To amend title 5, United States Code, to reduce the duration 
of probationary periods under an initial appointments 
for Federal employees, and for other purposes. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Probationary Reduc-4
tion for Employee Protections Act’’ or the ‘‘PREP Act’’. 5

SEC. 2. PROBATIONARY PERIOD REDUCTION. 1
(a) C
OMPETITIVESERVICE.—Section 3321 of title 5, 2
United States Code, is amended by adding at the end the 3
following new subsection: 4
‘‘(d) A probationary period under subsection (a) may 5
not exceed— 6
‘‘(1) 6 months for an initial appointment of an 7
individual who, immediately prior to such appoint-8
ment, held a position in the civil service in the exec-9
utive branch; or 10
‘‘(2) 12 months for an initial appointment of an 11
individual other than an individual described in 12
paragraph (1).’’. 13
(b) E
XCEPTEDSERVICE.— 14
(1) I
N GENERAL.—Subchapter I of chapter 33 15
of title 5, United States Code, is amended by adding 16
at the end the following new section: 17
‘‘§ 3330g. Excepted service probationary period 18
‘‘Except as otherwise specifically provided by statute, 19
the probationary or trial period before an initial appoint-20
ment of an individual to a position in the excepted service 21
becomes final may not exceed— 22
‘‘(1) 6 months for an initial appointment of an 23
individual who, immediately prior to such appoint-24
ment, held a position in the civil service in the exec-25
utive branch; or 26

‘‘(2) 12 months for an initial appointment of an 1
individual other than an individual described in 2
paragraph (1).’’. 3
(2) C
LERICAL AMENDMENT .—The table of sec-4
tions for chapter 33 of title 5, United States Code, 5
is amended by inserting after the item relating the 6
section 3330f the following new item: 7
‘‘3330g. Excepted service probationary period.’’. 
(c) SENIOREXECUTIVESERVICE.—Section 3393(d) 8
of title 5, United States Code, is amended by striking ‘‘has 9
served’’ and all that follows and inserting the following: 10
‘‘has served— 11
‘‘(1) 6 months, if such individual held a posi-12
tion in the civil service in the executive branch im-13
mediately prior to such appointment; or 14
‘‘(2) 12 months in all other cases.’’. 15
(d) I
NTERNALREVENUESERVICE.—Section 9510 of 16
title 5, United States Code, is amended— 17
(1) by striking subsection (d); and 18
(2) by redesignating subsection (e) as sub-19
section (d). 20
