A BILL
To authorize the Bay Mills Indian Community of the State
of Michigan to convey land and interests in land owned
by the Tribe.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. LAND AND INTERESTS OF THE BAY MILLS IN-3
DIAN COMMUNITY OF MICHIGAN. 4
(a) I
NGENERAL.—Subject to subsections (b) and (c), 5
notwithstanding any other provision of law (including reg-6
ulations), the Bay Mills Indian Community of Michigan 7
(including any agent or instrumentality of the Tribe) (re-8
ferred to in this section as the ‘‘Tribe’’), may transfer, 9
lease, encumber, or otherwise convey, without further au-10

thorization or approval, all or any part of the Tribe’s in-1
terest in any real property that is not held in trust by 2
the United States for the benefit of the Tribe. 3
(b) E
FFECT OFSECTION.—Nothing in this section 4
is intended to authorize the Tribe to transfer, lease, en-5
cumber, or otherwise convey, any lands, or any interest 6
in any lands, that are held in trust by the United States 7
for the benefit of the Tribe. 8
(c) L
IABILITY.—The United States shall not be held 9
liable to any party (including the Tribe or any agent or 10
instrumentality of the Tribe) for any term of, or any loss 11
resulting from the term of any transfer, lease, encum-12
brance, or conveyance of land made pursuant to this Act 13
unless the United States or an agent or instrumentality 14
of the United States is a party to the transaction or the 15
United States would be liable pursuant to any other provi-16
sion of law. This subsection shall not apply to land trans-17
ferred or conveyed by the Tribe to the United States to 18
be held in trust for the benefit of the Tribe. 19
