2626 This Act may be cited as ‘‘Mel’s Law’’. 4

3030 SEC. 2. REQUIREMENT TO AWARD POSTHUMOUS DEGREES. 1

3232 OSTHUMOUSDEGREES.—Section 487(a) of the 2
3333 Higher Education Act of 1965 (20 U.S.C. 1094(a)) is 3
3434 amended by adding at the end the following: 4
3535 ‘‘(30) The institution certifies that the institu-5
3636 tion has established a policy to award posthumous 6
3737 degrees to deceased students who— 7
3838 ‘‘(A) had been enrolled in a degree pro-8
3939 gram at the institution; 9
4040 ‘‘(B) died prior to completing such pro-10
4141 gram; and 11
4242 ‘‘(C) at the time of death, were in aca-12
4343 demic standing consistent with the require-13
4444 ments for graduation from such program, as 14
4545 determined by the institution.’’. 15

4747 CCREDITATIONCRITERIA.—Section 496(a) of 16
4848 the Higher Education Act of 1965 (20 U.S.C. 1099b(a)) 17
4949 is amended— 18
5050 (1) by redesignating paragraphs (6) through 19
5151 (8) as paragraphs (7) through (9), respectively; and 20
5252 (2) by inserting after paragraph (5) the fol-21
5353 lowing: 22
5454 ‘‘(6) the standards for accreditation of the 23
5555 agency or association do not take into consideration 24
5656 the number of posthumous degrees awarded by the 25
5757 institution to deceased students;’’. 26

6161 (c) EFFECTIVEDATE.—The amendments made by 1
6262 this Act shall take effect on the date that is 1 year after 2
