1818 SECTION 1. SHORT TITLE. 3
1919 This Act may be cited as the ‘‘Preserving Choice in 4
2020 Vehicle Purchases Act’’. 5
2121 SEC. 2. STATE STANDARDS. 6

2323 MENDMENTS.—Section 209(b) of the Clean Air 7
2424 Act (42 U.S.C. 7543(b)) is amended— 8
2525 (1) in paragraph (1)— 9

2929 (A) in subparagraph (B), by striking the 1
3030 ‘‘or’’ at the end; 2
3131 (B) in subparagraph (C), by striking 3
3232 ‘‘part.’’ and inserting ‘‘part, or’’; and 4
3333 (C) by adding at the end the following: 5
3434 ‘‘(D) such State standards directly or indirectly 6
3535 limit the sale or use of new motor vehicles with in-7
3636 ternal combustion engines, as such term is defined 8
3737 in section 63.9375 of title 40, Code of Federal Reg-9
3838 ulations, as in effect on January 1, 2023.’’; and 10
3939 (2) by adding at the end the following: 11
4040 ‘‘(4) The Administrator may not determine that any 12
4141 State standards amended after the date of enactment of 13
4242 this paragraph are within the scope of a waiver granted 14
4343 under paragraph (1) before the date of enactment of this 15
4444 paragraph.’’. 16

4646 FFECT ONCERTAINEXISTINGWAIVERS.—The 17
4747 Administrator of the Environmental Protection Agency 18
4848 shall revoke a waiver granted under section 209(b) of the 19
4949 Clean Air Act (42 U.S.C. 7543(b)) during the period that 20
5050 begins on January 1, 2022, and ends on the date of enact-21
5151 ment of this Act if the Administrator finds that such waiv-22
5252 er does not comply with subparagraph (D) of section 23
