21	21	To amend the Internal Revenue Code of 1986 to remove
22	22	short-barreled shotguns from the definition of firearms
23	23	for purposes of the National Firearms Act, and for other
24	24	purposes.
25	25	Be it enacted by the Senate and House of Representa-1
26	26	tives of the United States of America in Congress assembled, 2
27	27	SECTION 1. SHORT TITLE. 3
28	28	This Act may be cited as the ‘‘No Frivolous Applica-4
29	29	tion for Short-Barreled Shotguns Act’’ or as the ‘‘NFA 5
30	30	SBS Act’’. 6

36	36	NGENERAL.—Section 5845(a) of the Internal 2
37	37	Revenue Code of 1986 is amended— 3
38	38	(1) by striking ‘‘(1) a shotgun having a barrel 4
39	39	or barrels of less than 18 inches in length; (2) a 5
40	40	weapon made from a shotgun if such weapon as 6
41	41	modified has an overall length of less than 26 inches 7
42	42	or a barrel or barrels of less than 18 inches in 8
43	43	length; (3)’’ and inserting ‘‘(1)’’, and 9
44	44	(2) by redesignating paragraphs (4) through 10
45	45	(8) as paragraphs (2) through (6), respectively. 11

48	48	VICES.—Section 5845(f) of such Code is amended by 13
49	49	striking ‘‘except a shotgun or shotgun shell which the Sec-14
50	50	retary finds is generally recognized as particularly suitable 15
51	51	for sporting purposes’’ and inserting ‘‘except shotgun 16
52	52	shells and any weapon that is designed to shoot shotgun 17
53	53	shells’’. 18

55	55	FFECTIVEDATE.—The amendment made by 19
56	56	this section shall apply to calendar quarters beginning 20
57	57	more than 90 days after the date of the enactment of this 21
58	58	Act. 22

65	65	Section 922 of title 18, United States Code, is 4
66	66	amended in each of subsections (a)(4) and (b)(4) by strik-5
67	67	ing ‘‘short-barreled shotgun,’’. 6
68	68	SEC. 4. TREATMENT OF SHORT-BARRELED SHOTGUNS DE-7
69	69	TERMINED BY REFERENCE TO NATIONAL 8
70	70	FIREARMS ACT. 9
71	71	Section 5841 of the Internal Revenue Code of 1986 10
72	72	is amended by adding at the end the following: 11
73	73	‘‘(f) S

76	76	ETERMINED BYREFERENCE.—In the case of any short- 13
77	77	barreled shotgun registration or licensing requirement 14
78	78	under State or local law which is determined by reference 15
79	79	to the National Firearms Act, any person who acquires 16
80	80	or possesses such a shotgun in accordance with chapter 17
81	81	44 of title 18, United States Code, shall be treated as 18
82	82	meeting any such registration or licensing requirement 19
83	83	with respect to such shotgun.’’. 20
84	84	SEC. 5. PREEMPTION OF CERTAIN STATE LAWS IN RELA-21
85	85	TION TO SHORT-BARRELED SHOTGUNS. 22
86	86	Section 927 of title 18, United States Code, is 23
87	87	amended by adding at the end the following: ‘‘Notwith-24
88	88	standing the preceding sentence, a law of a State or a 25
89	89	political subdivision of a State that imposes a tax, other 26

93	93	than a generally applicable sales or use tax, on making, 1
94	94	transferring, using, possessing, or transporting a short- 2
95	95	barreled shotgun in or affecting interstate or foreign com-3
96	96	merce, or imposes a marking, recordkeeping or registra-4
97	97	tion requirement with respect to such a shotgun, shall 5
98	98	have no force or effect.’’. 6
99	99	SEC. 6. DESTRUCTION OF RECORDS. 7
100	100	(a) I
101	101	NGENERAL.—Not later than 365 days after the 8
102	102	date of the enactment of this Act, the Attorney General 9
103	103	shall destroy any registration of an applicable shotgun 10
104	104	maintained in the National Firearms Registration and 11
105	105	Transfer Record pursuant to section 5841 of the Internal 12
106	106	Revenue Code of 1986, any application to transfer filed 13
107	107	under section 5812 of the Internal Revenue Code of 1986 14
108	108	that identifies the transferee of an applicable shotgun, and 15
109	109	any application filed under section 5822 of the Internal 16
110	110	Revenue Code of 1986 that identifies the maker of an ap-17
111	111	plicable shotgun. 18
112	112	(b) A
113	113	PPLICABLESHOTGUN.—For purposes of this 19
114	114	section, the term ‘‘applicable shotgun’’ means any shot-20
115	115	gun— 21
116	116	(1) described in paragraph (1) or (2) of section 22
117	117	5845(a) of the Internal Revenue Code of 1986 (as 23
118	118	in effect on the day before the enactment of this 24
119	119	Act), or 25
