1919 SECTION 1. SHORT TITLE. 3
2020 This Act may be cited as the ‘‘Advanced Capabilities 4
2121 for Emergency Response Operations Act’’ or the ‘‘ACERO 5
2222 Act’’. 6

2626 SEC. 2. ADVANCED CAPABILITIES FOR EMERGENCY RE-1
2727 SPONSE OPERATIONS. 2
2828 (a) I
2929 NGENERAL.—The Administrator shall leverage 3
3030 NASA-developed tools and technologies to conduct re-4
3131 search and development activities under the Advanced Ca-5
3232 pabilities for Emergency Response Operations (ACERO) 6
3333 project to improve aerial responses to wildfires. 7
3434 (b) G
3535 OALS.—The research and development activities 8
3636 conducted under subsection (a) shall, to the extent prac-9
3737 ticable, address the following: 10
3838 (1) Advanced aircraft technologies and airspace 11
3939 management efforts to assist in the management, 12
4040 deconfliction, and coordination of aerial assets dur-13
4141 ing wildfire response efforts. 14
4242 (2) Information sharing and real-time data ex-15
4343 change for wildfire response teams. 16
4444 (3) Development of an interoperable platform to 17
4545 provide situational awareness of aerial assets during 18
4646 wildfire response. 19
4747 (4) Establishment of a multi-agency concept of 20
4848 operations, which may involve Federal, State, and 21
4949 local government agencies, to enable coordination of 22
5050 aerial activities for wildfire response. 23

5252 OLLABORATION.—In carrying out this section, 24
5353 the Administrator— 25

5757 (1) may coordinate and collaborate with other 1
5858 Federal, State, and local government agencies, re-2
5959 gional organizations, and commercial partners and 3
6060 academic institutions involved in wildfire manage-4
6161 ment; and 5
6262 (2) shall, to the maximum extent practicable, 6
6363 consult with the heads of other Federal departments 7
6464 and agencies to avoid duplication of activities. 8

6666 ROHIBITION.— 9
6767 (1) I
6868 N GENERAL.—Except as provided in this 10
6969 subsection, the Administrator may not procure an 11
7070 unmanned aircraft system to conduct activities de-12
7171 scribed in this section if such unmanned aircraft sys-13
7272 tem is manufactured or assembled by a covered for-14
7373 eign entity. 15
7474 (2) E
7575 XEMPTION.—The Administrator may 16
7676 waive the prohibition under paragraph (1) on a case- 17
7777 by-case basis if the Administrator— 18
7878 (A) determines that the procurement of an 19
7979 unmanned aircraft system is— 20
8080 (i) in the national interest of the 21
8181 United States; and 22
8282 (ii) necessary for the sole purpose of 23
8383 improving aerial responses to wildfires; and 24

8888 Space, and Technology of the House of Rep-2
8989 resentatives and the Committee on Commerce, 3
9090 Science, and Transportation of the Senate not 4
9191 later than 30 days after a determination in the 5
9292 affirmative under subparagraph (A). 6
9393 (e) A
9494 NNUALREPORTS.—Not later than one year 7
9595 after the date of the enactment of this Act and annually 8
9696 thereafter until December 31, 2030, the Administrator 9
9797 shall submit to the Committee on Science, Space and 10
9898 Technology of the House of Representatives and the Com-11
9999 mittee on Commerce, Science, and Transportation of the 12
100100 Senate a report describing the activities, including results, 13
101101 carried out pursuant to this section. Each such report, at 14
102102 minimum, shall contain the following: 15
103103 (1) A description of any research and develop-16
104104 ment activities. 17
105105 (2) A description of the Administrator’s activi-18
106106 ties pursuant to subsection (c). 19
107107 (3) An assessment of the effectiveness of such 20
108108 activities in preventing injuries and loss of life, pro-21
109109 tecting property, and reducing economic damage. 22
110110 (4) An identification of any topics related to 23
111111 improvement of aerial responses to wildfires that 24
112112 could benefit from further research. 25

121121 UTHORIZATION OF APPROPRIATIONS.—There is 5
122122 authorized to be appropriated $15,000,000 for fiscal year 6
123123 2026 to carry out this section. 7

127127 DMINISTRATOR.—The term ‘‘Adminis-9
128128 trator’’ means the Administrator of the National 10
129129 Aeronautics and Space Administration. 11

131131 OVERED FOREIGN ENTITY .—The term 12
132132 ‘‘covered foreign entity’’ has the meaning given such 13
133133 term in section 1822 of the National Defense Au-14
134134 thorization Act for Fiscal Year 2024 (Public Law 15
135135 118–31). 16
136136 (3) NASA.—The term ‘‘NASA’’ means the Na-17
137137 tional Aeronautics and Space Administration. 18

139139 NMANNED AIRCRAFT SYSTEM .—The term 19
140140 ‘‘unmanned aircraft system’’ has the meaning given 20
141141 such term in section 44801 of title 49, United 21
142142 States Code. 22
