17-NGENERAL.—Chapter 2 of title 18, United 6
18-States Code, is amended by adding at the end the fol-7
19-lowing: 8
20-‘‘§ 40B. Evading arrest or detention while operating a 9
21-motor vehicle 10

39+‘‘§ 40B. Evading arrest or detention while operating a 6
40+motor vehicle 7
2241 ‘‘(a) O
23-FFENSE.—A person commits an offense under 11
24-this section by operating a motor vehicle within 100 miles 12
25-of the United States border while intentionally fleeing 13
26-from— 14
27-‘‘(1) a pursuing U.S. Border Patrol agent act-15
28-ing pursuant to lawful authority; or 16
29-‘‘(2) any pursuing Federal, State, or local law 17
30-enforcement officer who is actively assisting, or 18
31-under the command of, U.S. Border Patrol. 19
42+FFENSE.—A person commits an offense under 8
43+this section by operating a motor vehicle within 100 miles 9
44+of the United States border while intentionally fleeing 10
45+from— 11
46+‘‘(1) a pursuing U.S. Border Patrol agent act-12
47+ing pursuant to lawful authority; or 13
48+‘‘(2) any pursuing Federal, State, or local law 14
49+enforcement officer who is actively assisting, or 15
50+under the command of, U.S. Border Patrol. 16

35-N GENERAL.—Except as provided in para-21
36-graphs (2) and (3), any person who commits an of-22
37-fense described in subsection (a) shall be— 23
38-‘‘(A) imprisoned for a term of not more 24
39-than 2 years; 25
40-‘‘(B) fined under this title; or 26 3

45-ERIOUS BODILY INJURY.—If serious bod-3
46-ily injury results from the commission of an offense 4
47-described in subsection (a), the person committing 5
48-such offense shall be— 6
49-‘‘(A) imprisoned for a term of not less 7
50-than 5 years and not more than 20 years; 8
51-‘‘(B) fined under this title; or 9
52-‘‘(C) subject to the penalties described in 10
53-subparagraphs (A) and (B). 11
54+N GENERAL.—Except as provided in para-18
55+graphs (2) and (3), any person who commits an of-19
56+fense described in subsection (a) shall be— 20
57+‘‘(A) imprisoned for a term of not more 21
58+than 2 years; 22

66+ily injury results from the commission of an offense 2
67+described in subsection (a), the person committing 3
68+such offense shall be— 4
69+‘‘(A) imprisoned for a term of not less 5
70+than 5 years and not more than 20 years; 6
71+‘‘(B) fined under this title; or 7
72+‘‘(C) subject to the penalties described in 8
73+subparagraphs (A) and (B). 9

57-subsection (a), the person committing such offense 14
58-shall be— 15
59-‘‘(A) imprisoned for a term of not less 16

62-‘‘(C) subject to the penalties described in 19

100124 II of the Immigration and Nationality Act is amended by 2
101125 inserting after section 208 the following: 3
102126 ‘‘SEC. 208A. INELIGIBILITY FOR RELIEF RELATED TO EVAD-4
103127 ING ARREST OR DETENTION WHILE OPER-5
104128 ATING A MOTOR VEHICLE. 6
105129 ‘‘Any alien who has been convicted of, who admits 7
106130 having committed, or who admits committing acts which 8
107131 constitute the essential elements of a violation of section 9
108132 40B(a) of title 18, United States Code, shall be ineligible 10
109133 for relief under the immigration laws, including asylum 11
110134 under section 208.’’. 12
111135 SEC. 4. ANNUAL REPORT. 13
112136 The Attorney General, in conjunction with the Sec-14
113137 retary of Homeland Security, shall submit an annual re-15
114138 port to the Committee on the Judiciary of the Senate and 16
115139 the Committee on the Judiciary of the House of Rep-17
116140 resentatives that— 18
117141 (1) identifies the number of people who com-19
118142 mitted a violation of section 40B(a) of title 18, 20
119143 United States Code, as added by section 2(a); and 21
120144 (2) summarizes— 22
121145 (A) the number of individuals who were 23
122146 charged with the violation referred to in para-24
123-graph (1); 25 6
