3030 NGENERAL.—Section 104(c)(1) of title 23, 3
3131 United States Code, is amended— 4
3232 (1) in subparagraph (B)— 5
3333 (A) by striking clause (i); and 6
3434 (B) by redesignating clauses (ii) and (iii) 7
3535 as clauses (i) and (ii), respectively; and 8
3636 (2) by adding at the end the following: 9
3737 ‘‘(C) D
3838 ISCRETIONARY INCREASE IN 10
3939 AMOUNTS FOR POPULATION GROWTH .—In addi-11
4040 tion to the amounts described in subparagraphs 12
4141 (A) and (B), the Secretary may provide an ad-13
4242 ditional amount to each State that has in-14
4343 creased in population since the previous decen-15
4444 nial census conducted under section 141(a) of 16
4545 title 13, United States Code, in a proportion 17
4646 based on the relative increase in each such pop-18
4747 ulation, as determined appropriate by the Sec-19
4848 retary .’’. 20

5050 PPLICABILITY.—The amendments made by sub-21
5151 section (a) shall apply beginning with the first fiscal year 22
5252 beginning after the date of enactment of this Act. 23
5353 SEC. 3. HIGHWAY FORMULA MODERNIZATION STUDY. 24

5555 NGENERAL.—The Secretary of Transportation, 25

6161 metropolitan planning organizations), shall conduct a 2
6262 highway formula modernization study to assess the meth-3
6363 od and data used to apportion Federal-aid highway funds 4
6464 under subsections (b) and (c) of section 104 of title 23, 5
6565 United States Code, and issue recommendations relating 6
6666 to such method and data. 7
6767 (b) A
6868 SSESSMENT.—The highway formula moderniza-8
6969 tion study required under subsection (a) shall include an 9
7070 assessment of, based on the latest available data, whether 10
7171 the apportionment method described in such subsection re-11
7272 sults in— 12
7373 (1) an equitable distribution of funds based on 13
7474 the estimated tax payments attributable to— 14
7575 (A) highway users in the State that are 15
7676 paid into the Highway Trust Fund; and 16
7777 (B) individuals in the State that are paid 17
7878 to the Treasury, based on contributions to the 18
7979 Highway Trust Fund from the general fund of 19
8080 the Treasury; and 20
8181 (2) the achievement of the goals described in 21
8282 section 101(b)(3) of title 23, United States Code. 22

8484 ONSIDERATIONS.—In the assessment under sub-23
8585 section (b), the Secretary shall consider the following: 24

9090 104(f)(2), 104(h)(2), 130(f), and 144(e) of title 23, 2
9191 United States Code, as in effect on the date of en-3
9292 actment of SAFETEA–LU (Public Law 109–59; 4
9393 119 Stat. 1144). 5
9494 (2) The availability and accuracy of data nec-6
9595 essary to calculate formula apportionments under 7
9696 the factors described in paragraph (1). 8
9797 (3) The measures established under section 150 9
9898 of title 23, United States Code, and whether those 10
9999 measures are appropriate for consideration as for-11
100100 mula apportionment factors. 12
101101 (4) Any other factors that the Secretary deter-13
102102 mines are appropriate. 14

104104 ECOMMENDATIONS .—The Secretary, in con-15
105105 sultation with the State departments of transportation 16
106106 and representatives of local governments (including metro-17
107107 politan planning organizations), shall develop rec-18
108108 ommendations on a new apportionment method, includ-19
109109 ing— 20
110110 (1) the factors recommended to be included in 21
111111 the new apportionment method; 22
112112 (2) the weighting recommended to be applied to 23
113113 the factors recommended under paragraph (1); and 24

119119 uitable distribution of funds described under sub-3
120120 section (b)(1) and the goals described in subsection 4

123123 EPORT TOCONGRESS.—Not later than 90 days 6
124124 after the date of enactment of this Act, the Secretary shall 7
125125 submit to Congress a report containing the study con-8
126126 ducted under subsection (a) and the recommendations de-9
127127 veloped under subsection (d). 10
