2929 (a) I
3030 NGENERAL.—The Commissioner of U.S. Cus-5
3131 toms and Border Protection shall, in coordination with the 6
3232 Under Secretary for Management, Chief Human Capital 7
3333 Officer, and Chief Financial Officer of the Department of 8
3434 Homeland Security, develop and implement, by not later 9
3535 than one year after the date of the enactment of this Act, 10
3636 a workload staffing model for each of the following: 11
3737 (1) The U.S. Border Patrol. 12
3838 (2) Air and Marine Operations. 13

4040 ESPONSIBILITIES OF THE COMMISSIONER OF 14
4141 CBP.—Subsection (c) of section 411 of the Homeland Se-15
4242 curity Act of 2002 (6 U.S.C. 211) is amended— 16
4343 (1) by redesignating paragraphs (18) and (19) 17
4444 as paragraphs (20) and (21), respectively; and 18
4545 (2) by inserting after paragraph (17) the fol-19
4646 lowing new paragraphs: 20
4747 ‘‘(18) implement a staffing model that includes 21
4848 consideration for essential frontline operator activi-22
4949 ties and functions, variations in operating environ-23
5050 ments, present and planned infrastructure, present 24
5151 and planned technology, and required operations 25
5252 support levels for the U.S. Border Patrol, Air and 26

5757 ations, to manage and assign personnel of such enti-2
5858 ties to ensure field and support posts possess ade-3
5959 quate resources to carry out duties specified in this 4

6161 ‘‘(19) develop standard operating procedures 6
6262 for a workforce tracking system within the U.S. 7
6363 Border Patrol, Air and Marine Operations, and the 8
6464 Office of Field Operations, train the workforce of 9
6565 each of such entities on the use, capabilities, and 10
6666 purpose of such system, and implement internal con-11
6767 trols to ensure timely and accurate scheduling and 12
6868 reporting of actual completed work hours and activi-13
6969 ties;’’. 14

7171 EPORT.—Not later than one year after the date 15
7272 of the enactment of this Act with respect to subsection 16
7373 (a) and paragraphs (18) and (19) of section 411(c) of the 17
7474 Homeland Security Act of 2002 (as amended by sub-18
7575 section (b)), and annually thereafter with respect to such 19
7676 paragraphs (18) and (19), the Secretary of Homeland Se-20
7777 curity shall submit to the Committee on Homeland Secu-21
7878 rity of the House of Representatives and the Committee 22
7979 on Homeland Security and Governmental Affairs of the 23
8080 Senate a status update on the implementation of this Act 24
8181 and such paragraphs (18) and (19), and annual status 25

8686 as all relevant workload staffing models. Such status up-2
8787 dates shall include information on data sources and meth-3
8888 odology used to generate such staffing models. 4

9090 NSPECTORGENERALREVIEW.—Not later than 5
9191 120 days after the Commissioner of U.S. Customs and 6
9292 Border Protection develops a workload staffing model pur-7
9393 suant to subsection (a), the Inspector General of the De-8
9494 partment of Homeland Security shall review such model 9
9595 and provide feedback to the Secretary of Homeland Secu-10
9696 rity and the Committee on Homeland Security of the 11
9797 House of Representatives and the Committee on Home-12
9898 land Security and Governmental Affairs of the Senate re-13
9999 garding the degree to which such model is responsive to 14
100100 Inspector General recommendations, including rec-15
101101 ommendations from the Inspector General’s February 16
102102 2019 audit, and as appropriate, any further recommenda-17
103103 tions to improve such model. 18
