16	16	responses to wildfires, and for other purposes.
17	17	Be it enacted by the Senate and House of Representa-1
18	18	tives of the United States of America in Congress assembled, 2
19	19	SECTION 1. SHORT TITLE. 3
20	20	This Act may be cited as the ‘‘Advanced Capabilities 4
21	21	for Emergency Response Operations Act’’ or the ‘‘ACERO 5
22	22	Act’’. 6

26	26	SEC. 2. ADVANCED CAPABILITIES FOR EMERGENCY RE-1
27	27	SPONSE OPERATIONS. 2
28	28	(a) I
29	29	NGENERAL.—The Administrator shall leverage 3
30	30	NASA-developed tools and technologies to conduct re-4
31	31	search and development activities under the Advanced Ca-5
32	32	pabilities for Emergency Response Operations (ACERO) 6
33	33	project to improve aerial responses to wildfires. 7
34	34	(b) G
35	35	OALS.—The research and development activities 8
36	36	conducted under subsection (a) shall, to the extent prac-9
37	37	ticable, address the following: 10
38	38	(1) Advanced aircraft technologies and airspace 11
39	39	management efforts to assist in the management, 12
40	40	deconfliction, and coordination of aerial assets dur-13
41	41	ing wildfire response efforts. 14
42	42	(2) Information sharing and real-time data ex-15
43	43	change for wildfire response teams. 16
44	44	(3) Development of an interoperable platform to 17
45	45	provide situational awareness of aerial assets during 18
46	46	wildfire response. 19
47	47	(4) Establishment of a multi-agency concept of 20
48	48	operations, which may involve Federal, State, and 21
49	49	local government agencies, to enable coordination of 22
50	50	aerial activities for wildfire response. 23

52	52	OLLABORATION.—In carrying out this section, 24
53	53	the Administrator— 25

57	57	(1) may coordinate and collaborate with other 1
58	58	Federal, State, and local government agencies, re-2
59	59	gional organizations, and commercial partners and 3
60	60	academic institutions involved in wildfire manage-4
61	61	ment; and 5
62	62	(2) shall, to the maximum extent practicable, 6
63	63	consult with the heads of other Federal departments 7
64	64	and agencies to avoid duplication of activities. 8

66	66	ROHIBITION.— 9
67	67	(1) I
68	68	N GENERAL.—Except as provided in this 10
69	69	subsection, the Administrator may not procure an 11
70	70	unmanned aircraft system to conduct activities de-12
71	71	scribed in this section if such unmanned aircraft sys-13
72	72	tem is manufactured or assembled by a covered for-14
73	73	eign entity. 15
74	74	(2) E
75	75	XEMPTION.—The Administrator may 16
76	76	waive the prohibition under paragraph (1) on a case- 17
77	77	by-case basis if the Administrator— 18
78	78	(A) determines that the procurement of an 19
79	79	unmanned aircraft system is— 20
80	80	(i) in the national interest of the 21
81	81	United States; and 22
82	82	(ii) necessary for the sole purpose of 23
83	83	improving aerial responses to wildfires; and 24

87	87	(B) notifies the Committee on Science, 1
88	88	Space, and Technology of the House of Rep-2
89	89	resentatives and the Committee on Commerce, 3
90	90	Science, and Transportation of the Senate not 4
91	91	later than 30 days after a determination in the 5
92	92	affirmative under subparagraph (A). 6
93	93	(e) A
94	94	NNUALREPORTS.—Not later than one year 7
95	95	after the date of the enactment of this Act and annually 8
96	96	thereafter until December 31, 2030, the Administrator 9
97	97	shall submit to the Committee on Science, Space and 10
98	98	Technology of the House of Representatives and the Com-11
99	99	mittee on Commerce, Science, and Transportation of the 12
100	100	Senate a report describing the activities, including results, 13
101	101	carried out pursuant to this section. Each such report, at 14
102	102	minimum, shall contain the following: 15
103	103	(1) A description of any research and develop-16
104	104	ment activities. 17
105	105	(2) A description of the Administrator’s activi-18
106	106	ties pursuant to subsection (c). 19
107	107	(3) An assessment of the effectiveness of such 20
108	108	activities in preventing injuries and loss of life, pro-21
109	109	tecting property, and reducing economic damage. 22
110	110	(4) An identification of any topics related to 23
111	111	improvement of aerial responses to wildfires that 24
112	112	could benefit from further research. 25

121	121	UTHORIZATION OF APPROPRIATIONS.—There is 5
122	122	authorized to be appropriated $15,000,000 for fiscal year 6
123	123	2026 to carry out this section. 7

127	127	DMINISTRATOR.—The term ‘‘Adminis-9
128	128	trator’’ means the Administrator of the National 10
129	129	Aeronautics and Space Administration. 11

131	131	OVERED FOREIGN ENTITY .—The term 12
132	132	‘‘covered foreign entity’’ has the meaning given such 13
133	133	term in section 1822 of the National Defense Au-14
134	134	thorization Act for Fiscal Year 2024 (Public Law 15
135	135	118–31). 16
136	136	(3) NASA.—The term ‘‘NASA’’ means the Na-17
137	137	tional Aeronautics and Space Administration. 18

139	139	NMANNED AIRCRAFT SYSTEM .—The term 19
140	140	‘‘unmanned aircraft system’’ has the meaning given 20
141	141	such term in section 44801 of title 49, United 21
142	142	States Code. 22
