2121 This Act may be cited as the ‘‘Expanding Access to 4
2222 Fertility Care for Servicemembers and Dependents Act’’. 5

2828 Chapter 55 of title 10, United States Code, is amend-3
2929 ed by inserting after section 1074o the following new sec-4
3030 tion: 5
3131 ‘‘§ 1074p. Assisted reproductive services for certain 6
3232 members and dependents 7
3333 ‘‘(a) I
3434 NGENERAL.—Any member of the armed forces 8
3535 (including the reserve components) performing active serv-9
3636 ice who is entitled to medical care under the TRICARE 10
3737 program, and any dependent of such a member, shall be 11
3838 entitled to assisted reproductive services as part of such 12
3939 medical care, without regard to any of the following: 13
4040 ‘‘(1) Whether the assisted reproductive service 14
4141 is related to the treatment of a service-connected 15
4242 disability. 16
4343 ‘‘(2) Whether the member has a serious illness 17
4444 or injury resulting from a service-connected dis-18
4545 ability. 19
4646 ‘‘(3) The ability of the member or dependent, 20
4747 as applicable— 21
4848 ‘‘(A) to conceive a pregnancy or carry a 22
4949 pregnancy to live birth after an appropriate pe-23
5050 riod of regular, unprotected sexual intercourse; 24
5151 or 25

5555 ‘‘(B) to reproduce, either as an individual 1

5757 ‘‘(4) The sex, gender, sexual orientation, or 3
5858 marital status of the member or dependent, as appli-4
5959 cable. 5

6161 EFINITIONS.—In this section: 6
6262 ‘‘(1) The term ‘appropriate period’ means, with 7
6363 respect to an individual, a period of at least one 8
6464 year, unless the health care provider of the indi-9
6565 vidual determines, based on medical history, age, or 10
6666 physical findings, that a shorter period is appro-11
6767 priate. 12
6868 ‘‘(2) The term ‘assisted reproductive services’ 13
6969 includes the following services: 14
7070 ‘‘(A) Assisted reproduction, including 15
7171 intravaginal insemination, intracervical insemi-16
7272 nation, and intrauterine insemination. 17
7373 ‘‘(B) In-vitro fertilization. 18
7474 ‘‘(C) The preservation of embryos, eggs, or 19
7575 sperm through cryopreservation. 20
7676 ‘‘(D) Such other forms of assisted repro-21
7777 ductive services as determined appropriate by 22
7878 the Secretary.’’. 23
