2121 SECTION 1. SHORT TITLE. 3
2222 This Act may be cited as the ‘‘Stealthing Act of 4
2323 2025’’. 5
2424 SEC. 2. FINDINGS. 6
2525 Congress finds the following: 7

2929 (1) Stealthing is a type of sexual violence used 1
3030 to describe non-consensual condom removal during 2
3131 sex. 3
3232 (2) In October 2021, California became the 4
3333 first State to outlaw stealthing at the State level. 5
3434 This law creates a civil remedy so that victims of 6
3535 stealthing can sue for damages. 7
3636 (3) A 2019 study from Health Psychology re-8
3737 ported that almost 10 percent of male participants 9
3838 reported engaging in non-consensual condom re-10
3939 moval since the age of 14 years, with an average of 11
4040 3.62 times and a range of 1–21 times. 12
4141 (4) A 2019 study from the Jacobs Institute of 13
4242 Women’s Health found that 12 percent of women 14
4343 have experienced stealthing. 15
4444 (5) A 2018 Australian study from PLoS ONE 16
4545 found that one in three female respondents and one 17
4646 in five gay male respondents have experienced 18
4747 stealthing. 19
4848 (6) Stealthing is a grave violation of autonomy, 20
4949 dignity, and trust that is considered emotional and 21
5050 sexual abuse. 22
5151 (7) Stealthing exposes victims to physical risks 23
5252 including pregnancy and sexually transmitted dis-24
5353 eases. 25

6363 IVILACTION.—Any person may commence a 6
6464 civil action against a person who, in a circumstance de-7
6565 scribed in subsection (b), engages in non-consensual sex-8
6666 ual protection barrier removal. 9

6868 IRCUMSTANCESDESCRIBED.—For the purposes 10
6969 of subsection (a), the circumstances described in this sub-11
7070 section are that— 12
7171 (1) the defendant traveled in interstate or for-13
7272 eign commerce, or traveled using a means, channel, 14
7373 facility, or instrumentality of interstate or foreign 15
7474 commerce, in furtherance of or in connection with 16
7575 the conduct described in subsection (a); 17
7676 (2) the defendant used a means, channel, facil-18
7777 ity, or instrumentality of interstate or foreign com-19
7878 merce in furtherance of or in connection with the 20
7979 conduct described in subsection (a); 21
8080 (3) a payment of any kind was made, directly 22
8181 or indirectly, in furtherance of or in connection with 23
8282 the conduct described in subsection (a) using any 24
8383 means, channel, facility, or instrumentality of inter-25

8787 state or foreign commerce or in or affecting inter-1
8888 state or foreign commerce; 2
8989 (4) the defendant transmitted in interstate or 3
9090 foreign commerce any communication relating to or 4
9191 in furtherance of the conduct described in subsection 5
9292 (a) using any means, channel, facility, or instrumen-6
9393 tality of interstate or foreign commerce or in or af-7
9494 fecting interstate or foreign commerce by any means 8
9595 or in manner, including by computer, mail, wire, or 9
9696 electromagnetic transmission; 10
9797 (5) any sexual protection barrier described has 11
9898 traveled in interstate or foreign commerce and was 12
9999 used to perform the conduct described in subsection 13
100100 (a); 14
101101 (6) the conduct described in subsection (a) oc-15
102102 curred within the special maritime and territorial ju-16
103103 risdiction of the United States, or any territory or 17
104104 possession of the United States; or 18
105105 (7) the conduct described in subsection (a) oth-19
106106 erwise occurred in or affected interstate or foreign 20
107107 commerce. 21

109109 ENALTY.—A person bringing a civil action under 22
110110 subsection (a) may recover compensatory and punitive 23
111111 damages, injunctive and declaratory relief, and such other 24
112112 relief as a court may deem appropriate. 25

118118 ON-CONSENSUAL SEXUAL PROTECTION 2
119119 BARRIER REMOVAL.—The term ‘‘non-consensual sex-3
120120 ual protection barrier removal’’ means removal of a 4
121121 sexual protection barrier from a body part, including 5
122122 the genitals, or an object being used by a person for 6
123123 sexual contact with another person without the con-7
124124 sent of each person involved in such sexual contact, 8
125125 causing sexual contact between the body parts, in-9
126126 cluding the genitals, or objects being used for sexual 10
127127 contact, and the body of any person engaged in such 11
128128 sexual contact. 12

130130 EXUAL PROTECTION BARRIER .—The term 13
131131 ‘‘sexual protection barrier’’ includes a condom, in-14
132132 cluding an internal condom, a dental dam, or any 15
133133 other barrier against sexual fluids during sexual con-16
134134 tact. 17
