3030 NGENERAL.—Section 212(a)(3)(A) of the Im-3
3131 migration and Nationality Act (8 U.S.C. 1182(a)(3)(A)) 4
3232 is amended to read as follows: 5
3333 ‘‘(A) I
3434 N GENERAL.—Any alien is inadmis-6
3535 sible if a consular officer, an immigration offi-7
3636 cer, the Secretary of Homeland Security, or the 8
3737 Attorney General knows, or has reasonable 9
3838 ground to believe, that the alien— 10
3939 ‘‘(i) engages, has engaged, or will en-11
4040 gage in any activity— 12
4141 ‘‘(I) in violation of any law of the 13
4242 United States relating to espionage or 14
4343 sabotage; or 15
4444 ‘‘(II) that would violate any law 16
4545 of the United States relating to espio-17
4646 nage or sabotage if the activity oc-18
4747 curred in the United States; 19
4848 ‘‘(ii) engages, has engaged, or will en-20
4949 gage in any activity in violation or evasion 21
5050 of any law prohibiting the export from the 22
5151 United States of goods, technology, or sen-23
5252 sitive information; 24

5656 ‘‘(iii) seeks to enter the United States 1
5757 to engage solely, principally, or incidentally 2
5858 in any other unlawful activity; 3
5959 ‘‘(iv) seeks to enter the United States 4
6060 to engage solely, principally, or incidentally 5
6161 in any activity a purpose of which is the 6
6262 opposition to, or the control or overthrow 7
6363 of, the Government of the United States by 8
6464 force, violence, or other unlawful means; or 9
6565 ‘‘(v) is the spouse or child of an alien 10
6666 who is inadmissible under this subpara-11
6767 graph, if the activity causing the alien to 12
6868 be found inadmissible occurred within the 13
6969 last 5 years.’’. 14

7171 AIVERAUTHORITY.—Section 212(d)(3)(A) of 15

7373 1182(d)(3)(A)) is amended by striking ‘‘(other than para-17
7474 graphs (3)(A)(i)(I), (3)(A)(ii), (3)(A)(iii), (3)(C), and 18
7575 clauses (i) and (ii) of paragraph (3)(E) of such sub-19
7676 section)’’ each place such phrase appears and inserting 20
7777 ‘‘(other than subparagraphs (A)(i)(I), (A)(ii), (A)(iii), 21
7878 (A)(iv), (C), (E)(i), and (E)(ii) of paragraph (3) of such 22
