24	24	To amend title X of the Public Health Service Act to prohibit
25	25	family planning grants from being awarded to any entity
26	26	that performs abortions, and for other purposes.
27	27	Be it enacted by the Senate and House of Representa-1
28	28	tives of the United States of America in Congress assembled, 2
29	29	SECTION 1. SHORT TITLE. 3
30	30	This Act may be cited as the ‘‘Title X Abortion Pro-4
31	31	vider Prohibition Act’’. 5

36	36	Title X of the Public Health Service Act (42 U.S.C. 2
37	37	300 et seq.) is amended by adding at the end the fol-3
38	38	lowing: 4
39	39	‘‘SEC. 1009. ADDITIONAL PROHIBITION REGARDING ABOR-5
40	40	TION. 6
41	41	‘‘(a) P
42	42	ROHIBITION.—The Secretary shall not provide 7
43	43	any assistance under this title to an entity unless the enti-8
44	44	ty certifies that, during the period of such assistance, the 9
45	45	entity will not perform, and will not provide any funds 10
46	46	to any other entity that performs, an abortion. 11
47	47	‘‘(b) E
48	48	XCEPTION.—Subsection (a) does not apply 12
49	49	with respect to an abortion where— 13
50	50	‘‘(1) the pregnancy is the result of rape or in-14
51	51	cest; or 15
52	52	‘‘(2) a physician certifies that the woman suf-16
53	53	fers from a physical disorder, physical injury, or 17
54	54	physical illness that would place the woman in dan-18
55	55	ger of death unless an abortion is performed, includ-19
56	56	ing a life-threatening physical condition caused by or 20
57	57	arising from the pregnancy itself. 21
58	58	‘‘(c) H
59	59	OSPITALS.—Subsection (a) does not apply with 22
60	60	respect to a hospital, so long as such hospital does not, 23
61	61	during the period of assistance described in subsection (a), 24
62	62	provide funds to any non-hospital entity that performs an 25

66	66	abortion (other than an abortion described in subsection 1
67	67	(b)). 2
68	68	‘‘(d) A
69	69	NNUALREPORT.—Not later than 60 days after 3
70	70	the date of the enactment of the Title X Abortion Provider 4
71	71	Prohibition Act, and annually thereafter, for the fiscal 5
72	72	year involved, the Secretary shall submit a report to the 6
73	73	Congress containing— 7
74	74	‘‘(1) a list of each entity receiving a grant 8
75	75	under this title; 9
76	76	‘‘(2) for each such entity performing abortions 10
77	77	under the exceptions described in subsection (b)— 11
78	78	‘‘(A) the total number of such abortions; 12
79	79	‘‘(B) the number of such abortions where 13
80	80	the pregnancy is the result of rape; 14
81	81	‘‘(C) the number of such abortions where 15
82	82	the pregnancy is the result of incest; and 16
83	83	‘‘(D) the number of such abortions where 17
84	84	a physician provides a certification described in 18
85	85	subsection (b)(2); 19
86	86	‘‘(3) a statement of the date of the latest cer-20
87	87	tification under subsection (a) for each entity receiv-21
88	88	ing a grant under this title; and 22
89	89	‘‘(4) a list of each entity to which an entity de-23
90	90	scribed in paragraph (1) makes available funds re-24
91	91	ceived through a grant under this title. 25

95	95	‘‘(e) DEFINITIONS.—In this section: 1
96	96	‘‘(1) The term ‘entity’ means the entire legal 2
97	97	entity, including any entity that controls, is con-3
98	98	trolled by, or is under common control with such en-4
99	99	tity. 5
100	100	‘‘(2) The term ‘hospital’ has the meaning given 6
101	101	to such term in section 1861(e) of the Social Secu-7
102	102	rity Act.’’. 8
