
cable. 5
‘‘(b) D
EFINITIONS.—In this section: 6
‘‘(1) The term ‘appropriate period’ means, with 7
respect to an individual, a period of at least one 8
year, unless the health care provider of the indi-9
vidual determines, based on medical history, age, or 10
physical findings, that a shorter period is appro-11
priate. 12
‘‘(2) The term ‘assisted reproductive services’ 13
includes the following services: 14
‘‘(A) Assisted reproduction, including 15
intravaginal insemination, intracervical insemi-16
nation, and intrauterine insemination. 17
‘‘(B) In-vitro fertilization. 18
‘‘(C) The preservation of embryos, eggs, or 19
sperm through cryopreservation. 20
‘‘(D) Such other forms of assisted repro-21
ductive services as determined appropriate by 22
the Secretary.’’. 23
