16	16	discretionary increase in certain highway funding to take
17	17	into account population growth of a State, and for other
18	18	purposes.
19	19	Be it enacted by the Senate and House of Representa-1
20	20	tives of the United States of America in Congress assembled, 2
21	21	SECTION 1. SHORT TITLE. 3
22	22	This Act may be cited as the ‘‘Highway Formula 4
23	23	Fairness Act’’. 5

28	28	FUNDING FOR POPULATION GROWTH. 2
29	29	(a) I
30	30	NGENERAL.—Section 104(c)(1) of title 23, 3
31	31	United States Code, is amended— 4
32	32	(1) in subparagraph (B)— 5
33	33	(A) by striking clause (i); and 6
34	34	(B) by redesignating clauses (ii) and (iii) 7
35	35	as clauses (i) and (ii), respectively; and 8
36	36	(2) by adding at the end the following: 9
37	37	‘‘(C) D
38	38	ISCRETIONARY INCREASE IN 10
39	39	AMOUNTS FOR POPULATION GROWTH .—In addi-11
40	40	tion to the amounts described in subparagraphs 12
41	41	(A) and (B), the Secretary may provide an ad-13
42	42	ditional amount to each State that has in-14
43	43	creased in population since the previous decen-15
44	44	nial census conducted under section 141(a) of 16
45	45	title 13, United States Code, in a proportion 17
46	46	based on the relative increase in each such pop-18
47	47	ulation, as determined appropriate by the Sec-19
48	48	retary .’’. 20
49	49	(b) A
50	50	PPLICABILITY.—The amendments made by sub-21
51	51	section (a) shall apply beginning with the first fiscal year 22
52	52	beginning after the date of enactment of this Act. 23
53	53	SEC. 3. HIGHWAY FORMULA MODERNIZATION STUDY. 24
54	54	(a) I
55	55	NGENERAL.—The Secretary of Transportation, 25
56	56	in consultation with the State departments of transpor-26

60	60	tation and representatives of local governments (including 1
61	61	metropolitan planning organizations), shall conduct a 2
62	62	highway formula modernization study to assess the meth-3
63	63	od and data used to apportion Federal-aid highway funds 4
64	64	under subsections (b) and (c) of section 104 of title 23, 5
65	65	United States Code, and issue recommendations relating 6
66	66	to such method and data. 7
67	67	(b) A
68	68	SSESSMENT.—The highway formula moderniza-8
69	69	tion study required under subsection (a) shall include an 9
70	70	assessment of, based on the latest available data, whether 10
71	71	the apportionment method described in such subsection re-11
72	72	sults in— 12
73	73	(1) an equitable distribution of funds based on 13
74	74	the estimated tax payments attributable to— 14
75	75	(A) highway users in the State that are 15
76	76	paid into the Highway Trust Fund; and 16
77	77	(B) individuals in the State that are paid 17
78	78	to the Treasury, based on contributions to the 18
79	79	Highway Trust Fund from the general fund of 19
80	80	the Treasury; and 20
81	81	(2) the achievement of the goals described in 21
82	82	section 101(b)(3) of title 23, United States Code. 22

84	84	ONSIDERATIONS.—In the assessment under sub-23
85	85	section (b), the Secretary shall consider the following: 24

89	89	(1) The factors described in sections 104(b), 1
90	90	104(f)(2), 104(h)(2), 130(f), and 144(e) of title 23, 2
91	91	United States Code, as in effect on the date of en-3
92	92	actment of SAFETEA–LU (Public Law 109–59; 4
93	93	119 Stat. 1144). 5
94	94	(2) The availability and accuracy of data nec-6
95	95	essary to calculate formula apportionments under 7
96	96	the factors described in paragraph (1). 8
97	97	(3) The measures established under section 150 9
98	98	of title 23, United States Code, and whether those 10
99	99	measures are appropriate for consideration as for-11
100	100	mula apportionment factors. 12
101	101	(4) Any other factors that the Secretary deter-13
102	102	mines are appropriate. 14
103	103	(d) R
104	104	ECOMMENDATIONS .—The Secretary, in con-15
105	105	sultation with the State departments of transportation 16
106	106	and representatives of local governments (including metro-17
107	107	politan planning organizations), shall develop rec-18
108	108	ommendations on a new apportionment method, includ-19
109	109	ing— 20
110	110	(1) the factors recommended to be included in 21
111	111	the new apportionment method; 22
112	112	(2) the weighting recommended to be applied to 23
113	113	the factors recommended under paragraph (1); and 24

118	118	the new apportionment method best achieves an eq-2
119	119	uitable distribution of funds described under sub-3
120	120	section (b)(1) and the goals described in subsection 4

123	123	EPORT TOCONGRESS.—Not later than 90 days 6
124	124	after the date of enactment of this Act, the Secretary shall 7
125	125	submit to Congress a report containing the study con-8
126	126	ducted under subsection (a) and the recommendations de-9
127	127	veloped under subsection (d). 10
