SHORT TITLE. 1 This Act may be cited as the ‘‘Bringing Real Ac-2 countability Via Enforcement in Burma Act’’ or the 3 ‘‘BRAVE Burma Act’’. 4 SEC. 2. EXTENSION OF SUNSET. 5 Section 5574 of the Burma Unified through Rigorous 6 Military Accountability Act of 2022 (subtitle E of title LV 7 of division E of the James M. Inhofe National Defense 8 Authorization Act for Fiscal Year 2023; 22 U.S.C. 10225) 9 is amended by striking ‘‘8 years’’ and inserting ‘‘10 10 years’’. 11 SEC. 3. MODIFICATIONS TO REPORTING REQUIREMENT. 12 Section 5571(e) of the James M. Inhofe National De-13 fense Authorization Act for Fiscal Year 2023 (22 U.S.C. 14 10222(e)) is amended to read as follows: 15 ‘‘(e) A SSESSMENT AND REPORT ON SANCTIONS 16 W ITHRESPECT TOBURMESEPERSONS.— 17 ‘‘(1) I N GENERAL.—Not later than 180 days 18 after the date of the enactment of this Act, and an-19 nually thereafter for 7 years, the President shall de-20 termine whether the following persons meet the cri-21 teria for sanctions described under subsection (a) or 22 under Executive Order 14014 (86 Fed. Reg. 9429; 23 relating to blocking property with respect to the sit-24 uation in Burma): 25 VerDate Sep 11 2014 01:01 May 10, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3190.IH H3190 ssavage on LAPJG3WLY3PROD with BILLS 3 •HR 3190 IH ‘‘(A) Any Burmese state-owned enterprise 1 described in subsection (c)(1). 2 ‘‘(B) Myanma Economic Bank. 3 ‘‘(C) Any foreign person that the President 4 determines operates in the jet fuel sector of the 5 Burmese economy, including through activities 6 such as the provision of financial services or the 7 importation, exportation, reexportation, sale, 8 supply, trade, storage, or transport, directly or 9 indirectly, of jet fuel in Burma. 10 ‘‘(2) R EPORT REQUIRED .—Upon making the 11 determination required by paragraph (1), the Presi-12 dent shall submit to the appropriate congressional 13 committees a report on the assessment. 14 ‘‘(3) F ORM OF REPORT.—The report required 15 by paragraph (2) shall be submitted in unclassified 16 form but may include a classified annex.’’. 17 SEC. 4. LIMITATION OF SHAREHOLDING BENEFITTING THE 18 STATE ADMINISTRATION COUNCIL OF 19 BURMA. 20 (a) I NGENERAL.—The Secretary of the Treasury 21 shall instruct the United States Executive Director at the 22 International Monetary Fund to use the voice and vote 23 of the United States, when assessing potential changes to 24 any shareholding formula in connection with a governance 25 VerDate Sep 11 2014 01:01 May 10, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3190.IH H3190 ssavage on LAPJG3WLY3PROD with BILLS 4 •HR 3190 IH review of the Fund, to limit, as appropriate, an increase 1 to the shareholding of Burma if the country is subject to 2 the rule of the State Administration Council. 3 (b) W AIVER.—The President of the United States 4 may waive the application of subsection (a) upon certifying 5 to the Committee on Financial Services of the House of 6 Representatives and the Committee on Foreign Relations 7 of the Senate that the waiver is important to the national 8 interest of the United States, with a detailed explanation 9 of the reasons therefor. 10 SEC. 5. UNITED STATES SPECIAL ENVOY FOR BURMA. 11 (a) I NGENERAL.—The President shall appoint, by 12 and with the advice and consent of the Senate, a Special 13 Envoy for Burma, who shall have the rank and status of 14 ambassador and who shall be responsible for coordinating 15 all aspects of United States policy with respect to Burma. 16 (b) C ENTRALOBJECTIVE.—The Special Envoy 17 should develop a comprehensive strategy for the implemen-18 tation of the full range of United States diplomatic capa-19 bilities to promote the restoration of peace and a civilian- 20 led democratic government in Burma. 21 (c) D UTIES ANDRESPONSIBILITIES.—The Special 22 Envoy shall also— 23 (1) coordinate the sanctions policies of the 24 United States under the Burma Unified through 25 VerDate Sep 11 2014 01:01 May 10, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H3190.IH H3190 ssavage on LAPJG3WLY3PROD with BILLS 5 •HR 3190 IH Rigorous Military Accountability Act of 2022 (22 1 U.S.C. 10201 et seq.) and other relevant statutory 2 authorities across relevant Federal departments and 3 agencies; 4 (2) develop and implement a comprehensive 5 international effort to impose and enforce multilat-6 eral sanctions with respect to Burma; 7 (3) lead interagency United States Government 8 efforts, including efforts of the Chief of Mission in 9 Burma, the Ambassador to ASEAN, the Ambas-10 sador to Bangladesh, the Ambassador to India, and 11 the United States Permanent Representative to the 12 United Nations, relating to— 13 (A) identifying opportunities to coordinate 14 with and exert pressure on the governments of 15 the People’s Republic of China and the Russian 16 Federation to cease or curtail support for the 17 Burmese military; 18 (B) working with like-minded partners to 19 impose a coordinated arms embargo on the 20 Burmese military and targeted sanctions on the 21 economic interests of the Burmese military, in-22 cluding through the introduction and adoption 23 of a United Nations Security Council resolu-24 tion; 25 VerDate Sep 11 2014 01:01 May 10, 2025 Jkt 059200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H3190.IH H3190 ssavage on LAPJG3WLY3PROD with BILLS 6 •HR 3190 IH (C) engaging Burmese civil society, democ-1 racy advocates, ethnic nationality representative 2 groups, and organizations or groups rep-3 resenting the resistance and revolutionary 4 movement, as well as officials elected in 2020 5 such as the Committee Representing the 6 Pyidaungsu Hluttaw, the National Unity Gov-7 ernment, the National Unity Consultative 8 Council, the Ethnic Resistance Revolutionary 9 Organizations, and their designated representa-10 tives; 11 (D) encouraging the United Nations Inde-12 pendent Investigative Mechanism for Myanmar 13 to incorporate accountability mechanisms in re-14 lation to the atrocities against Rohingya and 15 other ethnic groups, to take further steps to 16 make its leadership and membership ethnically 17 diverse, and to incorporate measures to enhance 18 ethnic reconciliation and national unity into its 19 policy agenda; 20 (E) assisting efforts by the relevant United 21 Nations Special Procedures to secure the re-22 lease of all political prisoners in Burma, pro-23 mote respect for human rights, seek account-24 ability, and encourage dialogue; 25 VerDate Sep 11 2014 01:01 May 10, 2025 Jkt 059200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H3190.IH H3190 ssavage on LAPJG3WLY3PROD with BILLS 7 •HR 3190 IH (F) working with the governments of 1 India, Bangladesh, and other countries as ap-2 propriate to address challenges in Western 3 Burma, including issues related to atrocity 4 crimes, refugees and displaced persons, cross- 5 border humanitarian assistance and trade, traf-6 ficking in persons, illicit trafficking of narcotics 7 and weapons, or other transnational threats to 8 regional peace and security; and 9 (G) supporting nongovernmental organiza-10 tions operating in Burma and neighboring 11 countries working to restore civilian democratic 12 rule to Burma, address the urgent humani-13 tarian needs of the people of Burma, and build 14 resilience against malign foreign influence in 15 support of the military regime; 16 (4) coordinate all streams of United States as-17 sistance to the people of Burma until such time as 18 the United States normalizes diplomatic relations 19 with Burma; 20 (5) provide timely input for reporting on the 21 impacts of the implementation of the Burma Unified 22 through Rigorous Military Accountability Act of 23 2022 on the Burmese military and the people of 24 Burma; and 25 VerDate Sep 11 2014 01:01 May 10, 2025 Jkt 059200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H3190.IH H3190 ssavage on LAPJG3WLY3PROD with BILLS 8 •HR 3190 IH (6) report to and coordinate with Congress. 1 Æ VerDate Sep 11 2014 01:01 May 10, 2025 Jkt 059200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6301 E:\BILLS\H3190.IH H3190 ssavage on LAPJG3WLY3PROD with BILLS
