1717 SECTION 1. SHORT TITLE. 3
1818 This Act may be cited as the ‘‘Geothermal Cost-Re-4
1919 covery Authority Act of 2025’’. 5
2020 SEC. 2. COST RECOVERY FROM GEOTHERMAL LEASING, 6
2121 PERMITTING, AND INSPECTIONS. 7
2222 Section 6 of the Geothermal Steam Act of 1970 (30 8
2323 U.S.C. 1005) is amended by adding at the end the fol-9

3030 N GENERAL.—During the period that be-2
3131 gins on the date of enactment of this subsection and 3
3232 ends September 30, 2032, the Secretary may require 4
3333 an applicant for, or a holder of, a geothermal lease 5
3434 to reimburse the United States for all reasonable ad-6
3535 ministrative and other costs incurred by the United 7
3636 States from— 8
3737 ‘‘(A) processing the application for the 9
3838 geothermal lease, including any application for 10
3939 an operations plan, geothermal drilling permit, 11
4040 utilization plan, site license, facility construc-12
4141 tion permit, commercial use permit, and any 13
4242 other approval associated with a geothermal 14
4343 lease; and 15
4444 ‘‘(B) inspecting and monitoring— 16
4545 ‘‘(i) geophysical exploration activities; 17
4646 ‘‘(ii) the drilling, plugging, and aban-18
4747 donment of wells; and 19
4848 ‘‘(iii) the construction, operation, ter-20
4949 mination, and reclamation of any well site 21
5050 or facility for the utilization of geothermal 22
5151 resources pursuant to the geothermal 23
5252 lease. 24

5656 ‘‘(2) CONSIDERATIONS.—In determining wheth-1
5757 er to require reimbursement under paragraph (1), 2
5858 the Secretary shall consider whether there is in ex-3
5959 istence a cooperative cost share agreement between 4
6060 the United States and the holder of a geothermal 5
6161 lease. 6
6262 ‘‘(3) A
6363 DJUSTMENTS.—The Secretary may re-7
6464 duce the amount to be reimbursed under paragraph 8
6565 (1) if the Secretary determines— 9
6666 ‘‘(A) that full reimbursement would impose 10
6767 an economic hardship on the applicant; or 11
6868 ‘‘(B) that a less than full reimbursement is 12
6969 necessary to promote the greatest use of geo-13
7070 thermal resources. 14
7171 ‘‘(4) U
7272 SE.—The amounts reimbursed under this 15
7373 subsection shall be credited to the currently applica-16
7474 ble appropriation, account, or fund of the Depart-17
7575 ment of the Interior as discretionary offsetting col-18
7676 lections, and shall be available only to the extent 19
7777 provided in advance in appropriations Acts for— 20
7878 ‘‘(A) processing the application for geo-21
7979 thermal leases, including any application for op-22
8080 erations plans, geothermal drilling permits, uti-23
8181 lization plans, site licenses, facility construction 24

8585 permits, commercial use permits, and any other 1
8686 approval associated with geothermal leases; and 2
8787 ‘‘(B) inspecting and monitoring— 3
8888 ‘‘(i) geophysical exploration activities; 4
8989 ‘‘(ii) the drilling, plugging, and aban-5
9090 donment of wells; and 6
9191 ‘‘(iii) the construction, operation, ter-7
9292 mination, and reclamation of any well site 8
9393 or facility for the utilization of geothermal 9
9494 resources pursuant to geothermal leases.’’. 10
9595 SEC. 3. REPORT. 11
9696 (a) R
9797 EPORT.—Not later than 5 years after the date 12
9898 of enactment of this Act, the Secretary of the Interior, 13
9999 in consultation with the geothermal industry and other 14
100100 stakeholders, shall submit to the Committee on Natural 15
101101 Resources of the House of Representatives and the Com-16
102102 mittee on Energy and Natural Resources of the Senate, 17
103103 and make publicly available on the website of the Depart-18
104104 ment of the Interior, a report that includes— 19
105105 (1) an assessment of how the amendments 20
106106 made by section 2 of this Act affected the Bureau 21
107107 of Land Management’s geothermal program; 22
108108 (2) any recommendations for reauthorization of 23
109109 section 6(j) of the Geothermal Steam Act of 1970, 24
110110 as added by this Act; and 25

118118 ONSIDERATIONS.—In developing the report re-4
119119 quired in subsection (a), the Secretary of the Interior shall 5
120120 solicit facts or information from the geothermal industry 6
121121 and other stakeholders. 7
